يُعتبر نظام الإثبات في الفقه الإسلامي أحد الجوانب الهامة في السياسة الشرعية والقضاء، حيث يُعنى بدراسة وتحليل أسس الإثبات في الفقه الإسلامي. يُشير الكتاب إلى أهمية القضاء في الإسلام، حيث يُعتبر ركنًا أساسيًا في الحفاظ على النظام الاجتماعي، ويُظهر كيفية تعامل الشريعة الإسلامية مع القضاء منذ البداية. يُغطي الكتاب مواضيع متعددة مثل الإقرار والشهادة والأصل في الشهادة وحكمها، بالإضافة إلى مقارنة بين الفقه والقانون في موضوع الشهادة، ويمين القسامة وعلم القاضي والحكم بالفراسة والقرائن. يُظهر الكتاب أهمية نظام الإثبات في الفقه الإسلامي في الحفاظ على العدل والحقوق في المجتمع الإسلامي.
Translation
The system of proof in Islamic jurisprudence is considered one of the important aspects of Sharia policy and judiciary, as it is concerned with studying and analyzing the foundations of proof in Islamic jurisprudence. The book points out the importance of the judiciary in Islam, as it is considered a fundamental pillar in maintaining social order, and shows how Islamic law has dealt with the judiciary from the beginning. The book covers multiple topics such as acknowledgment, testimony, the origin of testimony and its ruling, in addition to a comparison between jurisprudence and law on the subject of testimony, the oath of oath, the knowledge of the judge, and judgment based on physiognomy and evidence. The book shows the importance of the proof system in Islamic jurisprudence in maintaining justice and rights in Islamic society.
