غياث الأمم في التياث الظلم» هو مؤلف للشيخ أبو المعالي الجويني يندرج تحت تصنيف السياسة الشرعية والقضاء، ويتناول فيه مسألة الإمامة كقضية شرعية وإدارية، مستعرضاً أركانها من وجوب نصب الأئمة إلى شروط اختيارهم وخصائصهم. يشرح الكتاب أوجه الإمامة من حيث النصوص والآراء الفقهية، ويعرض تفاصيل الصفات المطلوبة في القادة، إضافة إلى أحكام الخلع والانخلاع عند وقوع الفسوق أو فقد الحواس. يختتم المؤلف ببيان خلاصة الأحكام المتعلقة بإزالة الإمام الفاسق أو المعيق، مستنداً إلى استدلالات شرعية ومناقشات فقهية.

Translation

Ghayāt al-Umām fi Tayāt al-Zālm is a book by Sheikh Abu al-Ma’ali al-Juwayni that falls under the classification of Sharia politics and judiciary, in which it deals with the issue of the imamate as a legal and administrative issue, reviewing its pillars from the necessity of appointing imams to the conditions of their selection and characteristics. The book explains the aspects of imamate in terms of jurisprudential texts and opinions, and presents details of the qualities required in leaders, in addition to the rulings on khula and khula when immorality occurs or loss of the senses. The author concludes by stating a summary of the rulings related to the removal of an immoral or obstructive imam, based on legal inferences and jurisprudential discussions.
