Hadith 1. حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، وَابْنُ أَبِي خَلَفٍ، قَالاَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عَامِرِ بْنِ سَعْدٍ، عَنْ أَبِيهِ، قَالَ مَرِضَ مَرَضًا - قَالَ ابْنُ أَبِي خَلَفٍ - بِمَكَّةَ - ثُمَّ اتَّفَقَا - أَشْفَى فِيهِ فَعَادَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ لِي مَالاً كَثِيرًا وَلَيْسَ يَرِثُنِي إِلاَّ ابْنَتِي أَفَأَتَصَدَّقُ بِالثُّلُثَيْنِ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قَالَ فَبِالشَّطْرِ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قَالَ فَبِالثُّلُثِ قَالَ ‏"‏ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَتْرُكَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً إِلاَّ أُجِرْتَ بِهَا حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ ‏"‏ ‏.‏ قُلْتُ يَا رَسُولَ اللَّهِ أَتَخَلَّفُ عَنْ هِجْرَتِي قَالَ ‏"‏ إِنَّكَ إِنْ تُخَلَّفْ بَعْدِي فَتَعْمَلْ عَمَلاً صَالِحًا تُرِيدُ بِهِ وَجْهَ اللَّهِ لاَ تَزْدَادُ بِهِ إِلاَّ رِفْعَةً وَدَرَجَةً لَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ ‏"‏ ‏.‏ ثُمَّ قَالَ ‏"‏ اللَّهُمَّ أَمْضِ لأَصْحَابِي هِجْرَتَهُمْ وَلاَ تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنِ الْبَائِسُ سَعْدُ ابْنُ خَوْلَةَ يَرْثِي لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ مَاتَ بِمَكَّةَ ‏"‏ ‏.‏. Narrated 'Amir b. Sa'd:On the authority of his father (Sa'd b. Abi Waqqas): When he (Sa'd) fell ill at Mecca (according to the version of Ibn Abi Kkalaf) - then the agreed version has: which brought him near to death - the Messenger of Allah (ﷺ) went to visit him. He said: Messenger of Allah, I have a large amount of property, and my daughter is my only heir. May I give two-thirds (of my property) as a sadaqah (charity)? He said: No. He asked: Then a half ? He replied: No. He asked: Then one-third ? He replied: (You may will away) a third and third is a lot. To leave your heirs rich is better than to leave them poor begging from people. You will not spend anything, seeking thereby to please Allah, without being rewarded for it, even the mouthful you give your wife. I said: Messenger of Allah, shall I be left behind form immigration (to Medina)? He said: If you remain behind after me and do good works seeking the pleasure of Allah, your rank will be raised and degree increased. Perhaps you will not remain behind, and some people will benefit from you and others will be harmed by you. He then said: O Allah, complete the immigration of my Companions and do not turn them back. But miserable was Sa'd b. Khawlah. The Messenger of Allah (ﷺ) lamented on him as he died at Mecca (Grade: shahih. Source: Sunan Abu Dawud no. 2864.) Hadith 2. حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ، حَدَّثَنَا عُمَارَةُ بْنُ الْقَعْقَاعِ، عَنْ أَبِي زُرْعَةَ بْنِ عَمْرِو بْنِ جَرِيرٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَجُلٌ لِلنَّبِيِّ صلى الله عليه وسلم يَا رَسُولَ اللَّهِ أَىُّ الصَّدَقَةِ أَفْضَلُ قَالَ ‏ "‏ أَنْ تَصَدَّقَ وَأَنْتَ صَحِيحٌ حَرِيصٌ تَأْمُلُ الْبَقَاءَ وَتَخْشَى الْفَقْرَ وَلاَ تُمْهِلْ حَتَّى إِذَا بَلَغَتِ الْحُلْقُومَ قُلْتَ لِفُلاَنٍ كَذَا وَلِفُلاَنٍ كَذَا وَقَدْ كَانَ لِفُلاَنٍ ‏"‏ ‏.‏. Narrated Abu Hurairah:A man asked the Messenger of Allah (ﷺ): Messenger of Allah, which sadaqah (charity) is the best ? He replied: (The best sadaqah is) that you give something as sadaqah (charity) when you are healthy, greedy, expect survival and fear poverty, and not that you postpone it until your death. and then you say: For so-and-so is such-and-such, and for so-and-so is such-and-such, while it was already for so-and-so (Grade: shahih. Source: Sunan Abu Dawud no. 2865.) Hadith 3. حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ، حَدَّثَنَا ابْنُ أَبِي فُدَيْكٍ، أَخْبَرَنِي ابْنُ أَبِي ذِئْبٍ، عَنْ شُرَحْبِيلَ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ لأَنْ يَتَصَدَّقَ الْمَرْءُ فِي حَيَاتِهِ بِدِرْهَمٍ خَيْرٌ لَهُ مِنْ أَنْ يَتَصَدَّقَ بِمِائَةٍ عِنْدَ مَوْتِهِ ‏"‏ ‏.‏. Narrated AbuSa'id al-Khudri: The Prophet (ﷺ) said: A man giving a dirham as sadaqah (charity) during his life is better than giving one hundred dirhams as sadaqah (charity) at the moment of his death (Grade: shahih. Source: Sunan Abu Dawud no. 2866.) Hadith 4. حَدَّثَنَا عَبْدَةُ بْنُ عَبْدِ اللَّهِ، أَخْبَرَنَا عَبْدُ الصَّمَدِ، حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ الْحُدَّانِيُّ، حَدَّثَنَا الأَشْعَثُ بْنُ جَابِرٍ، حَدَّثَنِي شَهْرُ بْنُ حَوْشَبٍ، أَنَّ أَبَا هُرَيْرَةَ، حَدَّثَهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ إِنَّ الرَّجُلَ لَيَعْمَلُ وَالْمَرْأَةَ بِطَاعَةِ اللَّهِ سِتِّينَ سَنَةً ثُمَّ يَحْضُرُهُمَا الْمَوْتُ فَيُضَارَّانِ فِي الْوَصِيَّةِ فَتَجِبُ لَهُمَا النَّارُ ‏"‏ ‏.‏ قَالَ وَقَرَأَ عَلَىَّ أَبُو هُرَيْرَةَ مِنْ هَا هُنَا ‏{‏ مِنْ بَعْدِ وَصِيَّةٍ يُوصَى بِهَا أَوْ دَيْنٍ غَيْرَ مُضَارٍّ ‏}‏ حَتَّى بَلَغَ ‏{‏ ذَلِكَ الْفَوْزُ الْعَظِيمُ ‏}‏ ‏.‏ قَالَ أَبُو دَاوُدَ هَذَا - يَعْنِي الأَشْعَثَ بْنَ جَابِرٍ - جَدُّ نَصْرِ بْنِ عَلِيٍّ ‏.‏. Narrated AbuHurayrah: The Prophet (ﷺ) said: A man or a woman acts in obedience to Allah for sixty years, then when they are about to die they cause injury by their will, so they must go to Hell. Then AbuHurayrah recited: "After a legacy which you bequeath or a debt, causing no injury...that will be the mighty success. Abu Dawud said: Al-Ash'ath b. Jabir is the grandfather of Nasr b. 