Welcome to the study of authentic hadith selected by ULYAH. God willing, God willing, God willing, God willing, God willing مَالِكٌ عَنِ God willing God willing God willing فَإِنَّهُ يَقْطَعُ التَّلْبِيَةَ إِذَا انْتَهَى إِلَى God bless you. عُمَرَ كَانَ يَصْنَعُ ذَلِكَ .. has told me from Yahya from Malik from [Hisyam bin Urwah] from [his father], that he stops his talbiyah in Umrah when he has entered the Grand Mosque (Degree: authentic. Source: Muwatta Malik no. 762.) 2nd hadith. God bless you مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ الْحَارِثِ بْنput God willing, God willing, God willing, God willing, God willing. God willing, God willing, God willing, God willing God willing Allah's blessings God willing God bless you. قُلْتَ يَا ابْنَ أَخِي . فَقَالَ الضَّحَّاكُ فَإِنَّ عُمَرَ بْنَ الْخَطَّابِ قَدْ نَهَى عَنْ ذَلِكَ . قَدْ صَنَعَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم وَصَنَعْنَاهَا مَعَهُ .. Yahya told me from Malik from [Ibnu Shihab] from [Muhammad bin Abdullah bin Al Harits bin Naufal bin Abdul Muthallib] that he told him that he heard [Sa'd bin Abu Waqash] and [Adl Dlahhak bin Qais] in the year Mu'awiyah bin Abu Sufyan performed the Hajj. Both mentioned tamattu', from Umrah to Hajj. Then Adl Dlahhak said; "No one does that except people who do not know the commands of Allah Azza Wa jalla." Sa'ad said; "How bad is what you say, O my brother's son!" Adl Dlahhak said, "[Umar bin al Khatthab] has forbidden it." Sa'd said again, "Rasulullah shallallahu 'alaihi wasallam once did it and we did it with him (Degree: authentic. Source: Muwatta Malik no. 763.) 3rd Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ صَدَقَةَ بْنِ يَسَارٍ، عَنْ عَبْدِ اللَّهِ بْنْ Allah's blessings أَنْ أَعْتَمِرَ بَعْدَ الْحَجِّ فِي ذِي الْحِجَّةِ .. has narrated to me from Malik from [Shadaqah bin Yasar] from [Abdullah bin 'Umar] he said, "By Allah, performing Umrah before Hajj and then slaughtering the slaughter is more preferable to me than performing Umrah after Hajj in the month of Dhul Hijjah (Degree: authentic. Source: Muwatta Malik no. 764.) 4th Hadith. God bless you بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ عَنْ أَبِي صَالِحٍ السَّمَّانِ، God willing, God willing, God willing, God willing, God willing قَالَ " الْعُمْرَةُ إِلَى الْعُمْرَةِ كَفَّارَةٌ لِمَا God bless you إِلاَّ الْجَنَّةُ " .. has told me Yahya from Malik from [Sumayya] a former slave of Abu Bakr bin Abdurrahman, from [Abu Shalih As Saman] from [Abu Hurairah], that the Messenger of Allah sallallaahu 'alaihi wasallam said: "One Umrah to the next Umrah is an expiation of the sins between the two. And there is no reward for a Mabrur Hajj except heaven (Degree: authentic. Source: Muwatta Malik no. 767.) 5th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ سُمَىٍّ، مَوْلَى أَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنْ God bless you God willing, God willing, God willing, God willing, God willing تَجَهَّزْتُ لِلْحَجِّ فَاعْتَرَضَ لِي. فَقَالَ لَهَا God willing, God willing " اعْتَمِرِي فِي رَمَضَانَ فَإِنَّ عُمْرَةً فِيهِ كَحِجَّةٍ " .. has told me from Malik from [Sumayya] a former slave of Abu Bakr bin Abdurrahman, that he heard [Abu Bakar bin Abdurrahman] say, "A woman met Rasulullah shallallahu 'alaihi wasallam and asked, "I am ready to perform the Hajj, but have not encountered any obstacles in doing so?" Rasulullah shallallahu 'alaihi wasallam then said; "Umrah in the month of Ramadan, because Umrah in that month (the reward) is like Hajj (Degree: authentic. Source: Muwatta Malik no. 768.) 