Welcome to the study of authentic hadith selected by ULYAH. Let's look at some of the following sayings of the Prophet sallallaahu 'alaihi wa sallam, one by one, with an open heart to put them into practice. 1st Hadith. حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ إِسْرَائِيلَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ قَالَ كَانَ السُّدُسُ أَحَبَّ إِلَيْهِمْ مِنْ الثُّلُثِ. Having told us [Ubaidullah] from [Isra`il] from [Mansur] from [Ibrahim] he said; They prefer one sixth to one third. (Degree: authentic. Source: Sunan Ad-Darimi.) 2nd hadith. حَدَّثَنَا أَبُو الْوَلِيدِ حَدَّثَنَا شَرِيكٌ عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ قَالَ الْوَصِيُّ أَمِينٌ فِيمَا أُوصِيَ إِلَيْهِ بِهِ. Has told us [Abu Al Walid] has told us [Sharik] from [Mughirah] from [Ibrahim] he said; The person who is given a will must be trustworthy in what is bequeathed to him. (Degree: authentic. Source: Sunan Ad-Darimi.) 3rd Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ عَنْ ابْنِ وَهْبٍ عَنْ مَكْحُولٍ قَالَ أَمْرُ الْوَصِيِّ جَائِزٌ فِي كُلِّ شَيْءٍ إِلَّا فِي الِابْتِيَاعِ وَإِذَا بَاعَ بَيْعًا لَمْ يُقِلْ وَهُوَ رَأْيُ يَحْيَى بْنِ حَمْزَةَ. Has told us [Muhammad bin Al Mubarak] has told us [Yahya bin Hamzah] from [Ibn Wahb] from [Makhul] he said; The actions of the person who is given a will are permitted in all matters except in the case of purchasing himself. If he sells an item, it cannot be cancelled. This is the opinion of Yahya bin Hamzah. (Degree: authentic. Source: Sunan Ad-Darimi.) 4th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ حَدَّثَنَا الْوَلِيدُ عَنْ الْأَوْزَاعِيِّ عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ قَالَ الْوَصِيُّ أَمِينٌ فِي كُلِّ شَيْءٍ إِلَّا فِي الْعِتْقِ فَإِنَّ عَلَيْهِ أَنْ يُقِيمَ الْوَلَاءَ. Has told us [Muhammad bin Al Mubarak] has told us [Al Walid] from [Al Auza'i] from [Yahya bin Abu Kathir] he said; The person who was given a will had the right to everything except emancipation, because his obligation was to maintain slave ownership. (Degree: authentic. Source: Sunan Ad-Darimi.) 5th Hadith. حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ إِسْرَائِيلَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ فِي مَالِ الْيَتِيمِ يَعْمَلُ بِهِ الْوَصِيُّ إِذَا أَوْصَى إِلَى الرَّجُلِ. Has told us [Ubaidullah] from [Isra`il] from [Mansur] from [Ibrahim] about the property of orphans; The person who is given a will has the right to manage it if he bequeaths it to someone. (Degree: authentic. Source: Sunan Ad-Darimi.) 6th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ الصَّلْتِ حَدَّثَنَا مُوسَى بْنُ مُحَمَّدٍ عَنْ إِسْمَعِيلَ عَنْ الْحَسَنِ قَالَ وَصِيُّ الْيَتِيمِ يَأْخُذُ لَهُ بِالشُّفْعَةِ وَالْغَائِبُ عَلَى شُفْعَتِهِ. Has told us [Muhammad bin Ash Shalt] has told us [Musa bin Muhammad] from [Isma'il] from [Al Hasan] he said; The testamentary right to take care of orphans is taken by syuf'ah. People who are not present also have syuf'ah rights. (Degree: authentic. Source: Sunan Ad-Darimi.) 