Welcome to the study of authentic hadith selected by ULYAH. Let's look at some of the following sayings of the Prophet sallallaahu 'alaihi wa sallam, one by one, with an open heart to put them into practice. 1st Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God willing God willing ‏.‏. It has been told to me from Malik from [Nafi'] from [Abdullah bin 'Umar] he said, "The Messenger of Allah sallallaahu 'alaihi wasallam said: "If one of you is invited to attend a walimah event, let him go to it (Degree: authentic. Source: Muwatta Malik no. 1141.) 2nd hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنِ God willing God willing God bless you فَقَدْ عَصَى اللَّهَ وَرَسُولَهُ ‏.‏. Has told me from Malik from [Ibn Shihab] from [Al A'raj] from [Abu Hurairah] he said; "The worst food is the walimah food to which only the rich are invited, without the poor. Whoever does not go to the walimah's invitation means he has disobeyed Allah and His Messenger (Degree: authentic. Source: Muwatta Malik no. 1142.) 3rd Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ God willing, God willing, God willing, God willing, God willing may Allah bless him and give him peace of mind وسلم لِطَعَامٍ صَنَعَهُ ‏.‏ قَالَ أَنَسٌ فَذَهَبْتُ مَعَ God willing, God willing, God willing, God willing, God willing فَقَرَّبَ إِلَيْهِ خُبْزًا مِنْ شِِيرٍ وَمَرَقًا فِيهِ God bless you God willing فَلَمْ أَزَلْ أُحِبُّ الدُّبَّاءَ بَعْدَ ذَلِكَ الْيَوْمِ ‏.‏. Has told me from Malik from [Ishaq bin Abdullah bin Abu Talhah] that he heard [Anas bin Malik] he said; "A tailor invited Rasulullah sallallaahu 'alaihi wasallam to attend the dishes he had made." Anas said; "I then went with him to attend the invitation. He was invited to enjoy a meal of wheat bread and sauce containing a kind of pumpkin." Anas continued, "I saw Rasulullah shallallahu 'alaihi wasallam looking for the pumpkin in the sauce tray. So since that day, I also like pumpkins (Degree: authentic. Source: Muwatta Malik no. 1143.) 4th Hadith. God willing may Allah bless him and give him peace of mind God willing, God willing, God willing, God willing فَلْيَأْخُذْ بِنَاصِيَتِهَا وَلْيَدْعُ بِالْبَرَكَةِ وَإِذَا God willing, God willing, God willing, God willing وَلْيَسْتَعِذْ بِاللَّهِ مِنَ الشَّيْطَانِ ‏"‏ ‏.‏. Yahya told me from Malik from [Zaid bin Aslam] that Rasulullah shallallahu 'alaihi wasallam said: "If one of you marries a woman or buys a female slave, let him hold her forelock and pray that Allah Ta'ala will bless him. When one of you buys a camel, let him hold the top of its hump and take refuge in Allah Ta'ala from the evil of Satan (Degree: authentic. Source: Muwatta Malik no. 1144.) 5th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ أَبِي الزُّبَيْرِ God willing فَذَكَرَ أَنَّهَا قَدْ كَانَتْ أَحْدَثَتْ فَبَلَغَ ذَلِكَ عُمَرَ بْنَ الْخَطَّابِ فَضَرَبَهُ - أَوْ كَادَ يَضْرِبُهُ - ثُمَّ قَالَ مَا لَكَ وَلِلْخَبَرِ. Has told me from Malik from [Abu Az Zubair Al Maki] said, "A man proposes to a woman through his brother. The woman's brother told her that her sister had previously committed adultery. This was conveyed to [Umar bin Khattab], so the woman's brother was beaten, or almost beaten. Then Umar said; "What business do you have to give this news? (Degree: authentic. Source: Muwatta Malik no. 1145.) 6th Hadith. God willing God willing God willing God bless you مُحَمَّدٍ قَالَ طَلَّقَهَا فِي مَجَالِسَ شَتَّى ‏.‏. It has been told to me from Malik from [Rabi'ah bin Abu Abdurrahman] that [Al Qasim bin Muhammad] and [Urwah bin Zubair] said about a man who had four wives, then he divorced one of his wives with triple talaq: "He can remarry according to his wishes without having to wait for his wife's 'iddah to finish." It has been told to me from Malik from Rabi'ah bin Abu Abdurrahman that Al Qasim bin Muhammad and Urwah bin Zubair gave this fatwa to Al Walid bin Abdul Malik when he came to Medina, only that Al Qasim bin Muhammad said, "Talaklah him in several majlis (not with triple talaq at once) (Degree: authentic. Source: Muwatta Malik no. 1147.) 7th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ may Allah bless him and give him peace and blessings فِيهِنَّ لَعِبٌ النِّكَاحُ وَالطَّلاَقُ وَالْعِتْقُ ‏.‏. Has told me from Malik from [Yahya bin Sa'id] from [Sa'id bin Musayyab] said; "There are three things that do not have the word 'play around' in them; marriage, divorce and freeing slaves (Degree: sahih. Source: Muwatta Malik no. 1148.) 