'Ali (Grade: shahih. Source: Sunan Abu Dawud no. 2867.) Hadith 5. حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، حَدَّثَنَا أَبُو عَبْدِ الرَّحْمَنِ الْمُقْرِئُ، حَدَّثَنَا سَعِيدُ بْنُ أَبِي أَيُّوبَ، عَنْ عُبَيْدِ اللَّهِ بْنِ أَبِي جَعْفَرٍ، عَنْ سَالِمِ بْنِ أَبِي سَالِمٍ الْجَيْشَانِيِّ، عَنْ أَبِيهِ، عَنْ أَبِي ذَرٍّ، قَالَ قَالَ لِي رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ يَا أَبَا ذَرٍّ إِنِّي أَرَاكَ ضَعِيفًا وَإِنِّي أُحِبُّ لَكَ مَا أُحِبُّ لِنَفْسِي فَلاَ تَأَمَّرَنَّ عَلَى اثْنَيْنِ وَلاَ تَوَلَّيَنَّ مَالَ يَتِيمٍ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ تَفَرَّدَ بِهِ أَهْلُ مِصْرَ ‏.‏. Narrated Abu Dharr: The Messenger of Allah (ﷺ) said to me: Abu Dharr, I see you weak, and I like for you what I like for myself. Do not be a leader of two (persons), and do not be a guardian of an orphan. Abu Dawud said: This has been narrated only by the people of Egypt (Grade: shahih. Source: Sunan Abu Dawud no. 2868.) Hadith 6. حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدٍ الْمَرْوَزِيُّ، حَدَّثَنِي عَلِيُّ بْنُ حُسَيْنِ بْنِ وَاقِدٍ، عَنْ أَبِيهِ، عَنْ يَزِيدَ النَّحْوِيِّ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، ‏{‏ إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ ‏}‏ فَكَانَتِ الْوَصِيَّةُ كَذَلِكَ حَتَّى نَسَخَتْهَا آيَةُ الْمِيرَاثِ ‏.‏. Narrated Ibn 'Abbas:The Qur'anic verse goes: "(It is prescribed when death approaches any of you), if he leaves any goods, that he may bequest to parents and next to kin." The bequest was made in this way until the verse of inheritance repealed it (Grade: shahih. Source: Sunan Abu Dawud no. 2869.) Hadith 7. حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ نَجْدَةَ، حَدَّثَنَا ابْنُ عَيَّاشٍ، عَنْ شُرَحْبِيلَ بْنِ مُسْلِمٍ، سَمِعْتُ أَبَا أُمَامَةَ، سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ إِنَّ اللَّهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ فَلاَ وَصِيَّةَ لِوَارِثٍ ‏"‏ ‏.‏. Narrated AbuHurayrah: I heard the Messenger of Allah (ﷺ) say: Allah has appointed for everyone who has a right what is due to him, and no bequest must be made to an heir (Grade: shahih. Source: Sunan Abu Dawud no. 2870.) Hadith 8. حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا جَرِيرٌ، عَنْ عَطَاءٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ لَمَّا أَنْزَلَ اللَّهُ عَزَّ وَجَلَّ ‏{‏ وَلاَ تَقْرَبُوا مَالَ الْيَتِيمِ إِلاَّ بِالَّتِي هِيَ أَحْسَنُ ‏}‏ وَ ‏{‏ إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَى ظُلْمًا ‏}‏ الآيَةَ انْطَلَقَ مَنْ كَانَ عِنْدَهُ يَتِيمٌ فَعَزَلَ طَعَامَهُ مِنْ طَعَامِهِ وَشَرَابَهُ مِنْ شَرَابِهِ فَجَعَلَ يَفْضُلُ مِنْ طَعَامِهِ فَيُحْبَسُ لَهُ حَتَّى يَأْكُلَهُ أَوْ يَفْسُدَ فَاشْتَدَّ ذَلِكَ عَلَيْهِمْ فَذَكَرُوا ذَلِكَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ ‏{‏ وَيَسْأَلُونَكَ عَنِ الْيَتَامَى قُلْ إِصْلاَحٌ لَهُمْ خَيْرٌ وَإِنْ تُخَالِطُوهُمْ فَإِخْوَانُكُمْ ‏}‏ فَخَلَطُوا طَعَامَهُمْ بِطَعَامِهِ وَشَرَابَهُمْ بِشَرَابِهِ ‏.‏. Narrated Abdullah ibn Abbas: When Allah, Most High, revealed the verses: "Come not nigh to the orphan's property except to improve it". And "Those who unjustly eat up the property of orphans", everyone who had an orphan with him went and separated his food from his (orphan's) food, and his drink from his drink, and began to detain the remaining food which he (the orphan) himself ate or spoiled. This fell heavy on them, and they mentioned this to the Messenger of Allah (ﷺ). So Allah, Most High, revealed the verse: "They ask thee concerning orphans. Say: The best thing to do is what is for their good; if ye mix their affairs with yours, they are your brethren." Then they mixed their food with his food and their drink with his drink (Grade: shahih. Source: Sunan Abu Dawud no. 2871.) Hadith 9. حَدَّثَنَا حُمَيْدُ بْنُ مَسْعَدَةَ، أَنَّ خَالِدَ بْنَ الْحَارِثِ، حَدَّثَهُمْ حَدَّثَنَا حُسَيْنٌ، - يَعْنِي الْمُعَلِّمَ - عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَجُلاً، أَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ إِنِّي فَقِيرٌ لَيْسَ لِي شَىْءٌ وَلِي يَتِيمٌ ‏.‏ قَالَ فَقَالَ ‏ "‏ كُلْ مِنْ مَالِ يَتِيمِكَ غَيْرَ مُسْرِفٍ وَلاَ مُبَادِرٍ وَلاَ مُتَأَثِّلٍ ‏"‏ ‏.‏. Narrated 'Amr b. Suh'aib: On his father's authority, said that his grandfather told that a man came to the Prophet (ﷺ) and said: I am poor, I have nothing (with me), and I have an orphan. He said: Use the property of your orphan without spending it lavishly, hurrying and taking it as your own property (Grade: shahih. Source: Sunan Abu Dawud no. 2872.) Hadith 10. حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ، حَدَّثَنَا يَحْيَى بْنُ مُحَمَّدٍ الْمَدِينِيُّ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ خَالِدِ بْنِ سَعِيدِ بْنِ أَبِي مَرْيَمَ، عَنْ أَبِيهِ، عَنْ سَعِيدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ بْنِ رُقَيْشٍ، أَنَّهُ سَمِعَ شُيُوخًا، مِنْ بَنِي عَمْرِو بْنِ عَوْفٍ وَمِنْ خَالِهِ عَبْدِ اللَّهِ بْنِ أَبِي أَحْمَدَ قَالَ قَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ حَفِظْتُ عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏ "‏ لاَ يُتْمَ بَعْدَ احْتِلاَمٍ وَلاَ صُمَاتَ يَوْمٍ إِلَى اللَّيْلِ ‏"‏ ‏.