7th Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ عَنْ عِكْرِمَةَ عَنْ شَيْخٍ مِنْ أَهْلِ دِمَشْقَ قَالَ كُنْتُ عِنْدَ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ وَعِنْدَهُ سُلَيْمَانُ بْنُ حَبِيبٍ وَأَبُو قِلَابَةَ إِذْ دَخَلَ غُلَامٌ فَقَالَ أَرْضُنَا بِمَكَانِ كَذَا وَكَذَا بَاعَكُمْ الْوَصِيُّ وَنَحْنُ أَطْفَالٌ فَالْتَفَتَ إِلَى سُلَيْمَانَ بْنِ حَبِيبٍ فَقَالَ مَا تَقُولُ فَأَضْجَعَ فِي الْقَوْلِ فَالْتَفَتَ إِلَى أَبِي قِلَابَةَ فَقَالَ مَا تَقُولُ قَالَ رُدَّ عَلَى الْغُلَامِ أَرْضَهُ قَالَ إِذًا يَهْلِكُ مَالُنَا قَالَ أَنْتَ أَهْلَكْتَهُ. Has told us [Muhammad bin Al Mubarak] has told us [Yahya bin Hamzah] from [Ikrimah] from [a sheikh resident of Damsyiq] he said; I was once at Umar bin Abdul Aziz's side, at that time next to him were Sulaiman bin Habib and Abu Qilabah. At that time a young man came in and said; Our land in such and such a place was sold by the person who was given a will to you when we were still small. So (Umar) turned to Sulaiman bin Habib and asked; What would you say? He answered briefly, he turned towards [Abu Qilabah] and asked; What would you say? He answered; Return the land to this young man. (Sulaiman) said; Then our treasure is lost. He answered; You are the one who removed it. (Degree: authentic. Source: Sunan Ad-Darimi.) 8th Hadith. أَخْبَرَنَا إِبْرَاهِيمُ بْنُ مُوسَى عَنْ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ عَنْ أَشْعَثَ عَنْ الْحَسَنِ فِي رَجُلٍ أَوْصَى لِرَجُلٍ بِنِصْفِ مَالِهِ وَلِآخَرَ بِثُلُثِ مَالِهِ قَالَ يَضْرِبَانِ بِذَلِكَ فِي الثُّلُثِ هَذَا بِالنِّصْفِ وَهَذَا بِالثُّلُثِ. Has informed us [Ibrahim bin Musa] from [Muhammad bin Abdullah] from [Ash'ath] from [Al Hasan] about someone who willed half his wealth to someone and a third of his wealth to another person, he said; Their share was taken from one third of the property. For this person it is half and that person a third. (Degree: authentic. Source: Sunan Ad-Darimi.) 9th Hadith. حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ حَدَّثَنَا زَائِدَةُ عَنْ الشَّيْبَانِيِّ عَنْ الشَّعْبِيِّ قَالَ يُغَيِّرُ صَاحِبُ الْوَصِيَّةِ مِنْهَا مَا شَاءَ غَيْرَ الْعَتَاقَةِ. Has told us [Abu Al Walid Ath Thayalisi] has told us [Za`idah] from [Ash Syaibani] from [Ash Sya'bi] he said; The person who gives the will can change it as they wish, except for independence. (Degree: authentic. Source: Sunan Ad-Darimi.) 