8th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ رَافِعِ God willing, God willing, God willing, God willing, God willing. مَسْلَمَةَ الأَنْصَارِيِّ فَكَانَتْ عِنْدَهُ حَتَّى كََتِ فَتَزَوَّجَ عَلَيْهَا فَتَاةً شَابَّةً فَآثَرَ الشَّابَّةَ God willing God bless you may Allah bless him and give him peace and blessings فَطَلَّقَهَا وَاحِدَةً ثُمَّ رَاجَعَهَا ثُمَّ عَادَ فَآثَرَ Allah's blessings God willing مَا تَرَيْنَ مِنَ الأُثْرَةِ وَإِنْ شِئْتِ فَارَقْتُكِ ‏.‏ قَالَتْ بَلْ أَسْتَقِرُّ عَلَى الأُثْرَةِ ‏.‏ فَأَمْسَكَهَا God willing, God willing, God willing, God willing, God willing. قَرَّتْ عِنْدَهُ عَلَى الأُثْرَةِ ‏.‏. It has been told to me from Malik from [Ibnu Shihab] from [Rafi' bin Khudaij] that he married Muhammad bin Maslamah Al Ansari's daughter. (the girl) lived with him until he was old. Then Rafi 'married again to a young girl. It turned out that he prioritized the girl over (his old wife). So his old wife sued him for divorce. Then Rafi' divorced her with one divorce, he acted kindly and gently towards (his old wife) until just before the end of her iddah period, he reconciled again. After the reconciliation, he still treated her the same as before (preferring his young wife) so that (his old wife) sued for divorce, then there was a double divorce. Then he reconciled again, but he continued to repeat his actions by prioritizing the girl so that his old wife sued for divorce. Rafi' bin Khudaij said; "Now it's up to you, there's only one divorce left. If you want, you can stay and accept what is. If not, I will divorce you." (the woman) said; "I will stay even if you act like that." In the end, Rafi' did not divorce his wife. Rafi' did not see that it was sinful when he determined that she should stay (his old wife) with such treatment (Degree: authentic. Source: Muwatta Malik no. 1149.) 9th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ God willing, God willing, God willing, God willing, God willing قَالَ لَهُ الَْ بَكْرٍ فَقُلْتُ لَهُ كَانَ أَبَانُ بْنُ عُثْمَانَ يَجْعَلُهَا وَاحِدَةً ‏.‏ فَقَالَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ لَوْ كَانَ God willing مَنْ قَالَ الْبَتَّةَ فَقَدْ رَمَى الْغَايَةَ الْقُصْوَى ‏.‏. It has been told to me from Malik from [Yahya bin Sa'id] from [Abu Bakr bin Hazm] that [Umar bin Abdul Aziz] said to him; "What do people say about talaq ba'in?" Abu Bakr answered; "[Aban bin Uthman] considered it a divorce." Umar bin Abdul Aziz also said; "If talaq were allowed a thousand times, surely there wouldn't be even a single talak ba'in left. Whoever says talak ba'in, means he has reached the final limit (Degree: authentic. Source: Muwatta Malik no. 1152.) 10th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، أَنَّ God bless you امْرَأَتَهُ الْبَتَّةَ أَنَّهَا ثَلاَثُ تَطْلِيقَاتٍ ‏.‏ قَالَ مَالِكٌ وَهَذَا أَحَبُّ مَا سَمِعْتُ إِلَىَّ فِي ذَلِكَ ‏.‏. It has been told to me from Malik from [Ibnu Syihab] that [Marwan bin Al Hakam] gave a ruling that a husband who divorces his wife with talak ba'in, then that is triple talaq. Malik said; "This is the opinion that I like the most (Degree: authentic. Source: Muwatta Malik no. 1153.) 11th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللَّهِ God willing, God willing, God willing, God willing, God willing إِنَّهَا ثَلاَثُ تَطْلِيقَاتٍ كُلُّ وَاحِدَةٍ مِنْهُمَا ‏.‏. It has been related to me from Malik from [Nafi'] that [Abdullah bin Umar] said about khaliyyah and bariyyah, "Both of them are triple talaq (Degree: authentic. Source: Muwatta Malik no. 1156.) 12th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، ‏ ‏ God bless you God willing. God willing ‏.‏. It has been told to me from Malik from [Yahya bin Sa'id] from [Al Qasim bin Muhammad] said, "A man who had a wife from a people. Then he said to the wife's family; "About her it's up to you." So people considered it as a divorce (Degree: authentic. Source: Muwatta Malik no. 1157.) 13th Hadith. God bless you يَقُولُ فِي الرَّجُلِ يَقُولُ لاِمْرَأَتِهِ بَرِئْتِ مِنِّي love God bless you لاِمْرَأَتِهِ أَنْتِ خَلِيَّةٌ أَوْ بَرِيَّةٌ أَوْ بَائِنَةٌ God willing God willing, God willing, God willing, God willing Allah's blessings God willing, God willing, God willing, God willing, God willing. لأَنَّهُ لاَ يُخْلِي الْمَرْأَةَ الَّتِي قَدْ دَخَلَ بِهَا God willing God bless you وَتُبْرِيهَا وَتُبِينُهَا الْوَاحِدَةُ ‏.‏ قَالَ مَالِكٌ وَهَذَا أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ ‏.