6th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God willing, God willing, God willing, God willing, God willing بَيْنَ حَجِّكُمْ وَعُمْرَتِكُمْ فَإِنَّ ذَلِكَ أَتَمُّ لِحَجِّ أَحَدِكُمْ وَأَتَمُّ لِعُمْرَتِهِ أَنْ يَعْتَمِرَ فِي غَيْرِ أَشْهُرِ الْحَجِّ .. has told me from Malik from [Nafi'] from [Abdullah bin 'Umar] that [Umar bin al Khatthab] said, "Separate your Hajj and Umrah, because that is more perfect for your Hajj. And the most important thing about Umrah is if it is performed other than the months of Hajj (Degree: authentic. Source: Muwatta Malik no. 769.) 7th Hadith. God willing, God willing, God willing, God willing, God willing وَرَجُلاً مِنَ الأَنْصَارِ فَزَوَّجَاهُ مَيْمُونَةَ بِنْتَ God willing, God willing, God willing, God willing, God willing. قَبْلَ أَنْ يَخْرُجَ .. has told me Yahya from Malik from [Rabi'ah bin Abu Abdurrahman] from [Sulaiman bin Yasar], that Rasulullah shallallahu 'alaihi wasallam sent Abu Rafi' and a man from among the Ansar. They both married him to Maimunah bint al Harith, while he was still in Medina and had not yet left (Degree: authentic. Source: Muwatta Malik no. 771.) 8th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ نُبَيْهِ بْنِ وَهْبٍ، أَخِي بَنِي عَبْدِ الدَّارِ أَنَّ عُمَرَ بْنَ عُبَيْدِ Allah's blessings يَوْمَئِذٍ أَمِيرُ الْحَاجِّ وَهُمَا مُحْرِمَانِ - إِنِّي قَدْ God willing, God willing, God willing, God willing, God willing بْنْ God willing, God willing, God willing, God willing, God willing, God willing يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ يَنْكِحِ الْمُحْرِمُ وَلاَ يُنْكِحْ وَلاَ يَخْطُبْ " .. has told me from Malik from [Nafi'] from [Nubiah bin Wahb] the brother of Bani Abdudar, that Umar bin Ubaidullah sent (messenger) to [Aban bin Uthman], at that time he was the leader of the Hajj group. Both of them were in a state of ihram, "I intend to marry Talha bin Umar to the daughter of Syaibah bin Jubair. I want you to be present." But Aban denied this, saying, "I have heard [Uthman bin Affan] say, "Rasulullah shallallahu 'alaihi wasallam said: "People who are in ihram are not allowed to marry, or marry off, or propose marriage (Degree: authentic. Source: Muwatta Malik no. 772.) 9th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، God willing may Allah bless him and give him peace and blessings فَرَدَّ عُمَرُ بْنُ الْخَطَّابِ نِكَاحَهُ .. has told me from Malik from [Daud bin Al Hushain] that [Abu Ghathafan bin Tharif al Murri] told him that Tharif, his father, married a woman while he was in ihram, then [Umar bin al Khatthab] rejected the marriage (Degree: authentic. Source: Muwatta Malik no. 773.) 10th Hadith. God bless you God bless you God willing يَوْمَئِذٍ بِلَحْيَىْ جَمَلٍ مَكَانٌ بِطَرِيقِ مَكَّةَ .. has told me Yahya from Malik from [Yahya bin Sa'id] from [Sulaiman bin Yasar], that the Messenger of Allah sallallaahu 'alaihi wasallam covered the top of his head when he was in ihram. At that time he was in Lahyai Jamal, which is a place on the route to Mecca (Degree: authentic. Source: Muwatta Malik no. 776.) 11th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God bless you God bless you يَحْتَجِمُ الْمُحْرِمُ إِلاَّ مِنْ ضَرُورَةٍ .. has told me from Malik from [Nafi'] from [Abdullah bin 'Umar] said; "A person who is in ihram should not do cupping unless he has to." Malik said; "A muhrim person should not cupce except in an emergency (Degree: authentic. Source: Muwatta Malik no. 777.) 