10th Hadith. حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ حَدَّثَنَا هَمَّامٌ حَدَّثَنَا قَتَادَةُ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي رَبِيعَةَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَالَ يُحْدِثُ الرَّجُلُ فِي وَصِيَّتِهِ مَا شَاءَ وَمِلَاكُ الْوَصِيَّةِ آخِرُهَا. Has told us [Abu Al Walid Ath Thayalisi] has told us [Hammam] has told us [Qatadah] from [Amr bin Syu'aib] from [Abdullah bin Abu Rabi'ah] that [Umar bin Al Khaththab] said; A person can do anything in their will. The basis of a will is what is left behind last. (Degree: authentic. Source: Sunan Ad-Darimi.) 11th Hadith. حَدَّثَنَا سَهْلُ بْنُ حَمَّادٍ حَدَّثَنَا هَمَّامٌ قَالَ حَدَّثَنِي قَتَادَةُ قَالَ حَدَّثَنِي عَمْرُو بْنُ دِينَارٍ أَنَّ أَبَاهُ أَعْتَقَ رَقِيقًا لَهُ فِي مَرَضِهِ ثُمَّ بَدَا لَهُ أَنْ يَرُدَّهُمْ وَيُعْتِقَ غَيْرَهُمْ قَالَ فَخَاصَمُونِي إِلَى عَبْدِ الْمَلِكِ بْنِ مَرْوَانَ فَأَجَازَ عِتْقَ الْآخِرِينَ وَأَبْطَلَ عِتْقَ الْأَوَّلِينَ. Has told us [Sahl bin Hammad] has told us [Hammam] he said; Having told me [Qatadah] he said; [Amr bin Dinar] told me that his father freed a slave he owned when he was sick. Then he wanted to cancel his freedom and free the other slaves. He said; They complained about me to [Abdul Malik bin Marwan], so he allowed the last independence and canceled the first independence. (Degree: authentic. Source: Sunan Ad-Darimi.) 12th Hadith. حَدَّثَنَا سَهْلُ بْنُ حَمَّادٍ حَدَّثَنَا هَمَّامٌ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي رَبِيعَةَ عَنْ الشَّرِيدِ بْنِ سُوَيْدٍ قَالَ قَالَ عُمَرُ يُحْدِثُ الرَّجُلُ فِي وَصِيَّتِهِ مَا شَاءَ وَمِلَاكُ الْوَصِيَّةِ آخِرُهَا قَالَ أَبُو مُحَمَّد هَمَّامٌ لَمْ يَسْمَعْ مِنْ عَمْرٍو وَبَيْنَهُمَا قَتَادَةُ. Has told us [Sahal bin Hammad] has told us [Hammam] from [Amr bin Syu'aib] from [Abdullah bin Abu Rabi'ah] from [Ash Sharid bin Suwaid] he said; [Umar] said; A person can do anything in their will. The will rest is the last one. Abu Muhammad said; Hammam did not hear from Amr and Qatadah was between the two. (Degree: authentic. Source: Sunan Ad-Darimi.) 13th Hadith. حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ قَالَ ابْنُ الْمُبَارَكِ حَدَّثَنَا عَنْ مَعْمَرٍ عَنْ الزُّهْرِيِّ فِي الرَّجُلِ يُوصِي بِوَصِيَّةٍ ثُمَّ يُوصِي بِأُخْرَى قَالَ هُمَا جَائِزَتَانِ فِي مَالِهِ. Has told us [Sa'id bin Al Mughirah], [Ibn Al Mubarak] said; Having told us from [Ma'mar] from [Az Zuhri] about someone who made a will and then made another will, he said; Both can be done on one's own property. (Degree: authentic. Source: Sunan Ad-Darimi.) 14th Hadith. حَدَّثَنَا سَعِيدٌ عَنْ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنْ قَتَادَةَ قَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ مِلَاكُ الْوَصِيَّةِ آخِرُهَا. Having told us [Sa'id] from [Ibn Al Mubarak] from [Ma'mar] from [Qatadah] he said; [Umar bin Al Khaththab] said; The basis of a will is what is left behind last. (Degree: authentic. Source: Sunan Ad-Darimi.) 