‏. Has told me from Malik that he heard [Ibn Shihab] say about a husband who said to his wife; 'You leave me and I leave you', this statement has the same status as triple talaq (Degree: authentic. Source: Muwatta Malik no. 1158.) 14th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللَّهِ God willing, God willing, God willing, God willing, God willing. God willing God willing may Allah bless him and give him peace and blessings عِدَّتِهَا ‏.‏. It has been told to me from Malik from [Nafi'] that [Abdullah bin Umar] said; "If a husband hands over his affairs to his wife, then the final decision is in the wife's hands. Unless the husband denies it (his words) and says: 'I don't want it except one divorce,' then he is obliged to swear that he retains the right to his wife as long as she is still in the iddah period (Degree: sahih. Source: Muwatta Malik no. 1160.) 15th Hadith. Allah's blessings God willing زَيْدِ بْنِ ثَابِتٍ، أَنَّهُ or Allah's blessings أَبِي عَتِيقٍ وَعَيْنَاهُ تَدْمَعَانِ فَقَالَ لَهُ زَيْدٌ مَا God willing, God willing, God willing, God willing فَفَارَقَتْنِي ‏.‏ فَقَالَ لَهُ زَيْدٌ مَا حَمَلَكَ عَلَى ذَلِكَ قَالَ الْقَدَرُ ‏ ‏ شِئْتَ فَإِنَّمَا هِيَ وَاحِدَةٌ وَأَنْتَ أَمْلَكُ بِهَا ‏.‏. Yahya told me from Malik from [Sa'id bin Sulaiman bin Zaid bin Thabit] from [Kharijah bin Zaid bin Thabit] that he told him that he had been sitting with [Zaid bin Thabit], suddenly Muhammad bin Abu 'Atiq met him with tears in his eyes. Zaid then asked him; "What's wrong with you?" He answered; "I have handed over the decision (talak) to my wife, and she decided to separate from me." Zaid asked again; "Why did you do that?" he answered, "Because of economic factors." Zaid said; "If you want, reconcile with him. Because that is only one divorce, and you are more entitled to it (Degree: authentic. Source: Muwatta Malik no. 1161.) 16th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ God willing God willing ثُمَّ قَالَتْ أَنْتَ الطَّلاَقُ فَقَالَ بِفِيكِ الْحَجَرُ ‏.‏ ثُمَّ قَالَتْ أَنْتَ الطَّلاَقُ فَقَالَ بِفِيكِ الْحَجَرُ ‏.‏ God bless you مَا مَلَّكَهَا إِلاَّ وَاحِدَةً وَرَدَّهَا إِلَيْهِ ‏.‏ قَالَ مَالِكٌ قَالَ عَبْدُ الرَّحْمَنِ فَكَانَ الْقَاسِمُ يُعْجِبُها God bless you. ذَلِكَ وَأَحَبُّهُ إِلَىَّ ‏.‏. He told me from Malik from [Abdurrahman bin Al Qasim] from [his father] he said, "A man from the Tsaqif tribe handed over the decision of divorce to his wife. His wife then said; "I am divorcing you." The man from Tsaqif was silent. His wife said again, "I am divorcing you." divorce." the man said; "There is a stone in your mouth." Then the two of them complained and asked Marwan bin Hakam to decide their dispute. [Marwan] then asked the man to swear that all he wanted was a divorce. Then Marwan handed the woman over to her husband." Malik said; Abdurrahman said; "Al Qasim really liked the decision. He saw it as the best decision." Malik said; "This is the best opinion, and the opinion I choose (Degree: authentic. Source: Muwatta Malik no. 1162.) 17th Hadith. God willing God willing, God willing, God willing, God willing, God willing God willing God willing فَزَوَّجُوهُ ثُمَّ إِنَّهُمْ عَتَبُوا عَلَي God willing love God bless you زَوْجَهَا فَلَمْ يَكُنْ ذَلِكَ طَلاَقًا ‏.‏. Yahya has told me from Malik from [Abdurrahman bin Al Qasim] from [his father] from ['Aisyah] Ummul Mukminin, that he once proposed to Qaribah bint Umayyah to Abdurrahman bin Abu Bakr. They then married 'Abdurrahman (to the woman), but then they denounced 'Abdurrahman bin Abu Bakr. They said, "We did not marry her except because of (the position of) 'Aisha." 'Aisyah then sent (a messenger) to Abdurrahman to tell him about this, then Abdurrahman handed over the decision to divorce his wife. Then the wife decided to choose her husband, so that it was not considered a divorce (Degree: authentic. Source: Muwatta Malik no. 1163.) 18th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ God willing may Allah bless him and give him peace and blessings الرَّحْمَنِ الْمُنْذِرَ بْنَ الزُّبَيْرِ - وَعَبْدُ God willing God willing يُفْتَاتُ عَلَيْهْ God willing God willing. God willing. God willing God willing الْمُنْذِرِ وَلَمْ يَكُنْ ذَلِكَ طَلاَقًا ‏.