12th Hadith. God willing مَوْلَى عُمَرَ بْنِ عُبَيْدِ اللَّهِ التَّيْمِيِّ عَنْ God bless you أَنَّهُ كَانَ مَعَ رَسُولِ اللَّهِ صلى الله عليه God willing مَعَ أَصْحَابٍ لَهُ مُحْرِمِينَ وَهُوَ غَيْرُ مُحْرِمٍ فَرَأَى God willing أَصْحَابَهُ أَنْ يُنَاوِلُوهُ or رُمْحَهُ فَأَبَوْا فَأَخَذَهُ ثُمَّ شَدَّ عَلَى God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing, God willing God willing God willing فَقَالَ " اللَّهُ " .. has told me Yahya from Malik from [Abu Nadlr] former slave 'Umar bin 'Ubaidullah At Taimi, from [Nafi'] former slave Abu Qatadah Al Ansari, from [Abu Qatadah], that he was with Rasulullah sallallaahu 'alaihi wasallam, until when they were on one of the roads to Mecca, he separated himself from his companions who were in ihram. Because he is not in ihram. When he saw a wild donkey, he chased it with his horse. He asked his friends to hand over his whip, but they refused. Then he asked for his arrows, but they still refused. Finally he took it and threw the arrow at the donkey so that it died. Then some of the companions of the Prophet sallallaahu 'alaihi wasallam ate it, and some did not. When they met Rasulullah sallallaahu 'alaihi wasallam, they asked him. He replied: "That is the food that Allah has given you (Degree: authentic. Source: Muwatta Malik no. 778.) 13th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ God willing يَتَزَوَّدُ صَفِيفَ الظِّبَاءِ وَهُوَ مُحْرِمٌ . قَالَ مَالِكٌ وَالصَّفِيفُ الْقَدِيدُ .. has told me from Malik from [Hisyam bin Urwah] from [his father] that [Zubair bin al 'Awwam] was provided with dried antelope meat, even though he was in ihram." Malik said; "Shafif means dried meat (Degree: authentic. Source: Muwatta Malik no. 779.) 14th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، أَنَّ may Allah bless him and give him peace God willing, God willing, God willing, God willing Allah's blessings may Allah bless him and give him peace and blessings " .. has told me from Malik from [Zaid bin Aslam] that ['Atha bin Yasar] he informed him, from [Abu Qatadah] about the problem of wild donkeys, like the hadith of Abu Nadlr. It's just that in the hadith of Zaid bin Aslam, Rasulullah shallallahu 'alaihi wasallam said: "Is there any of you who spares some of his flesh? (Degree: authentic. God willing God willing God willing God willing, God willing, God willing, God willing, God willing God willing may Allah bless him and give him peace and blessings God willing فَذُكِرَ ذَلِكَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " دَعُوهُ فَإِنَّهُ يُوشِكُ أَنْ يَأْتِيَ صَاحِبُهُ " . فَجَاءَ الْبَهْزِيُِ God willing, God willing, God willing, God willing, God willing, God willing. God bless you. God bless you God willing, God willing, God willing, God willing, God willing إِذَا كَانَ بِالأَثَايَةِ - بَيْنَ الرُّوَيْثَةِ وَالْعَرْجِ - God willing God willing, God willing, God willing, God willing, God willing God willing .. has told me from Malik from [Yahya bin Sa'id Al Ansari] he said; has reported to me [Muhammad bin Ibrahim bin Al Harith At Taimi] from [Isa bin Thalhah bin 'Ubaidullah] from ['Umair bin Salamah Adl-Dlamri] from [Al Bahzi], that the Messenger of Allah sallallaahu 'alaihi wasallam left for Mecca in a state of ihram. When he arrived at Rauha, there was a tame donkey. This was conveyed to the Messenger of Allah sallallaahu 'alaihi wasallam, he then said: "Leave it, indeed the person who owns it will soon come." Then Al Bahzi, the owner of the animal, came to the Prophet sallallaahu 'alaihi wasallam and asked, "O Messenger of Allah, it's up to you regarding this donkey." Rasulullah sallallaahu 'alaihi wasallam then ordered Abu Bakr to distribute it to the members of the group. Then they continued their journey, until when they arrived at Utsabah, the area between Ruwaitsah and 'Araj, there was a deer lying where it had been hit by an arrow. Not a single friend doubted that Rasulullah shallallahu 'alaihi wasallam would order a man to approach the donkey, until he passed it (without stopping) (Degree: authentic. Source: Muwatta Malik no. 781.) 