15th Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُبَارَكِ حَدَّثَنَا الْوَلِيدُ عَنْ الْأَوْزَاعِيِّ عَنْ يَحْيَى قَالَ إِذَا اتَّهَمَ الْقَاضِي الْوَصِيَّ لَمْ يَعْزِلْهُ وَلَكِنْ يُوَكِّلُ مَعَهُ غَيْرَهُ وَهُوَ رَأْيُ الْأَوْزَاعِيِّ. Has told us [Muhammad bin Al Mubarak] has told us [Al Walid] from [Al Auza'i] from [Yahya] he said; If hakim accuses the person who was given the will then he is not released from his will but hakim assigns another person with him to handle the will. This is Al Auza'i's opinion. (Degree: authentic. Source: Sunan Ad-Darimi.) 16th Hadith. حَدَّثَنَا أَبُو الْوَلِيدِ حَدَّثَنَا شَرِيكٌ عَنْ الشَّيْبَانِيِّ عَنْ عَامِرٍ قَالَ يَجُوزُ بَيْعُ الْمَرِيضِ وَشِرَاؤُهُ وَنِكَاحُهُ وَلَا يَكُونُ مِنْ الثُّلُثِ. Has told us [Abu Al Walid] has told us [Sharik] from [Ash Syaibani] from [Amir] he said; Sick people may carry out buying and selling transactions and marry, but this is not included in the third. (Degree: authentic. Source: Sunan Ad-Darimi.) 17th Hadith. حَدَّثَنَا أَبُو الْوَلِيدِ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ مُطَرِّفٍ عَنْ الْحَارِثِ الْعُكْلِيِّ قَالَ مَا حَابَى بِهِ الْمَرِيضُ فِي مَرَضِهِ مِنْ بَيْعٍ أَوْ شِرَاءٍ فَهُوَ فِي ثُلُثِهِ قِيمَةُ عَدْلٍ. Has told us [Abu Al Walid] has told us [Abu 'Awanah] from [Mutharrif] from [Al Harits Al 'Ukli] he said; What a sick person brings in during his or her illness from sales or purchases is included in one-third of the rights based on a fair calculation. (Degree: authentic. Source: Sunan Ad-Darimi.) 18th Hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ عَنْ يَحْيَى هُوَ ابْنُ سَعِيدٍ قَالَ أَعْطَتْ امْرَأَةٌ مِنْ أَهْلِنَا وَهِيَ حَامِلٌ فَسُئِلَ الْقَاسِمُ فَقَالَ هُوَ مِنْ جَمِيعِ الْمَالِ قَالَ يَحْيَى وَنَحْنُ نَقُولُ إِذَا ضَرَبَهَا الْمَخَاضُ فَمَا أَعْطَتْ فَمِنْ الثُّلُثِ. Has told us [Abu An Nu'man] has told us [Hammad bin Zaid] from [Yahya] he is Ibn Sa'id, he said; A pregnant woman in our family gave her property, so this was asked to [Al Qasim] and he answered; Given from all assets. Yahya said; Meanwhile, our opinion is that if the pregnancy is past one period, she should not give but she should give from one third of her assets. (Degree: authentic. Source: Sunan Ad-Darimi.) 19th hadith. حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا أَبُو شِهَابٍ عَنْ عَمْرٍو عَنْ الْحَسَنِ فِي رَجُلٍ قَالَ لِغُلَامِهِ إِنْ دَخَلْتُ دَارَ فُلَانٍ فَغُلَامِي حُرٌّ ثُمَّ دَخَلَهَا وَهُوَ مَرِيضٌ قَالَ يُعْتَقُ مِنْ الثُّلُثِ وَإِنْ دَخَلَ فِي صِحَّتِهِ عُتِقَ مِنْ جَمِيعِ الْمَالِ. Has told us [Ahmad bin Abdullah] has told us [Abu Shihab] from [Amr] from [Al Hasan] about someone who said to his slave; If I enter Fulan's house then my slave will be free. Then he entered it when he was sick, he said; He is freed from one-third of the property, but if he enters the house when he is healthy, he is freed from all the property. (Degree: authentic. Source: Sunan Ad-Darimi.) 