Welcome to the study of authentic hadith selected by ULYAH. Let's look at some of the following sayings of the Prophet sallallaahu 'alaihi wa sallam, one by one, with an open heart to put them into practice. 1st Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ يُونُسَ عَنْ الْحَسَنِ أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَعْطَى الْخَالَةَ الثُّلُثَ وَالْعَمَّةَ الثُّلُثَيْنِ. It has been reported to us that [Muhammad bin Yusuf] has told us [Sufyan] from [Yunus] from [Al Hasan] that [Umar bin Al Khaththab] gave his maternal aunt one third and his paternal aunt two thirds of the inheritance. (Degree: authentic. Source: Sunan Ad-Darimi.) 2nd hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ الْحَسَنِ بْنِ عَمْرٍو عَنْ غَالِبِ بْنِ عَبَّادٍ عَنْ قَيْسِ بْنِ حَبْتَرٍ النَّهْشَلِيِّ قَالَ أُتِيَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ فِي خَالَةٍ وَعَمَّةٍ فَقَامَ شَيْخٌ فَقَالَ شَهِدْتُ عُمَرَ بْنَ الْخَطَّابِ أَعْطَى الْخَالَةَ الثُّلُثَ وَالْعَمَّةَ الثُّلُثَيْنِ قَالَ فَهَمَّ أَنْ يَكْتُبَ بِهِ ثُمَّ قَالَ أَيْنَ زَيْدٌ عَنْ هَذَا. Has told us [Muhammad bin Yusuf] has told us [Sufyan] from [Al Hasan bin Amr] from [Ghalib bin 'Abbad] from [Qais bin Habtar An Nahsyali] he said; Abdul Malik bin Marwan was once asked about his maternal aunt and paternal aunt. Then someone [shaykh] stood up and said; I witnessed [Umar bin Al Khaththab] giving his maternal aunt one third and his paternal aunt two thirds. He said again; He intended to write down his decision, but he said; What does Zaid think about this? (Degree: authentic. Source: Sunan Ad-Darimi.) 3rd Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ مُحَمَّدِ بْنِ سَالِمٍ عَنْ الشَّعْبِيِّ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللَّهِ قَالَ الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ وَالْعَمَّةُ بِمَنْزِلَةِ الْأَبِ وَبِنْتُ الْأَخِ بِمَنْزِلَةِ الْأَخِ وَكُلُّ رَحِمٍ بِمَنْزِلَةِ رَحِمِهِ الَّتِي يُدْلِي بِهَا إِذَا لَمْ يَكُنْ وَارِثٌ ذُو قَرَابَةٍ. Has told us [Muhammad bin Yusuf] has told us [Sufyan] from [Muhammad bin Salim] from [Ash Sya'bi] from [Masruq] from [Abdullah] he said; The position of maternal aunts is the same as that of mothers, paternal aunts are the same as fathers, daughters of brothers are the same as brothers and all dzawul arhams are the same as other dzawul arhams determined by them, they are related to the deceased if there are no heirs who are closely related. Source: Sunan Ad-Darimi.) 4th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَخْبَرَنَا هِشَامٌ عَنْ مُحَمَّدٍ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ قَالَ حَدَّثَنِي الضَّحَّاكُ بْنُ قَيْسٍ أَنَّ عُمَرَ قَضَى فِي أَهْلِ طَاعُونِ عَمَوَاسَ أَنَّهُمْ كَانُوا إِذَا كَانُوا مِنْ قِبَلِ الْأَبِ سَوَاءً فَبَنُو الْأُمِّ أَحَقُّ وَإِذَا كَانَ بَعْضُهُمْ أَقْرَبَ مِنْ بَعْضٍ بِأَبٍ فَهُمْ أَحَقُّ بِالْمَالِ. Has reported to us [Yazid bin Harun] has reported to us [Hisham] from [Muhammad] from [Abdullah bin Utbah] he said; had told me [Adl Dlahhak bin Qais] that [Umar] had decided on the people affected by tha'un (leprosy) Amawas. If those from the father's side have the same position, then the mother's sons have more rights. If some of them are closer than others to their father, they are more entitled to inheritance. Source: Sunan Ad-Darimi.) 