‏. It has been told to me from Malik from [Abdurrahman bin Al Qasim] from [his father] that ['Aisyah] the wife of the Prophet sallallaahu 'alaihi wasallam married Hafshah bint Abdurrahman to Al Mundzir bin Zubair, even though Abdurrahman was in Syria. When Abdurrahman returned, in a disappointed tone he said; "People like me deserve to be treated like this, and don't deserve to be asked for consideration." Aisyah told Mundzir bin Zubair of Abdurrahman's disappointment. Mundzir said back; "That's up to Abdurrahman." Abdurrahman said; "I can't possibly refuse something you have decided." So Hafshah remains Mundzir's wife, and her words are not considered divorce (Degree: authentic. Source: Muwatta Malik no. 1164.) 19th hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ may Allah bless him and give him peace and blessings God willing, God willing, God willing, God willing, God willing مَالِكٌ فِي God willing God willing God willing مَجْلِسِهِمَا ‏.‏. Has told me from Malik from [Yahya bin Sa'id] from [Sa'id bin Musayyab] he said; "If a husband submits the decision to divorce to his wife, then the wife does not wish to separate and still lives with her husband, then this is not considered divorce (Degree: authentic. Source: Muwatta Malik no. 1166.) 20th hadith. God willing أَبِيهِ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، God willing, God willing, God willing, God willing, God willing. لَمْ يَقَعْ عَلَيْهِ طَلاَقٌ وَإِنْ مَضَتِ الأَرْبَعَةُ God willing فَإِمَّا أَنْ يُطَلِّقَ وَإِمَّا God bless you. ‏.‏. Having told me Yahya from Malik from [Ja'far bin Muhammad] from [his father] from [Ali bin Abu Talib] he said; "If a man swears not to have sexual intercourse with his wife, it is not considered divorce even if four months have passed until he is asked to confirm his words. Whether he divorces her or not." Malik said; "That's how it is between us (Degree: authentic. Source: Muwatta Malik no. 1167.) 21st Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God willing, God willing, God willing, God willing, God willing God willing وُقِفَ حَتَّى يُطَلِّقَ أَوْ يَفِيءَ وَلاَ يَقَعُ عَلَيْهِ God willing, God willing, God willing, God willing ‏.‏. Has told me from Malik from [Nafi'] from [Abdullah bin Umar] said; "A man swears not to have sexual intercourse with his wife, if it has exceeded the four month limit. Then he is asked to confirm his words; to divorce her or not. And no divorce has occurred until the man confirms his words even though the four month limit has passed (Degree: authentic. Source: Muwatta Malik no. 1168.) 22nd Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، أَنَّ سَعِيدَ God bless you كَانَا يَقُولاَنِ فِي الرَّجُلِ يُولِي مِنِ امْرَأَتِهِ God willing God bless you فِي الْعِدَّةِ ‏.‏. It has been told to me from Malik from [Ibn Shihab] that [Sa'id bin Musayyab] and [Abu Bakr bin Abdurrahman] said about a man who vowed not to have sexual intercourse with his wife, "If it has passed the four month limit, it means he has given one divorce, and he can reconcile with his wife as long as she is still in the iddah period (Degree: sahih. Source: Muwatta Malik no. 1169.) 23rd Hadith. God willing may Allah bless him and give him peace and blessings God willing شَهْرَانِ ‏.‏. Yahya told me from Malik he asked [Ibnu Shihab] about the ila' of his servants. Ibn Shihab answered; "The ila' of a slave is the same as the ila' of a free person. The law is also obligatory. The period of ila' of a slave is limited to two months (Degree: authentic. Source: Muwatta Malik no. 1172.) 24th Hadith. God willing God willing, God willing, God willing, God willing مُحَمَّدٍ عَنْ رَجُلٍ، طَلَّقَ امْرَأَةً إِنْ هُوَ God bless you God willing, God willing, God willing, God willing, God willing God willing God bless you الْمُتَظَاهِرِ ‏.‏. Yahya told me from Malik from [Sa'id bin 'Amru bin Sulaim Az Zuraqi] that he once asked [Al Qasim bin Muhammad] about a man who would divorce his wife if she had sex with him. Al Qasim bin Muhammad then answered; "Once a man considered his wife like his mother's back if he had sexual intercourse with her. So [Umar bin Khattab] told him not to approach her, unless he paid her zhihar fine (Degree: authentic. Source: Muwatta Malik no. 1173.) 25th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ God willing, God willing, God willing, God willing, God willing نِسْوَةٍ لَهُ بِكَلِمَةٍ وَاحِدَةٍ إِنَّهُ لَيْسَ عَلَيْهِ God bless you عَنْ رَبِيعَةَ بْنْ ‏.” may Allah bless him and give him peace and blessings ‏{‏فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا ‏}‏‏.‏ ‏{‏فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ مِنْ قَبْلِ أَنْ يَتَمَاسَّا فَمَنْ لَمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِينًا‏}‏ ‏.