‏. Narrated Ali ibn AbuTalib: I memorised (a tradition) from the Messenger of Allah (ﷺ): There is no orphanhood after puberty, and there is no silence for the whole day till the night (Grade: shahih. Source: Sunan Abu Dawud no. 2873.) Hadith 11. حَدَّثَنَا أَحْمَدُ بْنُ سَعِيدٍ الْهَمْدَانِيُّ، حَدَّثَنَا ابْنُ وَهْبٍ، عَنْ سُلَيْمَانَ بْنِ بِلاَلٍ، عَنْ ثَوْرِ بْنِ زَيْدٍ، عَنْ أَبِي الْغَيْثِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ اجْتَنِبُوا السَّبْعَ الْمُوبِقَاتِ ‏"‏ ‏.‏ قِيلَ يَا رَسُولَ اللَّهِ وَمَا هُنَّ قَالَ ‏"‏ الشِّرْكُ بِاللَّهِ وَالسِّحْرُ وَقَتْلُ النَّفْسِ الَّتِي حَرَّمَ اللَّهُ إِلاَّ بِالْحَقِّ وَأَكْلُ الرِّبَا وَأَكْلُ مَالِ الْيَتِيمِ وَالتَّوَلِّي يَوْمَ الزَّحْفِ وَقَذْفُ الْمُحْصَنَاتِ الْغَافِلاَتِ الْمُؤْمِنَاتِ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ أَبُو الْغَيْثِ سَالِمٌ مَوْلَى ابْنِ مُطِيعٍ ‏.‏. Narrated Abu Hurairah: The Messenger of Allah (ﷺ) as saying: Refrain from seven (characteristics) which cause destruction. He was asked: What are they, Messenger of Allah ? He replied: To assign partner to Allah, magic, to kill a soul (man) which is prohibited by Allah except for which is due, to take usury, to consume the property of an orphan, to retreat on the day of the battle, and to slander chaste women, indiscreet but believing. Abu Dawud said: The name Abu al-Ghaith is Salim client of Ibn Muti (Grade: shahih. Source: Sunan Abu Dawud no. 2874.) Hadith 12. حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ، أَخْبَرَنَا سُفْيَانُ، عَنِ الأَعْمَشِ، عَنْ أَبِي وَائِلٍ، عَنْ خَبَّابٍ، قَالَ مُصْعَبُ بْنُ عُمَيْرٍ قُتِلَ يَوْمَ أُحُدٍ وَلَمْ تَكُنْ لَهُ إِلاَّ نَمِرَةٌ كُنَّا إِذَا غَطَّيْنَا بِهَا رَأْسَهُ خَرَجَتْ رِجْلاَهُ وَإِذَا غَطَّيْنَا رِجْلَيْهِ خَرَجَ رَأْسُهُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ غَطُّوا بِهَا رَأْسَهُ وَاجْعَلُوا عَلَى رِجْلَيْهِ مِنَ الإِذْخِرِ ‏"‏ ‏.‏. Narrated Khabbab:Mus'ab b. 'Umar was killed at the battle of Uhud, and for him only a coarse cloth would be found as shroud. When we covered his head, his feet showed, and when we covered his feet, his head showed. So the Messenger of Allah (ﷺ) said: Cover his head with it (cloth), and put some rushes over his feet (Grade: shahih. Source: Sunan Abu Dawud no. 2876.) Hadith 13. حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ، حَدَّثَنَا زُهَيْرٌ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عَطَاءٍ، عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، بُرَيْدَةَ أَنَّ امْرَأَةً، أَتَتْ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَتْ كُنْتُ تَصَدَّقْتُ عَلَى أُمِّي بِوَلِيدَةٍ وَإِنَّهَا مَاتَتْ وَتَرَكَتْ تِلْكَ الْوَلِيدَةَ ‏.‏ قَالَ ‏"‏ قَدْ وَجَبَ أَجْرُكِ وَرَجَعَتْ إِلَيْكِ فِي الْمِيرَاثِ ‏"‏ ‏.‏ قَالَتْ وَإِنَّهَا مَاتَتْ وَعَلَيْهَا صَوْمُ شَهْرٍ أَفَيُجْزِئُ - أَوْ يَقْضِي - عَنْهَا أَنْ أَصُومَ عَنْهَا قَالَ ‏"‏ نَعَمْ ‏"‏ ‏.‏ قَالَتْ وَإِنَّهَا لَمْ تَحُجَّ أَفَيُجْزِئُ - أَوْ يَقْضِي - عَنْهَا أَنْ أَحُجَّ عَنْهَا قَالَ ‏"‏ نَعَمْ ‏"‏ ‏.‏. Narrated Buraidah:A woman came to the Messenger of Allah (ﷺ) and said: I donated my slave-girl to my mother, but she died and left the slave-girl. He said: Your reward became due, and she came back to you in inheritance. She said: She died while a month's fasting was due from her. Would it be sufficient or be taken as completed if I fast on her behalf ? He said: Yes. She said: She also did not perform Hajj. Would it be sufficient or be taken completed if I perform (Hajj) on her behalf ? He said: Yes (Grade: shahih. Source: Sunan Abu Dawud no. 2877.) Hadith 14. حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْمَهْرِيُّ، حَدَّثَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي اللَّيْثُ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ صَدَقَةِ، عُمَرَ بْنِ الْخَطَّابِ رضى الله عنه قَالَ نَسَخَهَا لِي عَبْدُ الْحَمِيدِ بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا كَتَبَ عَبْدُ اللَّهِ عُمَرُ فِي ثَمْغٍ فَقَصَّ مِنْ خَبَرِهِ نَحْوَ حَدِيثِ نَافِعٍ قَالَ غَيْرَ مُتَأَثِّلٍ مَالاً فَمَا عَفَا عَنْهُ مِنْ ثَمَرِهِ فَهُوَ لِلسَّائِلِ وَالْمَحْرُومِ - قَالَ وَسَاقَ الْقِصَّةَ - قَالَ وَإِنْ شَاءَ وَلِيُّ ثَمْغٍ اشْتَرَى مِنْ ثَمَرِهِ رَقِيقًا لِعَمَلِهِ وَكَتَبَ مُعَيْقِيبٌ وَشَهِدَ عَبْدُ اللَّهِ بْنُ الأَرْقَمِ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ هَذَا مَا أَوْصَى بِهِ عَبْدُ اللَّهِ عُمَرُ أَمِيرُ الْمُؤْمِنِينَ إِنْ حَدَثَ بِهِ حَدَثٌ أَنَّ ثَمْغًا وَصِرْمَةَ بْنَ الأَكْوَعِ وَالْعَبْدَ الَّذِي فِيهِ وَالْمِائَةَ سَهْمٍ الَّتِي بِخَيْبَرَ وَرَقِيقَهُ الَّذِي فِيهِ وَالْمِائَةَ الَّتِي أَطْعَمَهُ مُحَمَّدٌ صلى الله عليه وسلم بِالْوَادِي تَلِيهِ حَفْصَةُ مَا عَاشَتْ ثُمَّ يَلِيهِ ذُو الرَّأْىِ مِنْ أَهْلِهَا أَنْ لاَ يُبَاعَ وَلاَ يُشْتَرَى يُنْفِقُهُ حَيْثُ رَأَى مِنَ السَّائِلِ وَالْمَحْرُومِ وَذِي الْقُرْبَى وَلاَ حَرَجَ عَلَى مَنْ وَلِيَهُ إِنْ أَكَلَ أَوْ آكَلَ أَوِ اشْتَرَى رَقِيقًا مِنْهُ ‏.‏. Narrated Yahya b. Sa'id:'Abd al-Hamid b. Abd 'Allah b. 'Abd Allah b. 