5th Hadith. حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا أَبُو شِهَابٍ حَدَّثَنِي أَبُو إِسْحَقَ الشَّيْبَانِيُّ عَنْ عُبَيْدِ بْنِ أَبِي الْجَعْدِ عَنْ عَبْدِ اللَّهِ بْنِ شَدَّادِ بْنِ الْهَادِ قَالَ أُصِيبَ سَالِمٌ مَوْلَى أَبِي حُذَيْفَةَ يَوْمَ الْيَمَامَةِ فَبَلَغَ مِيرَاثُهُ مِائَتَيْ دِرْهَمٍ فَقَالَ عُمَرُ احْبِسُوهَا عَلَى أُمِّهِ حَتَّى تَأْتِيَ عَلَى آخِرِهَا. Has told us [Ahmad bin Abdullah] has told us [Abu Syihab] has told me [Abu Ishaq Asy Syaibani] from [Ubaid bin Abu Al Ja'd] from [Abdullah bin Syaddad bin Al Had] he said; Salim, former slave of Abu Hudzaifah, died (killed) in the Yamamah war. The inheritance left behind amounted to two hundred dirhams. So [Umar] said; Save the treasure for his mother, until finally she (mother) comes. (Degree: authentic. Source: Sunan Ad-Darimi.) 6th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زُهَيْرٌ عَنْ أَبِي إِسْحَقَ عَنْ الْحَارِثِ عَنْ عَلِيٍّ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْإِخْوَةُ مِنْ الْأُمِّ يَتَوَارَثُونَ دُونَ بَنِي الْعَلَّاتِ يَرِثُ الرَّجُلُ أَخَاهُ لِأَبِيهِ وَأُمِّهِ دُونَ أَخِيهِ لِأَبِيهِ. It has been told to us [Abu Nu'aim] has told us [Zuhair] from [Abu Ishaq] from [Al Harith] from [Ali] from the Prophet sallallaahu 'alaihi wasallam, he said: "Brothers from one mother can inherit from each other, not brothers from the father's father. A person can inherit from brothers from the father's father and from the same mother except brothers from the father's father." (Degree: authentic. Source: Sunan Ad-Darimi.) 7th Hadith. حَدَّثَنَا سَهْلُ بْنُ حَمَّادٍ حَدَّثَنَا شُعْبَةُ عَنْ النُّعْمَانِ بْنِ سَالِمٍ قَالَ قُلْتُ لِابْنِ عُمَرَ أَرَأَيْتَ رَجُلًا تَرَكَ ابْنَ ابْنَتِهِ أَيَرِثُهُ قَالَ لَا. Has told us [Sahal bin Hammad] has told us [Syu'bah] from [An Nu'man bin Salim] he said; I once asked [Ibn Umar]; What do you think about someone who dies and leaves a son and daughter, does he get an inheritance? He answered; No. (Degree: authentic. Source: Sunan Ad-Darimi.) 8th Hadith. حَدَّثَنَا يَعْلَى حَدَّثَنَا الْأَعْمَشُ عَنْ إِبْرَاهِيمَ قَالَ قَالَ عَبْدُ اللَّهِ الْأُمُّ عَصَبَةُ مَنْ لَا عَصَبَةَ لَهُ وَالْأُخْتُ عَصَبَةُ مَنْ لَا عَصَبَةَ لَهُ. Has told us [Ya'la] has told us [Al A'masy] from [Ibrahim] he said; [Abdullah] once said; Mother is ashabah for people who do not have ashabah. Sisters are also ashabah for people who do not have ashabah. (Degree: authentic. Source: Sunan Ad-Darimi.) 9th Hadith. حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ حَدَّثَنَا وُهَيْبٌ حَدَّثَنَا ابْنُ طَاوُسٍ عَنْ أَبِيهِ عَنْ ابْنِ عَبَّاسٍ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ. Has told us [Muslim bin Ibrahim] has told us [Wuhaib] has told us [Ibn Thawus] from [his father] from [Ibn Abbas] from the Prophet sallallaahu 'alaihi wasallam, he said: "Give the portion that has been determined to the person who is entitled to it. Meanwhile, the remaining property is distributed to the men closest to the deceased." (Degree: authentic. Source: Sunan Ad-Darimi.) 