‏ قَالَ مَالِكٌ فِي God willing مُتَفَرِّقَةٍ قَالَ لَيْسَ عَلَيْهِ إِلاَّ كَفَّارَةٌ وَاحِدَةٌ فَإِنْ تَظَاهَرَ ثُمَّ كَفَّرَ ثُمَّ تَظَاهَرَ بَعْدَ أَنْ يُكَفِّرَ فَعَلَيْهِ الْكَفَّارَةُ أَيْضًا ‏.‏ قَالَ مَالِكٌ وَمَنْ تَظَاهَرَ مِنِ امْرَأَتِهِ ثُمَّ مَسَّهَا قَبْلَ أَنْ يُكَفِّرَ لَيْسَ عَلَيْهِ إِلاَّ كَفَّارَةٌ وَاحِدَةٌ وَيَكُفُّ عَنْهَا حَتَّى يُكَفِّرَ وَلْيَسْتَغْفِرِ اللَّهَ وَذَلِكَ أَحْسَنُ مَا سَمِعْتُ ‏.‏ قَالَ مَالِكٌ وَالظِّهَارُ مِنْ ذَوَاتِ الْمَحَارِمِ مِنَ الرَّضَاعَةِ وَالنَّسَبِ سَوَاءٌ ‏.‏ قَالَ مَالِكٌ وَلَيْسَ عَلَى God bless you تَبَارَكَ وَتَعَالَى ‏{‏وَالَّذِينَ يُظَاهِرُونَ مِنْ نِسَائِهِمْ ثُمَّ يَعُودُونَ لِمَا قَالُوا‏}‏‏.‏ قَالَ God willing, God willing, God willing, God willing, God willing مِنِ امْرَأَتِهِ ثُمَّ يُجْمِعَ عَلَى إِمْسَاكِهَا وَإِصَابَتِهَا فَإِنْ أَجْمَعَ عَلَى ذَلِكَ فَقَْ God bless you بَعْدَ تَظَاهُرِهِ مِنْهَا عَلَى إِمْسَاكِهَا وَإِصَابَتِهَا فَلاَ كَفَّارَةَ عَلَيْهِ ‏.‏ قَالَ مَالِكٌ فَإِنْ تَزَوَّجَهَا بَعْدَ ذَلِكَ لَما كَفَّارَةَ الْمُتَظَاهِرِ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يَتَظَاهَرُ مِنْ أَمَتِهِ إِنَّهُ إِنْ أَرَادَ أَنْ يُصِيبَهَا فَعَلَيْهِ كَفَّارَةُ الظِّهَارِ قَبْلَ أَنْ يَطَأَهَا ‏.‏ قَالَ مَالِكٌ لاَ يَدْخُلُ عَلَى الرَّجُلِ إِيلاَءٌ فِي God bless you, God bless you يَفِيءَ مِنْ تَظَاهُرِهِ ‏. We have told Malik from [Hisyam bin Urwah] from [his father] that he said about a man who did zhihar on his four wives with one sentence, "He is only obliged to pay kaffarah once." Has told me from Malik from [Rabi'ah bin Abu Abdurrahman] as above (Degree: authentic. Source: Muwatta Malik no. 1175.) 26th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، God willing, God willing, God willing, God willing, God willing may Allah bless him and give him peace of mind عَلَيْكِ مَا عِشْتْ عُرْوَةُ بْنُ ام رَقَبَةٍ ‏.‏. Has told us from Malik from [Hisyam bin Urwah] that he heard a man ask [Urwah bin Az Zubair] about a man who said to his wife; "Every woman I marry after you and you are still alive, then she is like my mother's back." Urwah bin Zubair answered; "To atone for his words, he simply freed the slaves (Degree: authentic. Source: Muwatta Malik no. 1177.) 27th Hadith. God willing God willing, God willing, God willing, God willing God bless you. كَمَا يَقَعُ عَلَى الْحُرِّ ‏.‏ قَالَ مَالِكٌ وَظِهَارُ الْعَبْدِ عَلَيْهْ God willing God willing, God willing, God willing, God willing. أَنَّهُ لَوْ ذَهَبَ يَصُومُ صِيَامَ كَفِرِ دَخَلَ عَلَيْهِ طَلاَقُ الإِيلاَءِ قَبْلَ أَنْ يَفْرُغَ مِنْ صِيَامِهِ ‏.‏. Yahya from Malik told me that he once asked [Ibn Shihab] about the zhihar of his servants, so he answered; "His zhihar is like the zhihar of a free person (Degree: authentic. Source: Muwatta Malik no. 1178.) 28th Hadith. God bless you God willing, God willing, God willing, God willing. may Allah bless him and give him peace of mind God willing, God willing, God willing, God willing Allah's blessings وَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ الْوَلاَءُ لِمَنْ أَعْتَقَ ‏"‏ ‏.‏ وَدَخَلَ رَسُولُ اللَّهِ صلى الله عليه God bless you وَأُدْمٌ مِنْ أُدْمِ الْبَيْتِ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَلَمْ أَرَ بُرْمَةً فِيهَا لَحْمٌ ‏"‏ ‏.‏ فَقَالُوا بَلَى يَا رَسُولَ اللَّهِ وَلَكِنْ ذَلِكَ لَحْمٌ God willing الصَّدَقَةَ ‏." هُوَ عَلَيْهَا صَدَقَةٌ وَهُوَ لَنَا هَدِيَّةٌ ‏"‏ ‏.‏. Has told me Yahya from Malik from [Rabi'ah bin Abu Abdurrahman] from [Al Qasim bin Muhammad] from [Aisyah] Ummul Mukminin, he said; "There are three lessons relating to Barirah, one of which is that when she was liberated she was given the choice of her husband even though Rasulullah shallallahu 'alaihi wasallam said: 'The right of guardianship belongs to the one who liberates'. Once Rasulullah shallallahu 'alaihi wasallam met her, and at that time there was a stone pot full of meat boiling, but she was only served bread and side dishes. Rasulullah shallallahu 'alaihi wasallam asked; "Didn't the pot contain meat?" They answered; 'That's right, O Messenger of Allah, but that meat is meat that is given to Barirah, whereas you are not allowed to eat alms? ' Rasulullah sallallaahu 'alaihi wasallam answered; 29th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God bless you may Allah bless him and give him peace and blessings يَمَسَّهَا ‏.‏ قَالَ مَالِكٌ وَإِنْ مَسَّهَا زَوْجُهَا فَزَعَمَتْ أَنَّهَا جَهِلَتْ أَنَّ لَهَا الْخِيَارَ God bless you الْجَهَالَةِ وَلاَ خِيَارَ لَهَا بَعْدَ أَنْ يَمَسَّهَا ‏.