16th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ سَمِعَ سَعِيدَ بْنَ الْمُسَيَّبِ، يُحَدِّثُ عَنْ أَِِ God bless you كَانَ بِالرَّبَذَةِ وَجَدَ رَكْبًا مِنْ أَهْلِ الْعِِ love God willing, God willing, God willing, God willing, God willing God willing God willing, God willing, God willing, God willing. God bless you God bless you أَمَرْتَهُمْ بِغَيْرَ .. has told me from Malik from [Yahya bin Sa'id] that he heard [Sa'id bin Musayyab] tell from [Abu Hurairah], that when he was returning from Bahrain and arrived at a place called Rabadzah, he met a group of Iraqis who were in ihram. Then they asked him about the game meat they had found from the people of Rabadzah, and he ordered them to eat it. Abu Hurairah said; "I felt doubtful about what I said to them. So when I arrived in Medina, I told this to [Umar bin al Khatthab]. Umar then asked; 'What did you tell them'. Abu Hurairah said, "I told them to eat it." Umar bin al Khatthab said; "If only you told them otherwise, then I would do something to you." So he threatened him (Degree: authentic. Source: Muwatta Malik no. 782.) 17th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمِ God willing, God willing, God willing, God willing God willing مُحْرِمُونَ بِالرَّبَذَةَ وَجَدُوا نَاسًا أَحِلَّةً يَأْكُلُونَهُ فَأَفْتَاهُمْ God willing God willing أَفْتَيْتَهُمْ قَالَ فَقُلْتُ أَفْتَيْتُهُمْ بِأَكْلِهِ. قَالَ فَقَالَ عُمَرُ لَوْ أَفْتَيْتَهُمْ بِغَيْرِ ذَلِكَ لأَوْجَعْتُكَ .. told me from Malik from [Ibnu Shihab] from [Salim bin Abdullah] that he heard [Abu Hurairah] tell Abdullah bin Umar, that a group of people who were in ihram from Rabadzah passed in front of him and asked for a fatwa regarding game meat, they found people who were not in ihram eating it, so he gave a fatwa for them to eat it. Abu Hurairah said, "I went to [Umar bin al Khatthab] and asked him about it. Umar asked, "What did you say to them? ' I answered, "I told them to eat it." Abu Hurairah said; "Umar then said; 'If you had said anything other than that, I would have hit you (Degree: authentic. Source: Muwatta Malik no. 783.) 18th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ God willing God willing وَجَدُوا لَحْمَ صَيْدٍ فَأَفْتَاهُمْ كَعْبٌ بِأَكْلِهِ قَالَ فَلَمَّا قَدِمُوا عَلَى عُمَرَ بْنِ الْخَطَّابِ God willing God bless you God willing طَرِيقِ مَكَّةَ مَرَّتِ love قَدِمُوا عَلَى عُمَرَ بْنِ الْخَطَّابِ ذَكَرُوا لَهُ ذَلِكَ فَقَالَ مَا حَمَلَكَ عَلَى أَنْ تُفْتِيَهُمْ بِهَذَا قَالَ هُوَ مِنْ صَيْدِ الْبَحْرِ . قَالَ وَمَا يُدْرِيكَ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ - وَالَّذِي نَفْسِي بِيَدِهِ - إِنْ هِيَ God bless you .. has told me from Malik from [Zaid bin Aslam] from ['Atha bin Yasar] that Ka'b Al Ahbar arrived from Syria in a group. On one of the roads, they found meat from hunted animals. Ka'b then gave a fatwa for them to eat it. 'Atha said; "When they arrived in Medina they then met [Umar bin al Khatthab] and mentioned this to him. They mentioned it." Umar then asked them, "Who told you this?" They answered, "Ka'b." 'Umar said, "I have told him to be your leader until you return." When they were on one of the streets in Mecca, suddenly there were lots of grasshoppers. Ka'b then gave a fatwa to them so that they would take it and eat it. When they met 'Umar bin al Khattab, they mentioned this to him. 'Umar then asked; "What caused you to give a fatwa to them regarding that matter?" Ka'b answered; "This actually includes marine animals." 'Umar asked again, "How do you know." Ka'b answered; "O Amirul Mukminin! By the One in Whose Hands my soul is, these are just grasshoppers from the sea which will scatter twice a year (Degree: authentic. Source: Muwatta Malik no. 784.) 