'Umar b. al-Khattab copied to me a document about the religious endowment (waqf) made by 'Umar b. al-Khattab : In the name of Allah, the Compassionate, the Merciful. This is what Allah's servant 'Umar has written about Thamgh. He narrated the tradition like the one transmitted by Nafi'. He added: "provided he is not storing up goods (for himself)". The surplus fruit will be devoted to the beggar and the deprived. He then went on with the tradition, saying: If the man in charge of Thamgh wishes to buy a slave for his work for its fruits (by selling them), he may do so. Mu'iqib penned it and 'Abd Allah b. al-Arqam witnessed it : In the name of Allah, the Compassionate, the Merciful. This is what Allah's servant 'Umar , Commander of Faithful, directed, in case of some incident happens to him (i.e. he dies), that Thamg, Sirmah b. al-Akwa', the servant who is there, the hundred shares in (the land of) Khaibr, the servant who is there and the hundred sahres which Muhammad (ﷺ) had donated to me in the valley (nearly) will remain in the custody of Hafsah during her life, then the men of opinion from her family will be in charge of these (endowments), that these will neither be sold not purchased, spending (its produce) where they think (necessary on the beggar, deprived and relatives). There is no harm to the one in charge (of this endowment) if he eats himself, or feeds, or buys slaves with it (Grade: shahih. Source: Sunan Abu Dawud no. 2879.) Hadith 15. حَدَّثَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ الْمُؤَذِّنُ، حَدَّثَنَا ابْنُ وَهْبٍ، عَنْ سُلَيْمَانَ، - يَعْنِي ابْنَ بِلاَلٍ - عَنِ الْعَلاَءِ بْنِ عَبْدِ الرَّحْمَنِ، أُرَاهُ عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ إِذَا مَاتَ الإِنْسَانُ انْقَطَعَ عَنْهُ عَمَلُهُ إِلاَّ مِنْ ثَلاَثَةِ أَشْيَاءَ مِنْ صَدَقَةٍ جَارِيَةٍ أَوْ عِلْمٍ يُنْتَفَعُ بِهِ أَوْ وَلَدٍ صَالِحٍ يَدْعُو لَهُ ‏"‏ ‏.‏. Narrated Abu Hurairah:The Messenger of Allah (ﷺ) as saying: When a man dies, his action discontinues from him except three things, namely, perpetual sadaqah (charity), or the knowledge by which benefit is acquired, or a pious child who prays for him (Grade: shahih. Hadith 16. حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، أَنَّ امْرَأَةً، قَالَتْ يَا رَسُولَ اللَّهِ إِنَّ أُمِّيَ افْتُلِتَتْ نَفْسُهَا وَلَوْلاَ ذَلِكَ لَتَصَدَّقَتْ وَأَعْطَتْ أَفَيُجْزِئُ أَنْ أَتَصَدَّقَ عَنْهَا فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏ "‏ نَعَمْ فَتَصَدَّقِي عَنْهَا ‏"‏ ‏.‏. Narrated Aisha, Ummul Mu'minin: A woman said: Messenger of Allah, my mother suddenly died; if it had not happened, she would have given sadaqah (charity) and donated (something). Will it suffice if I give sadaqah on her behalf? The Prophet (ﷺ) said: Yes, give sadaqah on her behalf (Grade: shahih. Source: Sunan Abu Dawud no. 2881.) Hadith 17. حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا زَكَرِيَّا بْنُ إِسْحَاقَ، أَخْبَرَنَا عَمْرُو بْنُ دِينَارٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَجُلاً، قَالَ يَا رَسُولَ اللَّهِ إِنَّ أُمِّي تُوُفِّيَتْ أَفَيَنْفَعُهَا إِنْ تَصَدَّقْتُ عَنْهَا فَقَالَ ‏ "‏ نَعَمْ ‏"‏ ‏.‏ قَالَ فَإِنَّ لِي مَخْرَفًا وَإِنِّي أُشْهِدُكَ أَنِّي قَدْ تَصَدَّقْتُ بِهِ عَنْهَا ‏.‏. Narrated Ibn 'Abbas:A man said: Messenger of Allah, my mother has died ; will it benefit her if I give sadaqah on her behalf ? He said: Yes. He said: I have a garden, and I call you to witness that I have given it as sadaqah on her behalf (Grade: shahih. Source: Sunan Abu Dawud no. 2882.) Hadith 18. حَدَّثَنَا الْعَبَّاسُ بْنُ الْوَلِيدِ بْنِ مَزْيَدٍ، أَخْبَرَنِي أَبِي، حَدَّثَنَا الأَوْزَاعِيُّ، حَدَّثَنِي حَسَّانُ بْنُ عَطِيَّةَ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ الْعَاصَ بْنَ وَائِلٍ، أَوْصَى أَنْ يُعْتَقَ، عَنْهُ مِائَةُ رَقَبَةٍ فَأَعْتَقَ ابْنُهُ هِشَامٌ خَمْسِينَ رَقَبَةً فَأَرَادَ ابْنُهُ عَمْرٌو أَنْ يَعْتِقَ عَنْهُ الْخَمْسِينَ الْبَاقِيَةَ فَقَالَ حَتَّى أَسْأَلَ رَسُولَ اللَّهِ صلى الله عليه وسلم فَأَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ أَبِي أَوْصَى بِعِتْقِ مِائَةِ رَقَبَةٍ وَإِنَّ هِشَامًا أَعْتَقَ عَنْهُ خَمْسِينَ وَبَقِيَتْ عَلَيْهِ خَمْسُونَ رَقَبَةً أَفَأُعْتِقُ عَنْهُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ إِنَّهُ لَوْ كَانَ مُسْلِمًا فَأَعْتَقْتُمْ عَنْهُ أَوْ تَصَدَّقْتُمْ عَنْهُ أَوْ حَجَجْتُمْ عَنْهُ بَلَغَهُ ذَلِكَ ‏"‏ ‏.‏. Narrated 'Amr b. Suh'aib: On his father's authority, said that his grandfather told that Al-'As ibn Wa'il left his will that a hundred slaves should be emancipated on his behalf. His son Hisham emancipated fifty slaves and his son Amr intended to emancipate the remaining fifty on his behalf, but he said: I should ask first the Messenger of Allah (ﷺ). He, therefore, came to the Prophet (ﷺ) and said: Messenger of Allah, my father left in his will that a hundred slaves should be emancipated on his behalf and Hisham has emancipated fifty on his behalf and fifty remain. Shall I emancipate them on his behalf? The Messenger of Allah (ﷺ) said: Had he been a Muslim and you had emancipated slaves on his behalf, or given sadaqah on his behalf, or performed the pilgrimage, that would have reached him (Grade: shahih. Hadith 19. حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلاَءِ، أَنَّ شُعَيْبَ بْنَ إِسْحَاقَ، حَدَّثَهُمْ عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ وَهْبِ بْنِ كَيْسَانَ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، أَنَّهُ أَخْبَرَهُ أَنَّ أَبَاهُ تُوُفِّيَ وَتَرَكَ عَلَيْهِ ثَلاَثِينَ وَسْقًا لِرَجُلٍ مِنْ يَهُودَ فَاسْتَنْظَرَهُ جَابِرٌ فَأَبَى فَكَلَّمَ جَابِرٌ النَّبِيَّ صلى الله عليه وسلم أَنْ يَشْفَعَ لَهُ إِلَيْهِ فَجَاءَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَكَلَّمَ الْيَهُودِيَّ لِيَأْخُذَ ثَمَرَ نَخْلِهِ بِالَّذِي لَهُ عَلَيْهِ فَأَبَى عَلَيْهِ وَكَلَّمَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ يُنْظِرَهُ فَأَبَى ‏.‏ وَسَاقَ الْحَدِيثَ ‏.