20th hadith. حَدَّثَنَا مَرْوَانُ بْنُ مُحَمَّدٍ حَدَّثَنَا يَحْيَى بْنُ حَمْزَةَ حَدَّثَنَا النُّعْمَانُ بْنُ الْمُنْذِرِ عَنْ مَكْحُولٍ قَالَ إِذَا كَانَ الْوَرَثَةُ مَحَاوِيجَ فَلَا أَرَى بَأْسًا أَنْ يُرَدَّ عَلَيْهِمْ مِنْ الثُّلُثِ قَالَ يَحْيَى فَذَكَرْتُ ذَلِكَ لِلْأَوْزَاعِيِّ فَأَعْجَبَهُ. Has told us [Marwan bin Muhammad] has told us [Yahya bin Hamzah] has told us [An Nu'man bin Al Mundzir] from [Makhul] he said; If the heirs are people in need then I think it's okay if a third of the property is returned to them. [Yahya] said; Then I mentioned this to [Al Auza'i] and he was surprised. (Degree: authentic. Source: Sunan Ad-Darimi.) 21st Hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا هُشَيْمٌ حَدَّثَنَا يُونُسُ عَنْ الْحَسَنِ ح و أَخْبَرَنَا مُغِيرَةُ عَنْ إِبْرَاهِيمَ قَالَا إِذَا شَهِدَ شَاهِدَانِ مِنْ الْوَرَثَةِ جَازَ عَلَى جَمِيعِهِمْ وَإِذَا شَهِدَ وَاحِدٌ فَفِي نَصِيبِهِ بِحِصَّتِهِ. Has told us [Abu An Nu'man] has told us [Husyaim] has told us [Yunus] from [Al Hasan], in another narration; And it has been reported to us [Mughirah] from [Ibrahim] both of them said; If there are two heirs testifying to the will then this may represent all of them and if only one person testifies then the count is according to his share. (Degree: authentic. Source: Sunan Ad-Darimi.) 22nd Hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا هُشَيْمٌ حَدَّثَنَا مُطَرِّفٌ أَنَّهُ سَمِعَ الشَّعْبِيَّ يَقُولُ إِذَا شَهِدَ رَجُلٌ مِنْ الْوَرَثَةِ فَفِي نَصِيبِهِ بِحِصَّتِهِ ثُمَّ قَالَ بَعْدَ ذَلِكَ فِي جَمِيعِ حِصَّتِهِ. Has told us [Abu An Nu'man] has told us [Husyaim] has told us [Mutharrif] that he once heard [Ash Sha'bi] say; If one of the heirs testifies, his share will be according to his calculations. Then after that he said; For everything according to its part. (Degree: authentic. Source: Sunan Ad-Darimi.) 23rd Hadith. حَدَّثَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ حَدَّثَنَا أَبُو شِهَابٍ عَبْدُ رَبِّهِ بْنُ نَافِعٍ عَنْ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ قَالَ إِذَا أَوْصَى الرَّجُلُ بِالثُّلُثِ وَالرُّبُعِ فَفِي الْعَيْنِ وَالدَّيْنِ وَإِذَا أَوْصَى بِخَمْسِينَ أَوْ سِتِّينَ إِلَى الْمِائَةِ فَفِي الْعَيْنِ حَتَّى يَبْلُغَ الثُّلُثَ. Has told us [Abu Al Walid Ath Thayalisi] has told us [Abu Shihab Abdu Rabbihi bin Nafi'] from [Al A'masy] from [Ibrahim] he said; If someone makes a will with a third or a quarter of their assets then it is taken from goods and debts, but if they make a will with fifty or sixty to one hundred then only from goods up to a third. Source: Sunan Ad-Darimi.) 24th Hadith. أَخْبَرَنَا مَرْوَانُ بْنُ مُحَمَّدٍ حَدَّثَنَا سُلَيْمَانُ بْنُ بِلَالٍ حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدٍ عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ قُسَيْطٍ قَالَ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ الْمَرْءُ أَحَقُّ بِثُلُثِ مَالِهِ يَضَعُهُ فِي أَيِّ مَالِهِ شَاءَ. Has told us [Marwan bin Muhammad] has told us [Sulaiman bin Bilal] has told us [Ja'far bin Muhammad] from [Yazid bin Abdullah bin Qusaith] he said; The Prophet sallallaahu 'alaihi wasallam said: "A person is more entitled to a third of his wealth wherever he places it." Namely, from whatever wealth he desires. (Degree: authentic. Source: Sunan Ad-Darimi.) 