كتاب "تاريخ قضاة الأندلس المرقبة العليا فيمن" للنباهي يندرج ضمن تصنيف التراجم والطبقات، حيث يطرح مفهوم القضاة والفتاة في الإسلام ويستعرض الخصائص التي تستحق القضاء والفتوى. يشتمل على بابين رئيسيين؛ الأول يناقش أصول القضاء ومقاصده، والثاني يروي سيرة مجموعة من القضاة الأندلسيين مع إشارة إلى بعض الأحاديث والآراء الفقهية المتعلقة بهم. يهدف المؤلف إلى توضيح معايير الاختيار والاقتداء بالقاضي الصالح وتبيين حدود الفتوى في الشريعة.
Translation
The book “The History of the Judges of Andalusia, Al-Marqaba Al-Ulaiya Fimen” by Al-Nabahi falls within the classification of biographies and classes, as it presents the concept of judges and girls in Islam and reviews the characteristics that deserve a judge and a fatwa. It includes two main doors; The first discusses the principles and purposes of the judiciary, and the second narrates the biography of a group of Andalusian judges with reference to some hadiths and jurisprudential opinions related to them. The author aims to clarify the criteria for selection, following the example of a righteous judge, and clarifying the limits of fatwa in Sharia law.