‏. Narrated Jabir bin ‘Abdullah :That his father died and left a debt of thirty wasqs of a Jew on him. Jabir asked him to defer, but he refused. Jabir then spoke to the Messenger of Allah (ﷺ) asking him to mediate to him on his behalf. The Messenger of Allah (ﷺ) came to the Jew and spoke to him about taking fruit-dates in lieu of the debt that was on him. But he refused. The Messenger of Allah (ﷺ) asked him to defer (the debt) to him, but he refused. He then narrated the rest of the tradition (Grade: shahih. Source: Sunan Abu Dawud no. 2884.) Hadith 20. حَدَّثَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ، أَخْبَرَنَا ابْنُ وَهْبٍ، حَدَّثَنِي عَبْدُ الرَّحْمَنِ بْنُ زِيَادٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ رَافِعٍ التَّنُوخِيِّ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ الْعِلْمُ ثَلاَثَةٌ وَمَا سِوَى ذَلِكَ فَهُوَ فَضْلٌ آيَةٌ مُحْكَمَةٌ أَوْ سُنَّةٌ قَائِمَةٌ أَوْ فَرِيضَةٌ عَادِلَةٌ ‏"‏ ‏.‏. Narrated Abdullah ibn Amr ibn al-'As: The Prophet (ﷺ) said: Knowledge has three categories; anything else is extra; a precise verse, or an established sunnah (practice), or a firm obligatory duty (Grade: shahih. Hadith 21. حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا سُفْيَانُ، قَالَ سَمِعْتُ ابْنَ الْمُنْكَدِرِ، أَنَّهُ سَمِعَ جَابِرًا، يَقُولُ مَرِضْتُ فَأَتَانِي النَّبِيُّ صلى الله عليه وسلم يَعُودُنِي هُوَ وَأَبُو بَكْرٍ مَاشِيَيْنِ وَقَدْ أُغْمِيَ عَلَىَّ فَلَمْ أُكَلِّمْهُ فَتَوَضَّأَ وَصَبَّهُ عَلَىَّ فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللَّهِ كَيْفَ أَصْنَعُ فِي مَالِي وَلِي أَخَوَاتٌ قَالَ فَنَزَلَتْ آيَةُ الْمَوَارِيثِ ‏{‏ يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلاَلَةِ ‏}‏ ‏.‏. Narrated Jabir:I fell ill, and the Prophet (ﷺ) and Abu Bakr came to me on foot to visit me. As I was unconscious, I could not speak to him. He performed ablution and sprinkled water on me ; so I became conscious. I said: Messenger of Allah, how should I do in my property, as I have sisters? Thereafter the verse about inheritance was revealed: "They ask thee for legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs (Grade: shahih. Source: Sunan Abu Dawud no. 2886.) Hadith 22. حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا كَثِيرُ بْنُ هِشَامٍ، حَدَّثَنَا هِشَامٌ، - يَعْنِي الدَّسْتَوَائِيَّ - عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ اشْتَكَيْتُ وَعِنْدِي سَبْعُ أَخَوَاتٍ فَدَخَلَ عَلَىَّ رَسُولُ اللَّهِ صلى الله عليه وسلم فَنَفَخَ فِي وَجْهِي فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللَّهِ أَلاَ أُوصِي لأَخَوَاتِي بِالثُّلُثِ قَالَ ‏"‏ أَحْسِنْ ‏"‏ ‏.‏ قُلْتُ الشَّطْرَ قَالَ ‏"‏ أَحْسِنْ ‏"‏ ‏.‏ ثُمَّ خَرَجَ وَتَرَكَنِي فَقَالَ ‏"‏ يَا جَابِرُ لاَ أُرَاكَ مَيِّتًا مِنْ وَجَعِكَ هَذَا وَإِنَّ اللَّهَ قَدْ أَنْزَلَ فَبَيَّنَ الَّذِي لأَخَوَاتِكَ فَجَعَلَ لَهُنَّ الثُّلُثَيْنِ ‏"‏ ‏.‏ قَالَ فَكَانَ جَابِرٌ يَقُولُ أُنْزِلَتْ هَذِهِ الآيَةُ فِيَّ ‏{‏ يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلاَلَةِ ‏}‏ ‏.‏. Narrated Jabir ibn Abdullah: I fell ill, and I had seven sisters. The Messenger of Allah (ﷺ) came to me and blew on my face. So I became conscious. I said: Messenger of Allah, may I not bequeath one-third of my property to my sisters? He replied: Do good. I asked: Half? He replied: Do good. He then went out and left me, and said: I do not think, Jabir, you will die of this disease. Allah has revealed (verses) and described the share of your sisters. He appointed two-thirds for them. Jabir used to say: This verse was revealed about me: "They ask thee for a legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs (Grade: shahih. Source: Sunan Abu Dawud no. 2887.) Hadith 23. حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا شُعْبَةُ، عَنْ أَبِي إِسْحَاقَ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ آخِرُ آيَةٍ نَزَلَتْ فِي الْكَلاَلَةِ ‏{‏ يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلاَلَةِ ‏}‏ ‏.‏. Narrated Al-Bara' bin 'Azib:The last verse revealed about the decease who left no descendants or ascendants: "They ask thee for the legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs (Grade: shahih. Source: Sunan Abu Dawud no. 2888.) Hadith 24. حَدَّثَنَا مَنْصُورُ بْنُ أَبِي مُزَاحِمٍ، حَدَّثَنَا أَبُو بَكْرٍ، عَنْ أَبِي إِسْحَاقَ، عَنِ الْبَرَاءِ بْنِ عَازِبٍ، قَالَ جَاءَ رَجُلٌ إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ يَسْتَفْتُونَكَ فِي الْكَلاَلَةِ فَمَا الْكَلاَلَةُ قَالَ ‏ "‏ تُجْزِيكَ آيَةُ الصَّيْفِ ‏"‏ ‏.‏ فَقُلْتُ لأَبِي إِسْحَاقَ هُوَ مَنْ مَاتَ وَلَمْ يَدَعْ وَلَدًا وَلاَ وَالِدًا قَالَ كَذَلِكَ ظَنُّوا أَنَّهُ كَذَلِكَ ‏.‏. Narrated Al-Bara' ibn Azib: A man came to the Prophet (ﷺ) and said: Messenger of Allah, they ask thee for a legal decision about a kalalah. What is meant by kalalah? He replied: The verse revealed in summer is sufficient for you. I asked AbuIshaq: Does it mean a person who dies and leaves neither children nor father? He said: This is so. The people think it is so (Grade: shahih. Source: Sunan Abu Dawud no. 2889.) Hadith 25. حَدَّثَنَا عَبْدُ اللَّهِ بْنُ عَامِرِ بْنِ زُرَارَةَ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، عَنِ الأَعْمَشِ، عَنْ أَبِي قَيْسٍ الأَوْدِيِّ، عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ الأَوْدِيِّ، قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى الأَشْعَرِيِّ وَسَلْمَانَ بْنِ رَبِيعَةَ فَسَأَلَهُمَا عَنِ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ، لأَبٍ وَأُمٍّ فَقَالاَ لاِبْنَتِهِ النِّصْفُ وَلِلأُخْتِ مِنَ الأَبِ وَالأُمِّ النِّصْفُ وَلَمْ يُوَرِّثَا ابْنَةَ الاِبْنِ شَيْئًا وَأْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا فَأَتَاهُ الرَّجُلُ فَسَأَلَهُ وَأَخْبَرَهُ بِقَوْلِهِمَا فَقَالَ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنِّي سَأَقْضِي فِيهَا بِقَضَاءِ النَّبِيِّ صلى الله عليه وسلم لاِبْنَتِهِ النِّصْفُ وَلاِبْنَةِ الاِبْنِ سَهْمٌ تَكْمِلَةُ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلأُخْتِ مِنَ الأَبِ وَالأُمِّ ‏.