25th Hadith. حَدَّثَنَا عَبْدُ الصَّمَدِ بْنُ عَبْدِ الْوَارِثِ حَدَّثَنَا شُعْبَةُ حَدَّثَنَا أَبُو إِسْحَقَ عَنْ أَبِي حَبِيبَةَ قَالَ سَأَلْتُ أَبَا الدَّرْدَاءِ عَنْ رَجُلٍ جَعَلَ دَرَاهِمَ فِي سَبِيلِ اللَّهِ فَقَالَ أَبُو الدَّرْدَاءِ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَثَلُ الَّذِي يَتَصَدَّقُ عِنْدَ مَوْتِهِ أَوْ يُعْتِقُ كَالَّذِي يُهْدِي بَعْدَ مَا شَبِعَ. Has told us [Abdush Shamad bin Abdul Warits] has told us [Syu'bah] has told us [Abu Ishaq] from [Abu Habibah] he said; I asked Abu Ad Darda` about someone who gives away his dirhams (treasures) fi sabilillah, [Abu Ad Darda`] answered; The Prophet sallallaahu 'alaihi wasallam said: "The parable of a person who gives alms or frees a slave before his death is like a person who gives gifts after he is full." (Degree: authentic. Source: Sunan Ad-Darimi.) 26th Hadith. حَدَّثَنَا الْمُعَلَّى بْنُ أَسَدٍ حَدَّثَنَا وُهَيْبٌ عَنْ يُونُسَ عَنْ الْحَسَنِ فِي الرَّجُلِ يُوصِي بِأَشْيَاءَ وَفِيهَا الْعِتْقُ فَيُجَاوِزُ الثُّلُثَ قَالَ يُبْدَأُ بِالْعِتْقِ حَدَّثَنَا الْمُعَلَّى بْنُ أَسَدٍ قَالَ حَدَّثَنَا وُهَيْبٌ عَنْ أَيُّوبَ عَنْ مُحَمَّدٍ قَالَ بِالْحِصَصِ. Has told us [Al Mu'alla bin Asad] has told us [Wuhaib] from [Yunus] from [Al Hasan] about someone who willed something which contained the matter of freeing slaves in it and the will was more than a third of his wealth, he said; Independence takes precedence. Has told us [Al Mu'alla bin Asad] he said; Having related to us [Wuhaib] from [Ayyub] from [Muhammad] he said; Counting comes first. (Degree: authentic. Source: Sunan Ad-Darimi.) 27th Hadith. حَدَّثَنَا الْحَسَنُ بْنُ بِشْرٍ حَدَّثَنَا الْمُعَافَى عَنْ عُثْمَانَ بْنِ الْأَسْوَدِ عَنْ عَطَاءٍ قَالَ مَنْ أَوْصَى أَوْ أَعْتَقَ فَكَانَ فِي وَصِيَّتِهِ عَوْلٌ دَخَلَ الْعَوْلُ عَلَى أَهْلِ الْعَتَاقَةِ وَأَهْلِ الْوَصِيَّةِ قَالَ وَقَالَ عَطَاءٌ إِنَّ أَهْلَ الْمَدِينَةِ غَلَبُونَا يَبْدَءُونَ بِالْعَتَاقَةِ قَبْلُ. Has told us [Al Hasan bin Bisyr] has told us [Al Mu'afa] from [Uthman bin Al Aswad] from ['Atha`] he said; Whoever makes a will or frees a slave while there is an 'aul in his will, then the 'aul takes the share of the person who freed the slave and the person who made the will. He continued; ['Atha`] said; In fact, the people of Medina are at odds with us, they prioritize independence. (Degree: authentic. Source: Sunan Ad-Darimi.) 