10th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا يَحْيَى أَنَّ سُلَيْمَانَ بْنَ يَسَارٍ أَخْبَرَهُ عَنْ مُحَمَّدِ بْنِ الْأَشْعَثِ أَنَّ عَمَّةً لَهُ تُوُفِّيَتْ يَهُودِيَّةً بِالْيَمَنِ فَذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ فَقَالَ يَرِثُهَا أَقْرَبُ النَّاسِ إِلَيْهَا مِنْ أَهْلِ دِينِهَا. It has been reported to us [Yazid bin Harun] has told us [Yahya] that [Sulaiman bin Yasar] informed him from [Muhammad bin Al Asy'ats] that an aunt of his died in Yemen in a Jewish (religious) state. Then he told this to [Umar bin Al Khaththab], so he said; The person who is closest and of the same religion as him is the one who has the right to inherit it. (Degree: authentic. Source: Sunan Ad-Darimi.) 11th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ قَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ أَهْلُ الشِّرْكِ لَا نَرِثُهُمْ وَلَا يَرِثُونَا. Has told us [Muhammad bin Yusuf] has told us [Sufyan] from [Hammad] from [Ibrahim] he said; [Umar bin Al Khaththab] once said; We have no right to inherit the inheritance of polytheists and they have no right to inherit us. (Degree: authentic. Source: Sunan Ad-Darimi.) 12th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا حَسَنٌ عَنْ عِيسَى الْحَنَّاطِ عَنْ الشَّعْبِيِّ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَأَبَا بَكْرٍ وَعُمَرَ قَالُوا لَا يَتَوَارَثُ أَهْلُ دِينَيْنِ. Has told us [Abu Nu'aim] has told us [Hasan] from [Isa Al Hannath] from [Ash Sya'bi] that Rasulullah sallallaahu 'alaihi wasallam, Abu Bakr and Umar said; (Between) two followers of (different) religions cannot inherit from each other. (Degree: authentic. Source: Sunan Ad-Darimi.) 13th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زُهَيْرٌ عَنْ مُطَرِّفٍ عَنْ عَامِرٍ عَنْ عُمَرَ قَالَ لَا يَتَوَارَثُ أَهْلُ مِلَّتَيْنِ. Has told us [Abu Nu'aim] has told us [Zuhair] from [Mutharrif] from [Amir] from [Umar] he said; Two followers of a religion cannot inherit from each other. (Degree: authentic. Source: Sunan Ad-Darimi.) 14th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا شَرِيكٌ عَنْ الْأَشْعَثِ عَنْ الْحَسَنِ عَنْ جَابِرٍ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَا نَرِثُ أَهْلَ الْكِتَابِ وَلَا يَرِثُونَا إِلَّا الرَّجُلُ يَرِثُ عَبْدَهُ أَوْ أَمَتَهُ. Has told us [Muhammad bin Isa] has told us [Sharik] from [Al Ash'ats] from [Al Hasan] from [Jabir] he said; The Prophet sallallaahu 'alaihi wasallam said: "We have no right to inherit from people of the book and they have no right to inherit us except someone who inherits his male or female slaves." Source: Sunan Ad-Darimi.) 15th Hadith. حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ دَاوُدَ عَنْ الشَّعْبِيِّ عَنْ مَسْرُوقٍ قَالَ كَانَ مُعَاوِيَةُ يُوَرِّثُ الْمُسْلِمَ مِنْ الْكَافِرِ وَلَا يُوَرِّثُ الْكَافِرَ مِنْ الْمُسْلِمِ قَالَ قَالَ مَسْرُوقٌ وَمَا حَدَثَ فِي الْإِسْلَامِ قَضَاءٌ أَحَبُّ إِلَيَّ مِنْهُ قِيلَ لِأَبِي مُحَمَّدٍ تَقُولُ بِهَذَا قَالَ لَا. Has told us [Sulaiman bin Harb] has told us [Hammad bin Salamah] from [Dawud] from [Ash Sya'bi] from [Masruq] he said; [Mu'awiyah] allowed muslim people to inherit unbelievers but did not allow unbelievers to inherit muslim people. He continued; Masruq said; There is no decision in Islam that I like more than this decision. Someone asked Abu Muhammad; Do you also say this? He answered; No. (Degree: authentic. Source: Sunan Ad-Darimi.) 