‏. Narrated Huzail b. Shurahbil al-Awadi:A man came to Abu Musa al-Ash'ari and Salman b. Rabi'ah, and asked about a case where there were a daughter, a son's daughter and full sister. They replied: The daughter gets half and the full gets half. The son's daughter gets nothing. Go to Ibn Mas'ud and you will find that he agrees with me. So the man came to him and informed him about their opinion. He said: I would then be in error and not be one of those who are rightly guided. But I decide concerning the matter as the Messenger of Allah (ﷺ) did: The daughter gets half, and the son's daughter gets a share which complete thirds (i.e. gets a sixth), and what remain to the full sister (Grade: shahih. Hadith 26. حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَقِيلٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ خَرَجْنَا مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم حَتَّى جِئْنَا امْرَأَةً مِنَ الأَنْصَارِ فِي الأَسْوَاقِ فَجَاءَتِ الْمَرْأَةُ بِابْنَتَيْنِ لَهَا فَقَالَتْ يَا رَسُولَ اللَّهِ هَاتَانِ بِنْتَا ثَابِتِ بْنِ قَيْسٍ قُتِلَ مَعَكَ يَوْمَ أُحُدٍ وَقَدِ اسْتَفَاءَ عَمُّهُمَا مَالَهُمَا وَمِيرَاثَهُمَا كُلَّهُ فَلَمْ يَدَعْ لَهُمَا مَالاً إِلاَّ أَخَذَهُ فَمَا تَرَى يَا رَسُولَ اللَّهِ فَوَاللَّهِ لاَ تُنْكَحَانِ أَبَدًا إِلاَّ وَلَهُمَا مَالٌ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ يَقْضِي اللَّهُ فِي ذَلِكَ ‏"‏ ‏.‏ قَالَ وَنَزَلَتْ سُورَةُ النِّسَاءِ ‏{‏ يُوصِيكُمُ اللَّهُ فِي أَوْلاَدِكُمْ ‏}‏ الآيَةَ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ ادْعُوا لِيَ الْمَرْأَةَ وَصَاحِبَهَا ‏"‏ ‏.‏ فَقَالَ لِعَمِّهِمَا ‏"‏ أَعْطِهِمَا الثُّلُثَيْنِ وَأَعْطِ أُمَّهُمَا الثُّمُنَ وَمَا بَقِيَ فَلَكَ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ أَخْطَأَ بِشْرٌ فِيهِ إِنَّمَا هُمَا ابْنَتَا سَعْدِ بْنِ الرَّبِيعِ وَثَابِتُ بْنُ قَيْسٍ قُتِلَ يَوْمَ الْيَمَامَةِ ‏.‏. Narrated Jabir ibn Abdullah: We went out with the Messenger of Allah (ﷺ) and came to a woman of the Ansar in al-Aswaf. The woman brought her two daughters, and said: Messenger of Allah, these are the daughters of Thabit ibn Qays who was killed as a martyr when he was with you at the battle of Uhud, their paternal uncle has taken all their property and inheritance, and he has not left anything for them. What do you think, Messenger of Allah? They cannot be married unless they have some property. The Messenger of Allah (ﷺ) said: Allah will decide regarding the matter. Then the verse of Surat an-Nisa was revealed: "Allah (thus) directs you as regards your children's (inheritance)." Messenger of Allah (ﷺ) said: Call to me the woman and her husband's brother. He then said to their paternal uncle: Give them two-thirds and their mother an eighth, and what remains is yours. Abu Dawud said: The narrator Bishr made a mistake. They were the daughters of Sa'd b. al-Rabi' for Thabit b. Qais was killed in the battle of Yamamah (Grade: shahih. Source: Sunan Abu Dawud no. 2891.) Hadith 27. حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا أَبَانُ، حَدَّثَنَا قَتَادَةُ، حَدَّثَنِي أَبُو حَسَّانَ، عَنِ الأَسْوَدِ بْنِ يَزِيدَ، أَنَّ مُعَاذَ بْنَ جَبَلٍ، وَرَّثَ أُخْتًا وَابْنَةً فَجَعَلَ لِكُلِّ وَاحِدَةٍ مِنْهُمَا النِّصْفَ وَهُوَ بِالْيَمَنِ وَنَبِيُّ اللَّهِ صلى الله عليه وسلم يَوْمَئِذٍ حَىٌّ ‏.‏. Narrated Al-Aswad b. Yazid:Mu'adh b. Jabal gave shares of inheritance to a sister and a daughter. He gave each of them half. He was at Yemen while the Prophet (ﷺ) was alive (Grade: shahih. Hadith 28. حَدَّثَنَا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُثْمَانَ بْنِ إِسْحَاقَ بْنِ خَرَشَةَ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ، أَنَّهُ قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ تَعَالَى شَىْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ نَبِيِّ اللَّهِ صلى الله عليه وسلم شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ ‏.‏ فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ حَضَرْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم أَعْطَاهَا السُّدُسَ ‏.‏ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ ثُمَّ جَاءَتِ الْجَدَّةُ الأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ رضى الله عنه تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ تَعَالَى شَىْءٌ وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلاَّ لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ وَلَكِنْ هُوَ ذَلِكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا ‏.