28th Hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ قَالَ قَالَ عَمْرُو بْنُ دِينَارٍ فِي الَّذِي يُوصِي بِعِتْقٍ وَغَيْرِهِ فَيَزِيدُ عَلَى الثُّلُثِ قَالَ بِالْحِصَصِ. Has told us [Abu An Nu'man] has told us [Hammad bin Zaid] he said; [Amr bin Dinar] said about people who made a will for the freedom of slaves and other things and then exceeded one third of the wealth, he said; Counting comes first. Has told us [Sulaiman bin Harb] has told us [Hammad bin Zaid] from [Katsir bin Syinzhir] from [Al Hasan] about someone who left a will exceeding one third of the property and included the emancipation of slaves, he said; Priority was given to the freedom of slaves. (Degree: authentic. Source: Sunan Ad-Darimi.) 30th Hadith. حَدَّثَنَا عُبَيْدُ اللَّهِ عَنْ إِسْرَائِيلَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ قَالَ يُبْدَأُ بِالْعَتَاقَةِ قَبْلَ الْوَصِيَّةِ. Having told us [Ubaidullah] from [Isra`il] from [Mansur] from [Ibrahim] he said; The freeing of slaves took precedence before the will. (Degree: authentic. Source: Sunan Ad-Darimi.) 31st Hadith. أَخْبَرَنَا الْمُعَلَّى بْنُ أَسَدٍ قَالَ حَدَّثَنَا وُهَيْبٌ عَنْ يُونُسَ عَنْ الْحَسَنِ فِي الرَّجُلِ يُوصِي لِبَنِي فُلَانٍ قَالَ غَنِيُّهُمْ وَفَقِيرُهُمْ وَذَكَرُهُمْ وَأُنْثَاهُمْ سَوَاءٌ. Has told us [Al Mu'alla bin Asad] he said; has told us [Wuhaib] from [Yunus] from [Al Hasan] about a man who made a will for someone else's child, he said, "Rich and poor, men and women they are all the same." Source: Sunan Ad-Darimi.) 32nd Hadith. حَدَّثَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ حَدَّثَنَا أَبُو شِهَابٍ عَنْ عَمْرٍو عَنْ الْحَسَنِ قَالَ إِذَا أَوْصَى لِبَنِي فُلَانٍ فَالذَّكَرُ وَالْأُنْثَى فِيهِ سَوَاءٌ. Has told us [Ahmad bin Abdullah] has told us [Abu Shihab] from [Amru] from [Al Hasan] he said, "If someone makes a will for another person's child then men and women are equal." (Degree: authentic. Source: Sunan Ad-Darimi.) 33rd Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زَائِدَةُ بْنُ مُوسَى الْهَمْدَانِيُّ حَدَّثَنِي سَيَّارُ بْنُ أَبِي كَرِبٍ أَنَّ آتِيًا أَتَى شُرَيْحًا فَسَأَلَهُ عَنْ رَجُلٍ أَوْصَى بِسَهْمٍ مِنْ مَالِهِ قَالَ تُحْسَبُ الْفَرِيضَةُ فَمَا بَلَغَ سِهَامَهَا أُعْطِيَ الْمُوصَى لَهُ سَهْمًا كَأَحَدِهَا. Has told us [Abu Nu'aim] has told us [Za`idah bin Musa Al Hamdani] has told me [Sayyar bin Abu Karb], that someone came to [Syuraih] and asked him about a man who bequeathed some of his wealth. Syuraih answered, "Calculating what is his obligation, if it exceeds the share of the will then the person who gets the will is given his share like the others." (Degree: authentic. Source: Sunan Ad-Darimi.) 