About this work

كتاب "فقه النوازل" للمؤلف بكر أبو زيد هو عمل فقهي يعالج مسائل مستجدة وقضايا معاصرة، ويضم في طياته خمس رسائل مستقلة. تتناول الرسالة الأولى موضوع "التقنين والإلزام" ومناقشة إلزام القضاة بمذهب معين أو قانون مقنن، بينما تبحث الثانية في "المواضعة في الاصطلاح" وأثر تغيير المصطلحات الشرعية. أما الرسائل الثلاث الأخرى فتناقش نوازل عصرية مثل خطاب الضمان البنكي، وجهاز الإنعاش وعلامة الوفاة، وطرق الإنجاب الحديثة كطفل الأنابيب، وذلك في إطار دراسة الأحكام الشرعية لهذه الوقائع المستجدة.

Translation

The book “Jurisprudence of Calamities” by Bakr Abu Zaid is a jurisprudential work that addresses emerging issues and contemporary issues, and includes within it five independent treatises. The first thesis deals with the topic of “codification and binding” and discusses the obligation of judges to adhere to a specific doctrine or codified law, while the second examines “conformity in terminology” and the effect of changing legal terminology. The other three letters discuss modern calamities such as the bank guarantee letter, the life support device, the sign of death, and modern reproductive methods such as in vitro fertilization, within the framework of studying the legal rulings of these new facts.