16th Hadith. حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ حَدَّثَنَا أَنَسُ بْنُ سِيرِينَ قَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ لَا يَتَوَارَثُ مِلَّتَانِ شَتَّى وَلَا يَحْجُبُ مَنْ لَا يَرِثُ. Has told us [Sulaiman bin Harb] has told us [Hammad bin Zaid] has told us [Anas bin Sirin] he said; [Umar bin Al Khaththab] said; Two followers of different religions cannot inherit from each other and people who cannot inherit cannot prevent other heirs. (Degree: authentic. Source: Sunan Ad-Darimi.) 17th Hadith. حَدَّثَنَا نَصْرُ بْنُ عَلِيٍّ حَدَّثَنَا عَبْدُ الْأَعْلَى عَنْ مَعْمَرٍ عَنْ الزُّهْرِيِّ عَنْ عَلِيِّ بْنِ حُسَيْنٍ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ أُسَامَةَ بْنِ زَيْدٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ. It has been told to us [Nashr bin Ali] has told us [Abdul A'la] from [Ma'mar] from [Az Zuhri] from [Ali bin Husain] from [Amr bin Uthman] from [Usamah bin Zaid] that the Messenger of Allah (peace and blessings of Allaah be upon him) said: "The muslim person cannot inherit the property of the disbeliever and the disbeliever cannot inherit the property of the muslim person." Source: Sunan Ad-Darimi.) 18th Hadith. حَدَّثَنَا جَعْفَرُ بْنُ عَوْنٍ عَنْ سَعِيدٍ عَنْ أَبِي مَعْشَرٍ عَنْ إِبْرَاهِيمَ قَالَ إِذَا مَاتَ الْمَيِّتُ وَجَبَتْ الْحُقُوقُ لِأَهْلِهَا وَلَمْ يَجْعَلْ لِمَنْ أَسْلَمَ أَوْ أُعْتِقَ قَبْلَ أَنْ يُقْسَمَ الْمِيرَاثُ شَيْئًا. Has told us [Ja'far bin 'Aun] from [Sa'id] from [Abu Ma'syar] from [Ibrahim] he said; If someone dies, rights must be given to the people who are entitled to receive them. Not even the slightest portion of the assets is given to people who convert to Islam or people who are liberated before the inheritance is distributed. (Degree: authentic. Source: Sunan Ad-Darimi.) 19th hadith. حَدَّثَنَا عَمْرُو بْنُ عَوْنٍ حَدَّثَنَا سُفْيَانُ عَنْ الزُّهْرِيِّ عَنْ عَلِيِّ بْنِ حُسَيْنٍ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ أُسَامَةَ بْنِ زَيْدٍ عَنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ لَا يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلَا الْكَافِرُ الْمُسْلِمَ. Has told us [Amr bin 'Aun] has told us [Sufyan] from [Az Zuhri] from [Ali bin Husain] from [Amr bin Uthman] from [Usamah bin Zaid] from the Prophet sallallaahu 'alaihi wasallam, he said: "People muslim cannot inherit the property of unbelievers and unbelievers cannot inherit the property of muslim people." (Degree: authentic. Source: Sunan Ad-Darimi.) 20th hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ قَالَ لَيْسَ لِلْمُكَاتَبِ مِيرَاثٌ مَا بَقِيَ عَلَيْهِ شَيْءٌ مِنْ مُكَاتَبَتِهِ. Has told us [Abu An Nu'man] has told us [Abu 'Awanah] from [Al Mughirah] from [Ibrahim] he said; Mukatab does not inherit as long as there is still outstanding payment from his Mukatab that has not been paid off. (Degree: authentic. Source: Sunan Ad-Darimi.) 