معين الحكام فيما يتردد بين الخصمين من الأحكام للطرابلسي هو مؤلف يختص بالسياسة الشرعية والقضاء، يبيّن حقيقة القضاء ومعناه وحكمته وفضله في تحقيق العدل، ويستعرض أدوار ومهام القضاة والنواب والحسبة والتحكيم والسعاة والجباية والوظائف الجزئية المرتبطة بالقضاء. كما يتناول أركان القضاء من أوصاف وشروط صحة ولاية القاضي إلى ما يلزم في سيرته ومجلسه ومسكنه، مستنداً إلى الأدلة الشرعية التي تُظهر مكانة القضاء كمنصب نبوي عليٍ يرفع من شأن العدالة ويقضي بالمصالح ويمنع المفاسد.
Translation
Mu'in al-Hikam, regarding the Rulings between the Opponents, by Al-Tarabulsi, is a book concerned with legal politics and the judiciary. It explains the reality of the judiciary, its meaning, its wisdom, and its virtue in achieving justice, and reviews the roles and tasks of judges, representatives, hisbah, arbitration, messengers, collection, and partial functions related to the judiciary. It also addresses the pillars of the judiciary, from the descriptions and conditions for the validity of a judge’s mandate to what is necessary in his biography, seat, and residence, based on legal evidence that shows the status of the judiciary as a prophetic position that raises the status of justice, determines interests, and prevents corruption.