‏. It has been told to me that Malik from [Nafi'] from [Abdullah bin Umar] said about a female slave who became the wife of a male slave, then the woman was freed, "The female slave has the right to choose as long as she has not been sexually assaulted." Malik said; "If her husband has had sexual intercourse with her and he claims that he did not know that she had the right to vote, then he is doubted and his claim that he did not know cannot be justified. And he no longer has the right to vote after being sexually assaulted (Degree: authentic. Source: Muwatta Malik no. 1180.) 30th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ God willing لَهَا زَبْرَاءُ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ عَبْدٍ وَهِيَ أَمَةٌ يَوْمَئِذٍ فَعَتَقَتْ قَالَتْ فَأَرْسَلَتْ God willing فَدَعَتْنِى God willing لَمْ يَمْسَسْكِ زَوْجُكِ فَإِنْ مَسَّكِ فَلَيْسَ لَكِ مِنَ God bless you. God willing. It has been told to me from Malik from [Ibnu Shihab] from [Urwah bin Zubair] that a former female slave of the Bani 'Adi named [Zabra'] told him that when she was still a slave, she was the wife of a male slave. Then he was released (by his master, pent). Then he said, "Hafshah, the wife of the Prophet sallallaahu 'alaihi wasallam, sent someone for me to meet her, [Hafshah] then said, 'I will give you news, but I don't want you to do anything bad. In fact, now the decision is in your hands as long as your husband has never slept with you. If your husband has slept with you, then you have no rights anymore." Zabra said; "I immediately said; 'Talak, talak and talak'. She had divorced her husband three times (Degree: authentic. Source: Muwatta Malik no. 1181.) 31st Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، أَنَّهُ God willing, God willing, God willing, God willing فَاخْتَارَتْهُ فَلَيْسَ ذَلِكَ بِطَلاَقٍ ‏.‏ قَالَ مَالِكٌ وَذَلِكَ أَحْسَنُ مَا سَمِعْتُ ‏.‏ قَالَ مَالِكٌ فِي God willing نَفْسَهَا فَقَدْ طَلُقَتْ ثَلاَثًا وَإِنْ قَالَ زَوْجُهَا لَمْ أُخَيِّرْكِ إِلاَّ وَاحِدَةً فَلَيْسَ لَهُ ذَلِكَ ‏.‏ وَذَلِكَ أَحْسَنُ مَا سَمِعْتُهُ ‏.‏ قَالَ مَالِكٌ وَإِنْ خَيَّرَهَا فَقَالَتْ قَدْ قَبِلْتُ وَاحِدَةً وَقَالَ لَمْ أُرِدْ هَذَا وَإِنَّما Allah's blessings may Allah bless him and give him peace شَاءَ اللَّهُ تَعَالَى ‏.‏. It was told to me from Malik from [Ibnu Syihab] that he heard him say, "If a husband gives his wife a choice, then her wife chooses to stay with her husband, then that is not considered a divorce." Malik said; "This is the best opinion I have ever heard (Degree: authentic. Source: Muwatta Malik no. 1183.) 32nd Hadith. God bless you عَنْ عَمْرَةَ بِنْتْ God willing, God willing, God willing, God willing Allah's blessings وَأَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم خَرَجَ إِلَى Allah's blessings God willing مَنْ هَذِهِ ‏"‏ ‏.‏ فَقَالَتْ أَنَا حَبِيبَةُ بِنْتُ سَهْلٍ يَا رَسُولَ اللَّهِ ‏.‏ قَالَ ‏"‏ مَا شَأْنُكِ ‏"‏ ‏.‏ قَالَتْ لاَ أَنَا وَلاَ ثَابِتُ بْنُ قَيْسٍ ‏.‏ لِزَوْجِهَا فَلَمَّا جَاءَ زَوْجُهَا ثَابِتُ بْنُ قَيْسٍ قَالَ لَهُ رَسُولُ اللَّهْ سَهْلٍ قَدْ ذَكَرَتْ مَا شَاءَ اللَّهُ أَنْ تَذْكُرَ ‏"‏ ‏.‏ فَقَالَتْ حَبِيبَةُ يَا رَسُولَ اللَّهِ كُلُّ مَا أَعْطَانِي God bless you. لِثَابِتِ بْنِ قَيْسٍ ‏"‏ خُذْ مِنْهَا ‏"‏ ‏.‏ فَأَخَذَ مِنْهَا وَجَلَسَتْ فِي بَيْتِ أَهْلِهَا ‏.‏. Yahya has told me from Malik from [Yahya bin Sa'id] from ['Amrah bint Abdurrahman] that he told him, from [Habibah bint Sahl Al Ansari] that she is the wife of Thabit bin Qais bin Syammas. Once Rasulullah shallallahu 'alaihi wasallam left the house to perform the morning prayer, then he found Habibah bint Sahl at the door of his house, even though it was still dark at that time. Rasulullah sallallaahu 'alaihi wasallam then asked him: "Who is that?" Habibah answered; "O Messenger of Allah, I am Habibah bint Sahl." He asked again: "What do you need?" Habibah answered; "It's not my fault nor is it Thabit bin Qais' fault." -At that time Thabit bin Qais was still her husband- When Thabit bin Qais came, Rasulullah sallallaahu 'alaihi wasallam then asked him: "This is Habibah bint Sahl who has complained about her problem, according to Allah's will what she mentioned." Habibah then said; "O Messenger of Allah, everything he gave me is still with me." Rasulullah sallallaahu 'alaihi wasallam then said to Thabit bin Qais: "Take it from him." So Thabit bin Qais took it from him, so that day Habibah bint Sahl lived with her family (Degree: authentic. Source: Muwatta Malik no. 1184.) 