Translation

The book “Suspicions and their Impact on Criminal Punishment in Jurisprudence” by Mansour Al-Hafnawi is concerned with studying the concept of suspicions and their impact on the application of criminal penalties in Islamic jurisprudence, in comparison with the provisions of positive law. In its chapters, the author deals with the definition of crime and felony, and its sections in terms of the act, punishment, and violated right, in addition to the elements of the crime and its legal, material, and moral components. It is also detailed in the chapter on punishment, reviewing aspects of penal legislation in Sharia law compared to law, with a focus on the role of suspicions in determining limits and penalties.