21st Hadith. حَدَّثَنَا يَعْلَى حَدَّثَنَا عَبْدُ الْمَلِكِ عَنْ عَطَاءٍ فِي رَجُلٍ لَهُ بَنُونَ قَدْ أَعْتَقَ مِنْ بَعْضِهِمْ النِّصْفَ وَمِنْ بَعْضِهِمْ الثُّلُثَ وَمِنْ بَعْضٍ الرُّبُعَ قَالَ لَا يَرِثُونَ حَتَّى يُعْتَقُوا. Has told us [Ya'la] has told us [Abdul Malik] from ['Atha`] about someone who had several slaves, some of whom he freed for half (of the slave's price), others he freed for a third (of the slave's price) and others he freed for a quarter (of the slave's price). He said; They could not inherit until they were freed. (Degree: authentic. Source: Sunan Ad-Darimi.) 22nd Hadith. حَدَّثَنَا عَبْدُ اللَّهِ بْنُ جَعْفَرٍ الرَّقِّيُّ وَسَعِيدُ بْنُ الْمُغِيرَةِ عَنْ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ فِي رَجُلٍ اشْتَرَى ابْنَهُ فِي مَرَضِهِ قَالَ إِنْ خَرَجَ مِنْ الثُّلُثِ وَرِثَهُ وَإِنْ وَقَعَتْ عَلَيْهِ السِّعَايَةُ لَمْ يَرِثْ. Having told us [Abdul Ja'far Ar Ruqqi] and [Sa'ib bin Al Mughirah] from [Ibn Al Mubarak] from [Ma'mar] from [Hammad] from [Ibrahim] about a man who bought his slave during his illness, he said; If he had paid a third then the slave could inherit it, but if he was still doing work then he could not inherit. (Degree: authentic. Source: Sunan Ad-Darimi.) 23rd Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا حَسَنٌ عَنْ أَبِيهِ عَنْ الشَّعْبِيِّ قَالَ حَدُّ الْمُكَاتَبِ حَدُّ الْمَمْلُوكِ حَتَّى يُعْتَقَ. Has told us [Abu Nu'aim] has told us [Hasan] from [his father] from [Ash Sha'bi] he said; The punishment for themukatab is the same as that of a slave until he is free. (Degree: authentic. Source: Sunan Ad-Darimi.) 24th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا سَعِيدُ بْنُ عَبْدِ الرَّحْمَنِ حَدَّثَنَا يُونُسُ عَنْ الزُّهْرِيِّ قَالَ قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَوْلَى أَخٌ فِي الدِّينِ وَنِعْمَةٌ أَحَقُّ النَّاسِ بِمِيرَاثِهِ أَقْرَبُهُمْ مِنْ الْمُعْتِقِ. Has told us [Muhammad bin Isa] has told us [Sa'id bin Abdurrahman] has told us [Yunus] from [Az Zuhri] he said; The Prophet sallallaahu 'alaihi wasallam said: "Former slaves are brothers in religion and in the gift of enjoyment. The person who is most entitled to his inheritance is the person who liberates him who is closest to him." (Degree: authentic. Source: Sunan Ad-Darimi.) 25th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا عَبَّادٌ عَنْ عُمَرَ بْنِ عَامِرٍ عَنْ قَتَادَةَ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ عَنْ زَيْدِ بْنِ ثَابِتٍ فِي رَجُلٍ تَرَكَ أَبَاهُ وَابْنَ ابْنِهِ فَقَالَ الْوَلَاءُ لِابْنِ الِابْنِ. Has told us [Muhammad bin Isa] has told us ['Abbad] from [Umar bin Amir] from [Qatadah] from [Sa'id bin Al Musayyab] from [Zaid bin Thabit] about a son who left his father and his son's son, he said; Wala` for sons of sons. (Degree: authentic. Source: Sunan Ad-Darimi.) 