33rd Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ مَوْلاَةٍ، لِصَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ ‏.‏ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا بِكُلِّ شَىْءٍ لَهَا فَلَمْ يُنْكِرْ ذَلِكَ God bless you. God bless you God willing God willing, God willing, God willing, God willing, God willing God bless you God bless you. وَالَّذِي عَلَيْهِ أَمْرُ النَّاسِ عِنْدَنَا ‏.‏ قَالَ مَالِكٌ لاَ بَأْسَ بِأَنْ تَفْتَدِيَ الْمَرْأَةُ مِنْ زَوْجِهَا بِأَكْثَرَ مِمَّا أَعْطَاهَا ‏.‏. It has been told to me from Malik from [Nafi'] from the former slave Shafiyyah bint 'Ubaid that she had performed khulu' on her husband with all the property he had, and [Abdullah bin 'Umar] did not deny it (Degree: authentic. Source: Muwatta Malik no. 1185.) 34th Hadith. God bless you God willing وَعَمُّهَا إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ فَأَخْبَرَتْهُ Allah's blessings Allah's blessings يُنْكِرْهُ ‏.‏ وَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ عِدَّتُهَا عِدَّةُ الْمُطَلَّقَةِ ‏.‏. Yahya told me from Malik from [Nafi'] that [Rubai' bint Mu'awwadz bin 'Afra] and her uncle met [Abdullah bin Umar] and told him that she had asked her husband for a khulu' divorce during the time of the caliph Uthman bin 'Affan. Thing? it reached [Uthman] and he did not deny it. Abdullah bin Umar said; "Her iddah is like the iddah of a woman who was divorced (Degree: authentic. Source: Muwatta Malik no. 1186.) 35th Hadith. Allah's blessings God willing, God willing, God willing, God willing God willing Allah's blessings وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَك God willing. God willing may Allah bless him and give him peace and blessings may Allah bless him and give him peace and blessings God willing, God willing, God willing, God willing Allah's blessings God bless you God willing قَدْ كَرِهَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْمَسْأَلَةَ God bless you. God bless you. God bless you لاَ أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا ‏.‏ فَأَقْبَلَ God willing God willing وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلْ ‏ "‏ قَدْ أُنْزِلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا ‏"‏ ‏." may Allah bless him and give him peace and blessings God willing عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهْ قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ ‏.‏ وَقَالَ مَالِكٌ قَالَ ابْنُ شِهَابٍ فَكَانَتْ تِلْكَ بَعْدُ سُنَّةَ الْمُتَلاَعِنَيْنِ ‏.‏. Yahya has told me from Malik from [Ibnu Shihab] that [Sahl bin Sa'id As Sa'idi] informed him, that 'Uwaimir Al 'Ajlani met 'Ashim bin 'Adi Al Ansari and said; "O 'Ashim, what do you think if a man finds that his wife is having an affair with another man. Can he kill her so that they kill her (as qishah). Or what should he do? O 'Ashim, please ask this to Rasulullah sallallaahu 'alaihi wasallam." 'Ashim then asked Rasulullah shallallahu 'alaihi wasallam about this, but he hated the question and criticized it so that what he heard from Rasulullah shallallahu 'alaihi wasallam made it even more difficult. When 'Ashim went home to his wife, Uwaimir met him and asked; "O 'Ashim, what did Rasulullah sallallaahu 'alaihi wasallam answer to you?" 'Ashim answered; "There was nothing good, he even hated the questions I asked him." 'Uwaimir said; "By Allah, I will not be satisfied until I ask him myself!" Then Uwaimir immediately went to meet the Prophet sallallaahu 'alaihi wasallam who was in the middle of the crowd. He then asked; "O Messenger of Allah, what do you think, if there is a husband who finds out that his wife is having an affair with another man, is it permissible for him to kill her, so that the wife's family takes her as a qishah, or what?" Rasulullah sallallaahu 'alaihi wasallam then answered; "A verse has been revealed regarding you and your wife. So go and bring your wife here." Sahl said; "The two of them ended up cursing each other, while I and the people were on the side of Rasulullah sallallaahu 'alaihi wasallam. When they finished mula'anah (cursing each other), Uwaimir said, "O Rasulullah, I would have lied to her if I kept her." Uwaimi then gave three divorces to his wife before Rasulullah shallallahu 'alaihi wasallam ordered him to do so." Malik said; Ibn Syihab said, "The incident occurred after the revelation about bermula'anah (cursing each other that he had not committed adultery) (Degree: authentic. Source: Muwatta Malik no. 1188.) 