‏. Narrated Qabisah ibn Dhuwayb: A grandmother came to AbuBakr asking him for her share of inheritance. He said: There is nothing prescribed for you in Allah's Book, nor do I know anything for you in the Sunnah of the Prophet of Allah (ﷺ) Go home till I question the people. He then questioned the people, and al-Mughirah ibn Shu'bah said: I had been present with the Messenger of Allah (ﷺ) when he gave grandmother a sixth. AbuBakr said: Is there anyone with you? Muhammad ibn Maslamah stood and said the same as al-Mughirah ibn Shu'bah had said. So AbuBakr made it apply to her. Another grandmother came to Umar ibn al-Khattab asking him for her share of inheritance. He said: Nothing has been prescribed for you in Allah's Book. The decision made before you was made for a grandmother other than you. I am not going to add in the shares of inheritance; but it is that sixth. If there are two of you, it is shared between you, but whichever of you is the only one left gets it all (Grade: shahih. Source: Sunan Abu Dawud no. 2894.) Hadith 29. حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْعَزِيزِ بْنِ أَبِي رِزْمَةَ، أَخْبَرَنِي أَبِي، حَدَّثَنَا عُبَيْدُ اللَّهِ أَبُو الْمُنِيبِ الْعَتَكِيُّ، عَنِ ابْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم جَعَلَ لِلْجَدَّةِ السُّدُسَ إِذَا لَمْ تَكُنْ دُونَهَا أُمٌّ ‏.‏. Narrated Buraydah: The Prophet (ﷺ) appointed a sixth to a grandmother if no mother is left to inherit before her (Grade: shahih. Source: Sunan Abu Dawud no. 2895.) Hadith 30. حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ، أَخْبَرَنَا هَمَّامٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ عِمْرَانَ بْنِ حُصَيْنٍ، أَنَّ رَجُلاً، أَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ إِنَّ ابْنَ ابْنِي مَاتَ فَمَا لِي مِنْ مِيرَاثِهِ فَقَالَ ‏"‏ لَكَ السُّدُسُ ‏"‏ ‏.‏ فَلَمَّا أَدْبَرَ دَعَاهُ فَقَالَ ‏"‏ لَكَ سُدُسٌ آخَرُ ‏"‏ ‏.‏ فَلَمَّا أَدْبَرَ دَعَاهُ فَقَالَ ‏"‏ إِنَّ السُّدُسَ الآخَرَ طُعْمَةٌ ‏"‏ ‏.‏ قَالَ قَتَادَةُ فَلاَ يَدْرُونَ مَعَ أَىِّ شَىْءٍ وَرَّثَهُ ‏.‏ قَالَ قَتَادَةُ أَقَلُّ شَىْءٍ وَرِثَ الْجَدُّ السُّدُسَ ‏.‏. Narrated Imran ibn Husayn: A man came to the Prophet (ﷺ) and said: My son has died; what do I receive from his estate? He replied: You receive a sixth. When he turned away he called him and said: You receive another sixth. When he turned away, he called him and said: The other sixth is an allowance (beyond what is due). Qatadah said: They (the Companions) did not know the heirs with whom he was given (a sixth). Qatadah said: The minimum share given to the grandfather was a sixth (Grade: shahih. Hadith 31. حَدَّثَنَا وَهْبُ بْنُ بَقِيَّةَ، عَنْ خَالِدٍ، عَنْ يُونُسَ، عَنِ الْحَسَنِ، أَنَّ عُمَرَ، قَالَ أَيُّكُمْ يَعْلَمُ مَا وَرَّثَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْجَدَّ فَقَالَ مَعْقِلُ بْنُ يَسَارٍ أَنَا وَرَّثَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم السُّدُسَ ‏.‏ قَالَ مَعَ مَنْ قَالَ لاَ أَدْرِي ‏.‏ قَالَ لاَ دَرَيْتَ فَمَا تُغْنِي إِذًا ‏.‏. Al-Hasan reported that Umar asked:Which of your knows what share the Messenger of Allah (ﷺ) had given to the grandfather from the estate? Ma'qil ibn Yasar said: The Messenger of Allah (ﷺ) gave him a sixth. He asked: Along with whom? He replied: I do not know. He said: You do not know; what is the use then? (Grade: shahih. Hadith 32. حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ، وَمَخْلَدُ بْنُ خَالِدٍ، - وَهَذَا حَدِيثُ مَخْلَدٍ وَهُوَ الأَشْبَعُ - قَالَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ حَدَّثَنَا مَعْمَرٌ عَنِ ابْنِ طَاوُسٍ عَنْ أَبِيهِ عَنِ ابْنِ عَبَّاسٍ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ اقْسِمِ الْمَالَ بَيْنَ أَهْلِ الْفَرَائِضِ عَلَى كِتَابِ اللَّهِ فَمَا تَرَكَتِ الْفَرَائِضُ فَلأَوْلَى ذَكَرٍ ‏"‏ ‏.‏. Narrated Abdullah ibn Abbas: The Prophet (ﷺ) said: Divide the property among those whose share have been prescribed in the Book of Allah, and what remains from the prescribed shares goes to the nearest male heirs (Grade: shahih. Hadith 33. حَدَّثَنَا حَفْصُ بْنُ عُمَرَ، حَدَّثَنَا شُعْبَةُ، عَنْ بُدَيْلٍ، عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنْ رَاشِدِ بْنِ سَعْدٍ، عَنْ أَبِي عَامِرٍ الْهَوْزَنِيِّ عَبْدِ اللَّهِ بْنِ لُحَىٍّ، عَنِ الْمِقْدَامِ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ مَنْ تَرَكَ كَلاًّ فَإِلَىَّ ‏"‏ ‏.‏ وَرُبَّمَا قَالَ ‏"‏ إِلَى اللَّهِ وَإِلَى رَسُولِهِ ‏"‏ ‏.‏ ‏"‏ وَمَنْ تَرَكَ مَالاً فَلِوَرَثَتِهِ وَأَنَا وَارِثُ مَنْ لاَ وَارِثَ لَهُ أَعْقِلُ لَهُ وَأَرِثُهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ يَعْقِلُ عَنْهُ وَيَرِثُهُ ‏"‏ ‏.‏. Narrated Al-Miqdam al-Kindi: The Prophet (ﷺ) said: If anyone leaves a debt or a helpless family I shall be responsible-and sometimes the narrator said: Allah and His Apostle will be responsible-but if anyone leaves property, it goes to his heirs. I am the heirs of him who has none, paying blood-wit for him and inheriting from him; and a maternal uncle is the heir of him who has none, paying blood-wit for him and inheriting from him (Grade: shahih. Source: Sunan Abu Dawud no. 2899.) Hadith 34. حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ، - فِي آخَرِينَ - قَالُوا حَدَّثَنَا حَمَّادٌ، عَنْ بُدَيْلٍ، - يَعْنِي ابْنَ مَيْسَرَةَ - عَنْ عَلِيِّ بْنِ أَبِي طَلْحَةَ، عَنْ رَاشِدِ بْنِ سَعْدٍ، عَنْ أَبِي عَامِرٍ الْهَوْزَنِيِّ، عَنِ الْمِقْدَامِ الْكِنْدِيِّ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ أَنَا أَوْلَى بِكُلِّ مُؤْمِنٍ مِنْ نَفْسِهِ فَمَنْ تَرَكَ دَيْنًا أَوْ ضَيْعَةً فَإِلَىَّ وَمَنْ تَرَكَ مَالاً فَلِوَرَثَتِهِ وَأَنَا مَوْلَى مَنْ لاَ مَوْلَى لَهُ أَرِثُ مَالَهُ وَأَفُكُّ عَانَهُ وَالْخَالُ مَوْلَى مَنْ لاَ مَوْلَى لَهُ يَرِثُ مَالَهُ وَيَفُكُّ عَانَهُ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ رَوَاهُ الزُّبَيْدِيُّ عَنْ رَاشِدِ بْنِ سَعْدٍ عَنِ ابْنِ عَائِذٍ عَنِ الْمِقْدَامِ وَرَوَاهُ مُعَاوِيَةُ بْنُ صَالِحٍ عَنْ رَاشِدٍ قَالَ سَمِعْتُ الْمِقْدَامَ ‏.