26th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا مُعَمَّرٌ حَدَّثَنَا خُصَيْفٌ عَنْ زِيَادِ بْنِ أَبِي مَرْيَمَ أَنَّ امْرَأَةً أَعْتَقَتْ عَبْدًا لَهَا ثُمَّ تُوُفِّيَتْ وَتَرَكَتْ ابْنَهَا وَأَخَاهَا ثُمَّ تُوُفِّيَ مَوْلَاهَا فَأَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ابْنُ الْمَرْأَةِ وَأَخُوهَا فِي مِيرَاثِهِ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِيرَاثُهُ لِابْنِ الْمَرْأَةِ فَقَالَ أَخُوهَا يَا رَسُولَ اللَّهِ لَوْ أَنَّهُ جَرَّ جَرِيرَةً عَلَى مَنْ كَانَتْ قَالَ عَلَيْكَ. It has been told to us [Muhammad bin Isa] has told us [Mu'ammar] has told us [Khushaif] from [Ziyad bin Abu Maryam] that a woman freed her slave and then the woman died and left her son and brother behind. After that his former slave died. The boy and the girl's brother went to the Prophet sallallaahu 'alaihi wasallam to ask about the inheritance of the former slave. So the Prophet sallallaahu 'alaihi wasallam: "The inheritance is for the woman's sons." The woman's brother said; O Messenger of Allah, if the former slave commits a crime then who will bear the responsibility for his crime? He answered: "you." (Degree: authentic. Source: Sunan Ad-Darimi.) 27th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ الصَّلْتِ حَدَّثَنَا هُشَيْمٌ عَنْ شُعْبَةَ قَالَ سَمِعْتُ الْحَكَمَ وَحَمَّادًا يَقُولَانِ هُوَ لِلِابْنِ. Has told us [Muhammad bin Ash Shalt] has told us [Husyaim] from [Syu'bah] he said; I heard [Al Hakam] and [Hammad] both say; The inheritance was given to sons. (Degree: authentic. Source: Sunan Ad-Darimi.) 28th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَخْبَرَنَا الْأَشْعَثُ عَنْ الْحَسَنِ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ إِلَى الْبَقِيعِ فَرَأَى رَجُلًا يُبَاعُ فَأَتَاهُ فَسَاوَمَ بِهِ ثُمَّ تَرَكَهُ فَرَآهُ رَجُلٌ فَاشْتَرَاهُ فَأَعْتَقَهُ ثُمَّ جَاءَ بِهِ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ إِنِّي اشْتَرَيْتُ هَذَا فَأَعْتَقْتُهُ فَمَا تَرَى فِيهِ فَقَالَ هُوَ أَخُوكَ وَمَوْلَاكَ قَالَ مَا تَرَى فِي صُحْبَتِهِ فَقَالَ إِنْ شَكَرَكَ فَهُوَ خَيْرٌ لَهُ وَشَرٌّ لَكَ وَإِنْ كَفَرَكَ فَهُوَ خَيْرٌ لَكَ وَشَرٌّ لَهُ قَالَ مَا تَرَى فِي مَالِهِ قَالَ إِنْ مَاتَ وَلَمْ يَتْرُكْ عَصَبَةً فَأَنْتَ وَارِثُهُ. It has been reported to us [Yazid bin Harun] has informed us [Al Asy'ats] from [Al Hasan] that the Prophet sallallaahu 'alaihi wasallam once went to Baqi' then he saw a male slave being sold. He came and offered it then he left. After that, someone saw it and bought it and released it. Then he came and brought the former slave to the Prophet sallallaahu 'alaihi wasallam and said; In fact, I bought this slave and set him free, what do you think about it? The Prophet sallallaahu 'alaihi wasallam answered: "He is your brother and your former slave." He asked again; What do you think about being friends with him? He answered: "If he can thank you then it is good for him but bad for you and if he disowns you then it is good for you but bad for him." He asked again; What do you think about his assets? He answered: "If he dies and does not leave ashabah then you are his heir." (Degree: authentic. Source: Sunan Ad-Darimi.) 