19th hadith. God bless you God willing God willing God willing God willing God willing God willing, God willing, God willing, God willing, God willing, God willing. may Allah bless him and give him peace and blessings عَلَيْكَ إِلاَّ أَنَّا حُرُمٌ " .. has told me Yahya from Malik from [Ibn Shihab] from ['Ubaidullah bin Abdullah bin 'Utbah bin Mas'ud] from [Abdullah bin 'Abbas] from [Ash Sha'b bin Jatsamah Al Laitsi] that he once presented a tame donkey to Rasulullah sallallaahu 'alaihi wasallam when he was in Abwa', or in Waddan, but he refused it. When Rasulullah shallallahu 'alaihi wasallam saw the change in my face, he said: "We do not reject it, but we are in ihram (Degree: sahih. Source: Muwatta Malik no. 785.) 20th hadith. God willing بَكْرٍ، عَنْ عَبْدِ اللَّهِ بْنْ رَأَيْتُ عُثْمَانَ بْنَ عَفَّانَ بِالْعَرْمِ فِي يَوْمٍ صَائِفٍ قَدْ غَطَّى وَجْهَهُ بِقَطِيفَةِ Allah's blessings كُلُوا . فَقَالُوا أَوَلاَ تَأْكُلُ أَنْتَ فَقَالَ إِنِّي لَسْتُ كَهَيْئَتِكُمْ إِنَّمَا صِيدَ مِنْ أَجْلِي .. has told me from Malik from [Abdullah bin Abu Bakr] from [Abdullah bin 'Amir bin Rabi'ah] said; "I saw ['Uthman bin 'Affan] in 'Araj on a vehicle while he was in ihram on a very hot day, he covered his face with a colored velvet cloth dyed red. Then game meat was served to him, he then said to the companions: "Eat you! " They asked, "Why don't you eat? ' He answered: "I am not like you, the animal was hunted because of me (Degree: authentic. Source: Muwatta Malik no. 786.) 21st Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ God willing, God willing, God willing, God willing. قَالَتْ لَهُ يَا ابْنَ أُخْتِي إِنَّمَا هِيَ عَشْرُ لَيَالٍ God bless you لَحْمِ الصَّيْدِ . قَالَ مَالِكٌ فِي الرَّجُلِ الْمُحْرِمِ God bless you God bless you فَإِنَّ عَلَيْهِ جَزَاءَ ذَلِكَ الصَّيْدِ كُلِّهِ . وَسُئِلَ مَالِكٌ عَنِ الرَّجُلِ يُضْطَرُّ إِلَى أَكْلِ God willing God bless you وَذَلِكَ أَنَّ اللَّهَ تَبَارَكَ وَتَعَالَى لَمْ يُرَخِّصْ لِلْمُحْرِمِ فِي أَكْلِ الصَّيْدِ وَلاَ فِي أَخْذِهِ فِي حَالٍ God bless you God bless you may Allah bless him and give him peace and blessings لِحَلاَلٍ وَلاَ لِمُحْرِمٍ لأَنَّهُ لَيْسَ بِذَكِيٍّ كَانَ God willing God bless you God bless you قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُ .. has told me from Malik from [Hisyam bin Urwah] from [his father] from [Aisyah] Ummul Mukminin, he said, "O son of my sister, the Hajj is only ten days, if there is anything doubtful in you then avoid it." It means eating the meat of hunted animals (Degree: authentic. Source: Muwatta Malik no. 787.) 22nd Hadith. God willing اللَّهِ بْنْ قَالَ " خَمْسٌ مِنَ الدَّوَابِّ لَيْسَ عَلَى الْمُحْرِمِ فِي قَتْلِهِنَّ جُنَاحٌ الْغُرَابُ وَالْحِدَأَةُ وَالْعَقْرَبُ وَالْفَأْرَةُ وَالْكَلْبُ الْعَقُورُ " .. has told me Yahya from Malik from [Nafi'] from [Abdullah bin Umar], that Rasulullah sallallaahu 'alaihi wasallam said: "Five animals which it is not forbidden for a person in ihram to kill: crows, hida`ah birds (one type of bird), scorpions, rats and black dogs (Degree: authentic. Source: Muwatta Malik no. 788.) 23rd Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنْ عَبْدِ اللَّهِ بْنْ God willing وَهُوَ مُحْرِمٌ فَلاَ جُنَاحَ عَلَيْهِ الْعَقْرَبُ love الْعَقُورُ " .. has narrated to me from Malik from [Abdullah bin Dinar] from [Abdullah bin Umar], that Rasulullah sallallaahu 'alaihi wasallam said: "There are five animals that if someone kills them in a state of ihram, then he does not sin. Namely snakes, rats, crows, hida`ah birds and black dogs (Degree: authentic. Source: Muwatta Malik no. 789.) 