‏ قَالَ أَبُو دَاوُدَ يَقُولُ الضَّيْعَةُ مَعْنَاهُ عِيَالٌ ‏.‏. Narrated Al-Miqdam al-Kindi: The Prophet (ﷺ) said: I am nearer to every believer than himself, so if anyone leaves a debt or a helpless family, I shall be responsible, but if anyone leaves property, it goes to his heirs. I am patron of him who has none, inheriting his property and freeing him from his liabilities. A maternal uncle is patron of him who has none, inheriting his property and freeing him from his liabilities. Abu Dawud said: da'iah means dependants or helpless family. Abu Dawud said: This tradition has been transmitted by al-Zubaidi from Rashid b. Sa'd from Ibn 'A'idh on the authority of al-Miqdam. It has also been transmitted by Mu'awiyah b. Salih from Rashid who said: I heard al-Miqdam (say) (Grade: shahih. Source: Sunan Abu Dawud no. 2900.) Hadith 35. حَدَّثَنَا عَبْدُ السَّلاَمِ بْنُ عَتِيقٍ الدِّمَشْقِيُّ، حَدَّثَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ، حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ يَزِيدَ بْنِ حُجْرٍ، عَنْ صَالِحِ بْنِ يَحْيَى بْنِ الْمِقْدَامِ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ أَنَا وَارِثُ مَنْ لاَ وَارِثَ لَهُ أَفُكُّ عَانِيَهُ وَأَرِثُ مَالَهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ يَفُكُّ عَانِيَهُ وَيَرِثُ مَالَهُ ‏"‏ ‏.‏. Narrated Al-Miqdam: I heard the Messenger of Allah (ﷺ) say: I am the heirs of Him who has none, freeing him from his liabilities, and inheriting what he possesses. A maternal uncle is the heir of Him who has none, freeing him from his liabilities, and inheriting his property (Grade: shahih. Source: Sunan Abu Dawud no. 2901.) Hadith 36. حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، حَدَّثَنَا شُعْبَةُ، ح وَحَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا وَكِيعُ بْنُ الْجَرَّاحِ، عَنْ سُفْيَانَ، جَمِيعًا عَنِ ابْنِ الأَصْبَهَانِيِّ، عَنْ مُجَاهِدِ بْنِ وَرْدَانَ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، رضى الله عنها أَنَّ مَوْلًى، لِلنَّبِيِّ صلى الله عليه وسلم مَاتَ وَتَرَكَ شَيْئًا وَلَمْ يَدَعْ وَلَدًا وَلاَ حَمِيمًا فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ أَعْطُوا مِيرَاثَهُ رَجُلاً مِنْ أَهْلِ قَرْيَتِهِ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ وَحَدِيثُ سُفْيَانَ أَتَمُّ وَقَالَ مُسَدَّدٌ قَالَ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ هَا هُنَا أَحَدٌ مِنْ أَهْلِ أَرْضِهِ ‏"‏ ‏.‏ قَالُوا نَعَمْ ‏.‏ قَالَ ‏"‏ فَأَعْطُوهُ مِيرَاثَهُ ‏"‏ ‏.‏. Narrated Aisha, Ummul Mu'minin: A client of the Prophet (ﷺ) died and left some property, but he left no child or relative. The Messenger of Allah (ﷺ) said: Give what he has left to a man belonging to his village. Abu Dawud said: The tradition of Sufyan is more perfect. Musaddad said: Thereupon the Prophet (ﷺ) said: Is there anyone belonging to his land ? They replied: Yes. He said: Then give him what he has left (Grade: shahih. Source: Sunan Abu Dawud no. 2902.) Hadith 37. حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ الْكِنْدِيُّ، حَدَّثَنَا الْمُحَارِبِيُّ، عَنْ جِبْرِيلَ بْنِ أَحْمَرَ، عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، قَالَ أَتَى النَّبِيَّ صلى الله عليه وسلم رَجُلٌ فَقَالَ إِنَّ عِنْدِي مِيرَاثَ رَجُلٍ مِنَ الأَزْدِ وَلَسْتُ أَجِدُ أَزْدِيًّا أَدْفَعُهُ إِلَيْهِ ‏.‏ قَالَ ‏"‏ اذْهَبْ فَالْتَمِسْ أَزْدِيًّا حَوْلاً ‏"‏ ‏.‏ قَالَ فَأَتَاهُ بَعْدَ الْحَوْلِ فَقَالَ يَا رَسُولَ اللَّهِ لَمْ أَجِدْ أَزْدِيًّا أَدْفَعُهُ إِلَيْهِ ‏.‏ قَالَ ‏"‏ فَانْطَلِقْ فَانْظُرْ أَوَّلَ خُزَاعِيٍّ تَلْقَاهُ فَادْفَعْهُ إِلَيْهِ ‏"‏ ‏.‏ فَلَمَّا وَلَّى قَالَ ‏"‏ عَلَىَّ الرَّجُلَ ‏"‏ ‏.‏ فَلَمَّا جَاءَ قَالَ ‏"‏ انْظُرْ كُبْرَ خُزَاعَةَ فَادْفَعْهُ إِلَيْهِ ‏"‏ ‏.‏. Narrated Buraydah ibn al-Hasib: A man came to the Messenger of Allah (ﷺ) and said: I have property left by a man of Azd. I do not find any man of Azd to give it to him. He said: Go and look for man of Azd for a year. He then came to him after one year and said: Messenger of Allah, I did not find any man of Azd to give it to him. He said: Look for a man of Khuza'ah whom you meet first and give it to him. When he turned away, he said; Call the man to me. When he came to him, he said: Look for the leading man of Khuza'ah and give it to him (Grade: shahih. Source: Sunan Abu Dawud no. 2903.) Hadith 38. حَدَّثَنَا الْحُسَيْنُ بْنُ أَسْوَدَ الْعِجْلِيُّ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا شَرِيكٌ، عَنْ جِبْرِيلَ بْنِ أَحْمَرَ أَبِي بَكْرٍ، عَنِ ابْنِ بُرَيْدَةَ، عَنْ أَبِيهِ، قَالَ مَاتَ رَجُلٌ مِنْ خُزَاعَةَ فَأُتِيَ النَّبِيُّ صلى الله عليه وسلم بِمِيرَاثِهِ فَقَالَ ‏"‏ الْتَمِسُوا لَهُ وَارِثًا أَوْ ذَا رَحِمٍ ‏"‏ ‏.‏ فَلَمْ يَجِدُوا لَهُ وَارِثًا وَلاَ ذَا رَحِمٍ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَعْطُوهُ الْكُبْرَ مِنْ خُزَاعَةَ ‏"‏ ‏.‏ قَالَ يَحْيَى قَدْ سَمِعْتُهُ مَرَّةً يَقُولُ فِي هَذَا الْحَدِيثِ ‏"‏ انْظُرُوا أَكْبَرَ رَجُلٍ مِنْ خُزَاعَةَ ‏"‏ ‏.‏. Narrated Buraydah ibn al-Hasib: A man of Khuza'ah died and his estate was brought to the Prophet (ﷺ). He said: Look for his heir or some relative. But they found neither heir nor relative.