29th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَخْبَرَنَا أَشْعَثُ عَنْ الْحَكَمِ وَسَلَمَةَ بْنِ كُهَيْلٍ عَنْ عَبْدِ اللَّهِ بْنِ شَدَّادٍ أَنَّ ابْنَةَ حَمْزَةَ أَعْتَقَتْ عَبْدًا لَهَا فَمَاتَ وَتَرَكَ ابْنَتَهُ وَمَوْلَاتَهُ بِنْتَ حَمْزَةَ فَقَسَمَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مِيرَاثَهُ بَيْنَ ابْنَتِهِ وَمَوْلَاتِهِ بِنْتِ حَمْزَةَ نِصْفَيْنِ. It has been reported to us [Yazid bin Harun] has informed us [Al Asy'ats] from [Al Hakam] and [Salamah bin Kuhail] from [Abdullah bin Syaddad] that Hamzah's daughter freed a male slave who belonged to him and then the former slave died and left behind a daughter and her master, namely Hamzah's daughter. So the Prophet sallallaahu 'alaihi wasallam divided the inheritance of the freed slave between his daughter and her master, half (portion) each. (Degree: authentic. Source: Sunan Ad-Darimi.) 30th Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ ابْنِ أَبِي لَيْلَى عَنْ الْحَكَمِ عَنْ أَبِي الْكَنُودِ عَنْ عَلِيٍّ أَنَّهُ أُتِيَ بِابْنَةٍ وَمَوْلًى فَأَعْطَى الِابْنَةَ النِّصْفَ وَالْمَوْلَى النِّصْفَ قَالَ الْحَكَمُ فَمَنْزِلِي هَذَا نَصِيبُ الْمَوْلَى الَّذِي وَرِثَهُ عَنْ مَوْلَاهُ. It has been reported to us [Muhammad bin Uyainah] from [Ali bin Mushir] from [Ibn Abu Laila] from [Al Hakam] from [Abu Al Kanud] from [Ali] that he was once asked about a daughter and a former slave. So he gave the daughter and the former slave half each. Al Hakam said; In my opinion, this is part of what former slaves inherited from those who freed them. (Degree: authentic. Source: Sunan Ad-Darimi.) 31st Hadith. أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُوسَى عَنْ ابْنِ إِدْرِيسَ عَنْ أَشْعَثَ عَنْ الْحَكَمِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ مُدْلِجٍ أَنَّهُ مَاتَ وَتَرَكَ ابْنَتَهُ وَمَوَالِيَهُ فَأَعْطَى عَلِيٌّ ابْنَتَهُ النِّصْفَ وَمَوَالِيَهُ النِّصْفَ. It has been reported to us [Ibrahim bin Musa] from [Ibn Idris] from [Ash'ath] from [Al Hakam] from [Abdurrahman bin Mudlij] that a slave died and left behind a daughter and the person who freed her, so [Ali] gave half to the daughter and half to the former slaves of her father. Source: Sunan Ad-Darimi.) 32nd Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا حَفْصُ بْنُ غِيَاثٍ حَدَّثَنَا أَشْعَثُ عَنْ جَهْمِ بْنِ دِينَارٍ عَنْ إِبْرَاهِيمَ أَنَّهُ سُئِلَ عَنْ أُخْتَيْنِ اشْتَرَتْ إِحْدَاهُمَا أَبَاهَا فَأَعْتَقَتْهُ ثُمَّ مَاتَ قَالَ لَهُمَا الثُّلُثَانِ فَرِيضَتُهُمَا فِي كِتَابِ اللَّهِ وَمَا بَقِيَ فَلِلْمُعْتِقَةِ دُونَ الْأُخْرَى. Has told us [Muhammad bin Isa] has told us [Hafsh bin Ghiyats] has told us [Ash'ats] from [Jahm bin Dinar] from [Ibrahim] that he was once asked about one of the two sisters who bought his father and then freed him and then his father died. He answered; They both get two-thirds as the portion that has been determined for both of them in the Book of Allah and the remaining wealth is for the one who liberates it and not for the other. Source: Sunan Ad-Darimi.) 33rd Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا إِسْرَائِيلُ حَدَّثَنَا الْأَشْعَثُ عَنْ الشَّعْبِيِّ فِي امْرَأَةٍ أَعْتَقَتْ أَبَاهَا فَمَاتَ الْأَبُ وَتَرَكَ أَرْبَعَ بَنَاتٍ هِيَ إِحْدَاهُنَّ قَالَ لَيْسَ عَلَيْهِ مِنَّةٌ لَهُنَّ الثُّلُثَانِ وَهِيَ مَعَهُنَّ. Has told us [Muhammad bin Yusuf] has told us [Isra`il] has told us [Al Asy'ats] from [Ash Sya'bi] about a woman who liberated her father, then the father died and left four daughters, one of whom was the one who liberated her. He answered; Fathers are not allowed to exceed (their share), they get two-thirds including those who free them. (Degree: authentic. Source: Sunan Ad-Darimi.) 