34th Hadith. أَخْبَرَنَا مَرْوَانُ بْنُ مُحَمَّدٍ حَدَّثَنَا سَعِيدٌ عَنْ مَكْحُولٍ قَالَ إِذَا تَصَدَّقَ الرَّجُلُ عَلَى بَعْضِ وَرَثَتِهِ وَهُوَ صَحِيحٌ بِأَكْثَرَ مِنْ النِّصْفِ رُدَّ إِلَى الثُّلُثِ وَإِذَا أَعْطَى النِّصْفَ جَازَ لَهُ ذَلِكَ قَالَ سَعِيدٌ وَكَانَ قُضَاةُ أَهْلِ دِمَشْقَ يَقْضُونَ بِذَلِكَ. It has been reported to us that [Marwan bin Muhammad] has told us [Sa'id] from [Makhul] that he said, "If a man gives alms to some of his heirs - while he is still in good health - more than half of his wealth, then he must reduce it to only one third. And if he gives half of his wealth then it is permissible for him." Sa'id berkata, "Para hakim Damaskus memutuskan hukum seperti itu." (Degree: authentic. Source: Sunan Ad-Darimi.) 35th Hadith. حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ أَبِي شَيْبَةَ حَدَّثَنَا حَفْصٌ عَنْ إِسْمَعِيلَ بْنِ أَبِي خَالِدٍ عَنْ الْحَكَمِ عَنْ إِبْرَاهِيمَ قَالَ الْكَفَنُ مِنْ جَمِيعِ الْمَالِ. Has told us [Abdullah bin Muhammad bin Abu Syaibah] has told us [Hafsh] from [Isma'il bin Abu Khalid] from [Al Hakam] from [Ibrahim] he said, "The shroud was taken from all the wealth." Source: Sunan Ad-Darimi.) 36th Hadith. حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى عَنْ مُعَاذٍ عَنْ أَشْعَثَ عَنْ الْحَسَنِ فِي رَجُلٍ مَاتَ وَتَرَكَ قِيمَةَ أَلْفَيْ دِرْهَمٍ وَعَلَيْهِ مِثْلُهَا أَوْ أَكْثَرُ قَالَ يُكَفَّنُ مِنْهَا وَلَا يُعْطَى دَيْنُهُ. Has told us [Ibrahim bin Musa] from [Mu'adz] from [Ash'ath] from [Al Hasan] about a man who died and he left property worth two hundred dirhams and he also had debts of that amount or even more, he said, "The shroud must be taken from the property even though the debt is not paid off." (Degree: authentic. Source: Sunan Ad-Darimi.) 37th Hadith. حَدَّثَنَا قَبِيصَةُ حَدَّثَنَا سُفْيَانُ عَمَّنْ سَمِعَ إِبْرَاهِيمَ قَالَ يُبْدَأُ بِالْكَفَنِ ثُمَّ الدَّيْنِ ثُمَّ الْوَصِيَّةِ. It has been told to us [Qabishah] has told us [Sufyan] from [someone] who heard [Ibrahim] say, "What must come first is the shroud, then paying off the debt, then the will." (Degree: authentic. Source: Sunan Ad-Darimi.) 38th Hadith. حَدَّثَنَا قَبِيصَةُ أَخْبَرَنَا سُفْيَانُ عَنْ فِرَاسٍ عَنْ الشَّعْبِيِّ فِي الْمَرْأَةِ تَمُوتُ قَالَ تُكَفَّنُ مِنْ مَالِهَا لَيْسَ عَلَى الزَّوْجِ شَيْءٌ. Having told us [Qabishah] had told us [Sufyan] from [Firas] from [Ash Sha'bi] about a woman who died, he said, "She must be shrouded from her property, and her husband does not get anything." It has been told to us by [Sa'id bin Al Mughirah] from [Ibn Al Mubarak] from [Ibn Juraij] from ['Atha] he said, "Fragrances and shrouds are taken from the wealth." (Degree: authentic. Source: Sunan Ad-Darimi.) 40th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ إِسْمَعِيلَ عَنْ الْحَسَنِ قَالَ الْكَفَنُ مِنْ وَسَطِ الْمَالِ يُكَفَّنُ عَلَى قَدْرِ مَا كَانَ يَلْبَسُ فِي حَيَاتِهِ ثُمَّ يُخْرَجُ الدَّيْنُ ثُمَّ الثُّلُثُ. It has been told to us by [Muhammad bin Uyainah] from [Ali bin Mushir] from [Isma'il] from [Al Hasan] he said, "The shroud is taken from ordinary cloth, he is shrouded in just what he wore during his lifetime, then the assets are taken out to pay the debt and then a third for the will."