24th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ God willing God bless you وَالْعَقَْبُ الْعَقُورُ " .. has told me from Malik from [Hisyam bin Urwah] from [his father], that Rasulullah sallallaahu 'alaihi wasallam said: "There are five destructive animals that must be killed even in the state of ihram, namely: rats, snakes, crows, birds of guidance and black dogs (Degree: authentic. Source: Muwatta Malik no. 790.) 25th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، أَنَّ عُمَرَ God willing, God willing, God willing, God willing . قَالَ مَالِكٌ فِي الْكَلْبِ الْعَقُورِ الَّذِي أُمِرَ God willing وَعَدَا عَلَيْهِمْ وَأَخَافَهُمْ مِثْلُ الأَسَدِ وَالنَّمِرِ وَالْفَهْدِ وَالذِّئْبِ فَهُوَ الْكَلْبُ الْعَقُورُ وَأَمَّا مَا كَانَ مِنَ السِّبَاعِ لاَ يَعْدُو مِثْلُ الضَّبُعِ وَالثَّعْلَبِ وَالْهِرِّ وَمَا أَشْبَهَهُنَّ مِنَ السِّبَاعِ فَلاَ يَقْتُلُهُنَّ الْمُحْرِمُ فَإِنْ قَتَلَهُ فَدَاهُ وَأَمَّا مَا ضَرَّ مِنَ الطَّيْرِ فَإِنَّ الْمُحْرِمَ لاَ God bless you may Allah bless him and give him peace of mind مِنَ الطَّيْرِ سِوَاهُمَا فَدَاهُ .. has told me from Malik from [Ibn Shihab] that [Umar bin al Khatthab] ordered to kill snakes in the Haram land (Degree: authentic. Malik said; "I hate him (Degree: sahih. Source: Muwatta Malik no. 792.) 27th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ عَلْقَمَةَ بْنِ أَبِي God willing God willing, God willing, God willing, God willing may Allah bless him and give him peace and blessings فَلْيَحْكُكْهُ وَلْيَشْدُدْ وَلَوْ رُبِطَتْ يَدَاىَ وَلَمْ أَجِدْ إِلاَّ رِجْلَىَّ لَحَكَكْتُ .. has told me with Malik from ['Alqamah] from [his mother] he said; I heard [Aishah] the wife of the Prophet sallallaahu 'alaihi wasallam asked about a person in ihram, 'Is it permissible for him to scratch his body? ' 'Aisyah then answered, "Yes, let him scratch it and pull it. If only my hands were tied and I could find nothing other than my feet, I would really scratch it (Degree: authentic. Source: Muwatta Malik no. 794.) 29th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللَّهِ God willing, God willing, God willing, God willing. حَلَمَةً أَوْ قُرَادًا عَنْ بَعِيرِهِ . قَالَ مَالِكٌ وَذَلِكَ أَحَبُّ مَا سَمِعْتُ إِلَىَّ فِي ذَلِكَ .. It has been told to me from Malik from [Nafi'] that [Abdullah bin Umar] made a person who was in ihram makruh to remove the worms or fleas on his camel. Malik said; "This is the opinion that I like the most on this issue (Degree: authentic. God willing الْمُسَيَّبْ فَقَالَ سَعِيدٌ اقْطَعْهُ . وَسُئِلَ مَالِكٌ عَنِ الرَّجُلِ God bless you God bless you بِذَلِكَ بَأْسًا وَم بَأْسًا . قَالَ مَالِكٌ وَلاَ بَأْسَ أَنْ يَبُطَّ may Allah bless him and give him peace and blessings عِرْقَهُ إِذَا احْتَاجَ إِلَى ذَلِكَ .. Has told me from Malik from [Muhammad bin Abdullah bin Abu Maryam] asking [Sa'id bin Musayyab] about his damaged nails while he was in ihram. Sa'id answered; "Cut it!" Malik was asked by a person who felt pain in his ear, "Is it permissible for him to drip medicine that does not smell good in his ear while in ihram?" Malik replied, "I see that it is okay, even if he does it in the mouth, then I don't see any prohibition. Malik continued again, "There is nothing wrong with someone who is in ihram popping his pimples, boils, or cutting his veins if it is not necessary (Degree: authentic. God bless you God willing God willing may Allah bless him and give him peace and blessings تَسْتَفْتِيهْ God bless you وسلم يَصْرِفُ وَجْهَ الْفَضْلِ إِلَى الشِّقِّ الآخَرِ فَقَالَتْ يَا رَسُولَ اللَّهِ إِنَّ فَرِيضَةَ اللَّهِ فِي God willing أَنْ يَثْبُتَ عَلَى الرَّاحِلَةِ أَفَأَحُجُّ عَنْهُ قَالَ " نَعَمْ " . وَذَلِكَ فِي حَجَّةِ الْوَدَاعِ .. Has told me Yahya from Malik from [Ibn Shihab] from [Sulaiman bin Yasar] from [Abdullah bin 'Abbas] said; "Al Fadll bin Abbas was riding with Rasulullah sallallaahu 'alaihi wasallam, then a woman from Khat'am came to him asking for his fatwa." Al Fadll then looked at the woman and the woman also looked at him. Rasulullah shallallahu 'alaihi wasallam then turned Al Fadll's face to another direction. The woman asked; "O Messenger of Allah, my father was only able to perform the Hajj when he was old. But he was no longer able to drive, can I perform the Hajj for him?" he answered; "Yes." this happened during Hajj Wada (Degree: authentic. Source: Muwatta Malik no. 797.) 