34th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زُهَيْرٌ عَنْ حَيَّانَ بْنِ سَلْمَانَ قَالَ كُنْتُ عِنْدَ سُوَيْدِ بْنِ غَفَلَةَ فَجَاءَهُ رَجُلٌ فَسَأَلَهُ عَنْ فَرِيضَةِ رَجُلٍ تَرَكَ ابْنَتَهُ وَامْرَأَتَهُ قَالَ أَنَا أُنْبِئُكَ قَضَاءَ عَلِيٍّ قَالَ حَسْبِي قَضَاءُ عَلِيٍّ قَالَ قَضَى عَلِيٌّ لِامْرَأَتِهِ الثُّمُنَ وَلِابْنَتِهِ النِّصْفَ ثُمَّ رَدَّ الْبَقِيَّةَ عَلَى ابْنَتِهِ. Has told us [Abu Nu'aim] has told us [Zuhair] from [Hayyan bin Salman] he said; When I was with [Suwaid bin Ghafalah], a man came and asked him about the inheritance of someone who left his daughter and wife; I tell you, is that Ali's decision? He answered; I think (enough with) Ali's decision. He continued; [Ali] decided to give the wife one eighth and the daughter half then he returned the rest to the daughter. (Degree: authentic. Source: Sunan Ad-Darimi.) 35th Hadith. حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ إِسْرَائِيلَ عَنْ أَبِي الْهَيْثَمِ عَنْ إِبْرَاهِيمَ أَنَّ مَوْلَاةً لِإِبْرَاهِيمَ تُوُفِّيَتْ وَتَرَكَتْ مَالًا فَقُلْتُ لِإِبْرَاهِيمَ فَقَالَ إِنَّ لَهَا ذَا قَرَابَةٍ. It has been told to us [Ubaidullah] from [Isra`il] from [Abu Al Haitsam] from [Ibrahim] that a former female slave of Ibrahim died and left property. So I asked Ibrahim, he answered; In fact, he still has kinship. (Degree: authentic. Source: Sunan Ad-Darimi.) 36th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا أَشْعَثُ عَنْ الشَّعْبِيِّ عَنْ عُمَرَ وَعَلِيٍّ وَزَيْدٍ قَالَ وَأَحْسَبُهُ قَدْ ذَكَرَ عَبْدَ اللَّهِ أَيْضًا أَنَّهُمْ قَالُوا الْوَلَاءُ لِلْكُبْرِ يَعْنُونَ بِالْكُبْرِ مَا كَانَ أَقْرَبَ بِأَبٍ أَوْ أُمٍّ. Has told us [Yazid bin Harun] has told us [Ash'ath] from [Ash Sya'bi] from [Umar], [Ali] and [Zaid]. He said; And I thought [Abdullah] also said it. They said; Wala` for the older ones. According to them, what is meant by older is someone who is closer to their father or mother. (Degree: authentic. Source: Sunan Ad-Darimi.) 37th Hadith. حَدَّثَنَا يَزِيدُ حَدَّثَنَا أَشْعَثُ عَنْ ابْنِ سِيرِينَ عَنْ عَبْدِ اللَّهِ بْنِ عُتْبَةَ قَالَ كُتِبَ إِلَى عُمَرَ فِي شَأْنِ فُكَيْهَةَ بِنْتِ سَمْعَانَ أَنَّهَا مَاتَتْ وَتَرَكَتْ ابْنَ أَخِيهَا لِأَبِيهَا وَأُمِّهَا وَابْنَ أَخِيهَا لِأَبِيهَا فَكَتَبَ عُمَرُ إِنَّ الْوَلَاءَ لِلْكُبْرِ. Has told us [Yazid] has told us [Ash'ath] from [Ibn Sirin] from [Abdullah bin Utbah] he said; A letter was sent to Umar regarding Fukaihah bint Sam'an who died and left behind a son from her father's and mother's brothers and a son from her father's half-brother. So [Umar] replied to the letter; Verily wala` is for the older ones. (Degree: authentic. Source: Sunan Ad-Darimi.) 38th Hadith. حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا أَبُو شِهَابٍ عَنْ الشَّيْبَانِيِّ عَنْ الشَّعْبِيِّ أَنَّ عَلِيًّا وَزَيْدًا قَالَا الْوَلَاءُ لِلْكُبْرِ و قَالَ عَبْدُ اللَّهِ وَشُرَيْحٌ لِلْوَرَثَةِ. Has told us [Ahmad bin Abdullah] has told us [Abu Shihab] from [Ash Syaibani] from [Ash Sya'bi] that [Ali] and [Zaid] said; Wala` for the older ones. While [Abdullah] and [Syuraih] said; For heirs.