36th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ God willing, God willing, God willing, God willing. God willing فَفَرَّقَ رَسُولُ اللَّهِ صلى الله وسلم وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ ‏.‏. It has been told to me from Malik from [Nafi'] from [Abdullah bin Umar] said, "In the time of the Messenger of Allah sallallaahu 'alaihi wasallam there was a man who performed li'an on his wife and asked for her child. Rasulullah shallallahu 'alaihi wasallam then separated the two and gave the child to the wife (Degree: authentic. Source: Muwatta Malik no. 1189.) 37th Hadith. God bless you God willing مُحَمَّدِ بْنِ إِيَاسِ بْنِ الْبُكَيْرِ، أَنَّهُ قَالَ طَلَّقَ God bless you God willing God bless you وَأَبَا هُرَيْرَةَ عَنْ ذَلِكَ فَقَالاَ لاَ نَرَى أَنْ God willing فَإِنَّمَا طَلاَقِي إِيَّاهَا وَاحِدَةٌ ‏.‏ قَالَ ابْنُ God bless you فَضْلٍ ‏.‏. Has told me Yahya from Malik from [Ibnu Shihab] from [Muhammad bin Abdurrahman bin Tsauban] from [Muhammad bin Iyas bin Bukair] he said; "A man imposed triple talaq on his wife before he had sex with her. Then he wanted to marry her. So he wanted to ask for a fatwa, so I accompanied him to ask for a fatwa. Then he asked [Abdullah bin 'Abbas] and [Abu Hurairah], they both answered; "We are of the opinion that you should not marry her again until your ex-wife marries another man." The man also denied; "My talaq to her was only a one-time divorce." And Ibn 'Abbas replied back; "You have given up the virtue that was in your hands (Degree: authentic. Source: Muwatta Malik no. 1192.) 38th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ God willing, God willing, God willing, God willing, God willing. بْنِ أَبِي عَيَّاش0 God willing, God willing, God willing, God willing عَمْرِو بْنْ قَبْلَ أَنْ يَمَسَّهَا قَالَ عَطَاءٌ فَقُلَُْ الْبِكْرْ God willing God bless you زَوْجًا غَيْرَهُ ‏.‏. Has told me from Malik from [Yahya bin Sa'id] from [Bukair bin Abdullah bin Al Asyaj] from [An-Nu'man bin Abu 'Ayyasy Al Ansari] from ['Atha bin Yasar] he said, "A man met Abdullah bin 'Amr bin Al 'Ash asking about a man who divorced his wife three times, even though he had never had sexual intercourse with her." 'Atha said; "Then I said, "The only thing that divorces a girl is once." [Abdullah bin 'Amru bin Al 'Ash] then said to me, "You are a fairy tale teller! (not knowing the law) Once it is bain, and three times it makes it haram until she marries another man (Degree: shahih. Source: Muwatta Malik no. 1193.) 39th Hadith. وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ God willing God willing, God willing, God willing, God willing God bless you God willing فَجَاءَهُمَا مُحَمَّدُ بْنُ إِيَاسِ بْنِ الْبُكَيْرِ فَقَالَ God willing God willing عَبْدُ اللَّهِ بْنا فِيهِ قَوْلٌ فَاذْهَبْ إِلَى عَبْدِ اللَّهِ بْنِ عَبَّاسٍ وَأَبِي هُرَيْرَةَ فَإِنِّي تَرَكْتُهُمَا عِنْدَ عَائِشَةَ فَسَلْهُمَا ثُمَّ ائْتِنَا فَأَخْبِرْنَا ‏.‏ فَذَهَبَ فَسَأَلَهُمَا فَقَالَ ابْنُ عَبَّاسٍ لأَبِي هُرَيْرَةَ مُعْضِلَةٌ ‏.‏ فَقَالَ أَبُو هُرَيْرَةَ الْوَاحِدَةُ تُبِينُهَا وَالثَّلاَثَةُ تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ ‏.‏ وَقَالَ ابْنُ عَبَّاسٍ مِثْلَ ذَلِكَ ‏.‏ قَالَ مَالِكٌ may Allah bless him and give him peace مَلَكَهَا الرَّجُلُ فَلَمْ يَدْخُلْ بِهَا إِنَّهَا تَجْرِي مَجْرَى الْبِكْرِ الْوَاحِدَةُ or تُحَرِّمُهَا حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ ‏.‏. It has been told to me from Malik from [Yahya bin Sa'id] from [Bukair bin Abdullah bin Al Asyaj] that he told him, from [Mua'wiyah bin Abu 'Ayyasy Al Ansari] that he once sat with Abdullah bin Zubair and 'Ashim bin Umar bin Khattab." Mua'wiyah said; "Muhammad bin Iyas bin Al Bukair approached the two of them and asked; "There was a Bedouin man who divorced his wife three times, even though he had never had sexual intercourse with her. What do you two think? ' Abdullah bin Zubair answered; 'In this matter, we have no opinion. Go to [Abdullah bin 'Abbas] and [Abu Hurairah], I have left them both at 'Aisha's place. Ask them both, after that come back and tell us!' Muhammad bin Iyas then went and asked them both, Ibn Abbas then said to Abu Hurairah; "O Abu Hurairah, give him a fatwa. He has come to you with a complicated problem." Abu Hurairah then answered; 'Talak once for a wife who is still a girl means talak ba'in, and talaq three times can forbid her from marrying until she marries another man.'