32nd Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God willing, God willing, God willing, God willing, God willing مُعْتِمَرًا فِي الْفِتْنَةِ إِنْ صُدِدْتُ عَنِ الْبَيْتِ God willing وسلم فَأَهَلَّ بِعُمْرَةٍ مِنْ أَجْلِ أَنَّ رَسُولَ اللَّهِ God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing, God willing, God willing. God willing God bless you قَدْ أَوْجَبْتُ الْحَجَّ مَعَ الْعُمْرَةِ . ثُمَّ نَفَذَ may Allah bless him and give him peace of mind ذَلِكَ مُجْزِيًا عَنْهُ وَأَهْدَى .. It has been narrated to me from Malik from [Nafi'] from [Abdullah bin 'Umar] who said when heading to Mecca for Umrah during the fitnah (i.e. Hajjaj fitnah), "If I am prevented from leaving the Ka'bah, then we will do as we did with the Messenger of Allah (peace and blessings of Allaah be upon him). Then Abdullah did the ihram for the Umrah, because the Messenger of Allah (peace and blessings of Allaah be upon him) also did it during the Hudaibiyah incident. Umrah ihram. Abdullah then looked at the matter, then he said, "These two things are actually the same," he then turned to his companions and said, "These two things are actually the same. I swear to you that I have combined Hajj and Umrah together." Then he immediately did it, until when he arrived at the Kaaba, he made one round of Tawaf and saw that it was enough. After that he slaughtered the sacrifice." Malik said; "In our opinion, this opinion is used if the situation is surrounded by enemies, as the Prophet sallallaahu 'alaihi wasallam and his companions were surrounded. However, if it is not surrounded by enemies, then it is not permissible to stay silent before going to the Kaaba (Degree: authentic. Source: Muwatta Malik no. 799.) 33rd Hadith. Has told me Yahya from Malik from [Ibnu Shihab] from [Salim bin Abdullah] from [Abdullah bin Umar] said; "A person who is stricken with an illness must not endure until he makes Tawaf and performs sa'i between Safa and Marwa. If he is forced to wear certain clothes or take medicine for his illness, he should do so and then pay fidyah (Degree: authentic. Has told me from Malik from [Ayub bin Abu Tamimah As Sakhtiyani] from [one of the residents of Basrah] said; "I went to Mecca, until when I reached one of the roads, my femur broke. I sent someone to Mecca to ask for a fatwa, there were [Abdullah bin Abbas], [Abdullah bin Umar] and others. But no one gave me relief to endure. So I stayed at the spring for seven months, until I completed the Umrah (Degree: authentic. Source: Muwatta Malik no. 802.) 36th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمِ God willing قَالَ مَنْ حُبِسَ دُونَ الْبَيْتِ بِمَرَضٍ فَإِنَّهُ لاَ يَحِلُّ حَتَّى يَطُوفَ بِالْبَيْتِ وَبَيْنَ الصَّفَا وَالْمَرْوَةِ .. Has told me from Malik from [Ibnu Shihab] from [Salim bin Abdullah] from [Abdullah bin Umar] he said; "Whoever is prevented from getting to the Ka'bah because of illness, then he must not stay until the tawaf at the Ka'bah and perform sa'i between Safa and Marwa (Degree: sahih. Hadits ke-37. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ مَعْبَدَ بْنَ حُزَابَةَ الْمَخْزُومِيَّ، صُرِعَ بِبَعْضِ طَرِيقِ مَكَّةَ وَهُوَ مُحْرِمٌ فَسَأَلَ مَنْ يَلِي عَلَى الْمَاءِ الَّذِي كَانَ عَلَيْهِ فَوَجَدَ عَبْدَ اللَّهِ بْنَ عُمَرَ وَعَبْدَ اللَّهِ بْنَ الزُّبَيْرِ وَمَرْوَانَ بْنَ الْحَكَمِ فَذَكَرَ لَهُمُ الَّذِي عَرَضَ لَهُ فَكُلُّهُمْ أَمَرَهُ أَنْ يَتَدَاوَى بِمَا لاَ بُدَّ لَهُ مِنْهُ وَيَفْتَدِيَ فَإِذَا صَحَّ اعْتَمَرَ فَحَلَّ مِنْ إِحْرَامِهِ ثُمَّ عَلَيْهِ حَجُّ قَابِلٍ وَيُهْدِي مَا اسْتَيْسَرَ مِنَ الْهَدْىِ . قَالَ مَالِكٌ وَعَلَى هَذَا الأَمْرُ عِنْدَنَا فِيمَنْ أُحْصِرَ بِغَيْرِ عَدُوٍّ وَقَدْ أَمَرَ عُمَرُ بْنُ الْخَطَّابِ أَبَا أَيُّوبَ الأَنْصَارِيَّ وَهَبَّارَ بْنَ الأَسْوَدِ حِينَ فَاتَهُمَا الْحَجُّ وَأَتَيَا يَوْمَ النَّحْرِ أَنْ يَحِلاَّ بِعُمْرَةٍ ثُمَّ يَرْجِعَا حَلاَلاً ثُمَّ يَحُجَّانِ عَامًا قَابِلاً وَيُهْدِيَانِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاَثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعَ إِلَى أَهْلِهِ . قَالَ مَالِكٌ وَكُلُّ مَنْ حُبِسَ عَنِ الْحَجِّ بَعْدَ مَا يُحْرِمُ إِمَّا بِمَرَضٍ أَوْ بِغَيْرِهِ أَوْ بِخَطَإٍ مِنَ الْعَدَدِ أَوْ خَفِيَ عَلَيْهِ الْهِلاَلُ فَهُوَ مُحْصَرٌ عَلَيْهِ مَا عَلَى الْمُحْصَرِ . قَالَ يَحْيَى سُئِلَ مَالِكٌ عَمَّنْ أَهَلَّ مِنْ أَهْلِ مَكَّةَ بِالْحَجِّ ثُمَّ أَصَابَهُ كَسْرٌ أَوْ بَطْنٌ مُتَحَرِّقٌ أَوِ امْرَأَةٌ تَطْلُقُ . قَالَ مَنْ أَصَابَهُ هَذَا مِنْهُمْ فَهُوَ مُحْصَرٌ يَكُونُ عَلَيْهِ مِثْلُ مَا عَلَى أَهْلِ الآفَاقِ إِذَا هُمْ أُحْصِرُوا . قَالَ مَالِكٌ فِي رَجُلٍ قَدِمَ مُعْتَمِرًا فِي أَشْهُرِ الْحَجِّ حَتَّى إِذَا قَضَى عُمْرَتَهُ أَهَلَّ بِالْحَجِّ مِنْ مَكَّةَ ثُمَّ كُسِرَ أَوْ أَصَابَهُ أَمْرٌ لاَ يَقْدِرُ عَلَى أَنْ يَحْضُرَ مَعَ النَّاسِ الْمَوْقِفَ . قَالَ مَالِكٌ أَرَى أَنْ يُقِيمَ حَتَّى إِذَا بَرَأَ خَرَجَ إِلَى الْحِلِّ ثُمَّ يَرْجِعُ إِلَى مَكَّةَ فَيَطُوفُ بِالْبَيْتِ وَيَسْعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ يَحِلُّ ثُمَّ عَلَيْهِ حَجُّ قَابِلٍ وَالْهَدْىُ . قَالَ مَالِكٌ فِيمَنْ أَهَلَّ بِالْحَجِّ مِنْ مَكَّةَ ثُمَّ طَافَ بِالْبَيْتِ وَسَعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ ثُمَّ مَرِضَ فَلَمْ يَسْتَطِعْ أَنْ يَحْضُرَ مَعَ النَّاسِ الْمَوْقِفَ . قَالَ مَالِكٌ إِذَا فَاتَهُ الْحَجُّ فَإِنِ اسْتَطَاعَ خَرَجَ إِلَى الْحِلِّ فَدَخَلَ بِعُمْرَةٍ فَطَافَ بِالْبَيْتِ وَسَعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ لأَنَّ الطَّوَافَ الأَوَّلَ لَمْ يَكُنْ نَوَاهُ لِلْعُمْرَةِ فَلِذَلِكَ يَعْمَلُ بِهَذَا وَعَلَيْهِ حَجُّ قَابِلٍ وَالْهَدْىُ . فَإِنْ كَانَ مِنْ غَيْرِ أَهْلِ مَكَّةَ فَأَصَابَهُ مَرَضٌ حَالَ بَيْنَهُ وَبَيْنَ الْحَجِّ فَطَافَ بِالْبَيْتِ وَسَعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ حَلَّ بِعُمْرَةٍ وَطَافَ بِالْبَيْتِ طَوَافًا آخَرَ وَسَعَى بَيْنَ الصَّفَا وَالْمَرْوَةِ لأَنَّ طَوَافَهُ الأَوَّلَ وَسَعْيَهُ إِنَّمَا كَانَ نَوَاهُ لِلْحَجِّ وَعَلَيْهِ حَجُّ قَابِلٍ وَالْهَدْىُ .. Telah menceritakan kepadaku dari Malik dari [Yahya bin Sa'id] dari [Sulaiman bin Yasar] bahwa Sa'id bin Huzabah al Makhzumi terjatuh dalam perjalanannya menuju Makkah, padahal dia dalam keadaan ihram. Lalu ia bertanya tentang masalahnya kepada ulama yang ada, maka dia mendapati [Abdullah bin Umar], [Abdullah bin az Zubair] dan [Marwan bin al Hakam] . Kemudian ia sebutkan kepada mereka apa yang terjadi padanya, lantas mereka menyuruhnya agar berobat dan menebus denda. Jika telah sembuh, maka ia harus melakukan umrah dan tahallul dari ihramnya. Aisha said; "I said: 'O Messenger of Allah, wouldn't it be better for you to return according to Abraham's rules?" Rasulullah sallallaahu 'alaihi wasallam replied: "If it were not for your people who had just escaped disbelief (converted to Islam), I would have done it." Abdullah bin Muhammad said; "Abdullah bin Umar said; 'If indeed 'Aisyah had heard this hadith from Rasulullah shallallahu 'alaihi wasallam, I have never seen Rasulullah shallallahu 'alaihi wasallam leave touching the two pillars after Hijr Isma'il, except because the Kaaba was not built according to Abraham's rules (Degree: authentic.
