Welcome to the study of authentic hadith selected by ULYAH. Let's look at some of the following sayings of the Prophet sallallaahu 'alaihi wa sallam, one by one, with an open heart to put them into practice. 1st Hadith. may Allah bless him and give him peace of mind God bless you God willing God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing الْقِصَاصُ إِلاَّ أَمَرَ فِيهِ بِالْعَفْوِ .. Has told us [Ishaq bin Manshur], has told us [Habban bin Hilal], has told us [Abdullah bin Bukair Al Muzanni] from ['Atha`bin Abu Maimunah] said; I don't know it except from [Anas bin Malik's] line, he said; "There was never a case brought to the Messenger of Allah in which there was a question of qishash unless he ordered forgiveness (Degree: authentic. Source: Sunan Ibnu Majah no. 2692.) 2nd hadith. God bless you يُونُسَ بْنِ أَبِي إِسْحَاقَ، عَنْ أَبِي السَّفَرِ، قَالَ قَالَ أَبُو الدَّرْدَاءِ سَمِعْتُ or God bless you God willing, God willing, God willing, God willing دَرَجَةً أَوْ حَطَّ عَنْهُ بِهِ خَطِيئَةً " ." أُذُنَاىَ وَوَعَاهُ قَلْبِي .. Has told us [Ali bin Muhammad], has told us [Waki'] from [Yunus bin Abu Ishaq] from [Abu Safar] said; [Abu Darda`] said; I heard the Messenger of Allah (peace and blessings of Allaah be upon him) say: "There is no man who has something struck on his body and then leaves to do his qishas unless Allah will raise his rank or have his mistakes removed from him." I heard it with both my ears and my heart can understand it (Degree: authentic. Source: Sunan Ibnu Majah no. 2693.) 3rd Hadith. God bless you God willing نُسَىٍّ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ، حَدَّثَنَا may Allah bless him and give him peace God bless you رَسُولَ اللَّهْ قَتَلَتْ عَمْدًا لاَ تُقْتَلُ حَتَّى تَضَعَ مَا فِي بَطْنِهَا God bless you God bless you تُكَفِّلَ وَلَدَهَا " .. Has told us [Muhammad bin Yahya], has told us [Abu Salih] from [Ibn Lahi'ah] from [Ibn `An'um] from [Ubadah bin Nusai] from [Abdurrahman bin Ghanam], has told us [Mu'adh bin Jabal], [Abu 'Ubaidah bin Al-Jarrah], ['Ubadah bin As-Shamit] and [Syaddad bin Aus]; In fact, Rasulullah shallallahu 'alaihi wasallam said: "If a woman kills intentionally, then do not kill her until she gives birth to the child in her stomach, if she is pregnant and until she is able to care for the child. And if she commits adultery, do not stone her until she gives birth to the child in her stomach and until she is able to care for the child (Degree: authentic. Source: Sunan Ibnu Majah no. 2694.) 4th Hadith. God bless you God bless you may Allah bless him and give him peace and blessings حَدَّثَنَا أَبُو مُعَاوِيَةَ، - قَالَ أَبُو بَكْرٍ وَعَبْدُ God knows what God is saying love may Allah bless him and give him peace and blessings بَعِيرًا وَلاَ أَوْصَى بِشَىْءٍ .. Has told us [Muhammad bin Abdullah bin Numair], has told us [my father] and [Abu Mu'awiyah], (as also narrated from another route), has told us [Abu Bakr bin Abu Syaibah] and [Ali bin Muhammad], both of them said; has told us [Abu Mu'awiyah]; Abu Bakr and Abdullah bin Numair from [Al `A'masy] from [Syaqiq] from [Masruq] from [Aisyah], he said; "The Messenger of Allah sallallaahu 'alaihi wasallam did not leave a dinar or a dirham, nor a goat or a camel. Nor did he leave a will with anything at all (Degree: authentic. Source: Sunan Ibnu Majah no. 2695.) 5th Hadith. God bless you God willing, God willing, God willing, God willing God bless you God willing, God willing, God willing, God willing حَضَرَتْهُ الْوَفَاةُ وَهُوَ يُغَرْغِرُ بِنَفْسِهِ " الصَّلاَةَ وَمَا مَلَكَتْ أَيْمَانُكُمْ " .. Has told us [Ahmad bin Miqdam], has told us [Al Mu'tamir bin Sulaiman]; I heard [my father] tell from [Qatadah] from [Anas bin Malik], he said; "The general will of the Prophet sallallaahu 'alaihi wasallam before his death, when he died, was: "Take care of your prayers and zakat and pay attention to your servants (Degree: authentic. Source: Sunan Ibnu Majah no. 2697.) 6th Hadith. may Allah bless him and give him peace of mind God bless you God willing, God willing, God willing, God willing, God willing God willing " .. Has told us [Sahal bin Abu Sahal], has told us [Muhammad bin Fudhail] from [Mughirah] from [Ummu Musa] from [Ali bin Abu Talib] said; "The final words of the Prophet sallallaahu 'alaihi wasallam were: "Take care of prayer and zakat and pay attention to your servants (Degree: authentic. Source: Sunan Ibnu Majah no. 2698.) 7th Hadith. God bless you may Allah bless him and give him peace and blessings نَافِعٍ، عَنِ ابْنْ God willing لَيْلَتَيْنِ وَلَهُ شَىْءٌ يُوصِي فِيهِ إِلاَّ وَوَصِيَّتُهُ مَكْتُوبَةٌ عِنْدَهُ " .. Has told us [Ali bin Muhammad], has told us [Abdullah bin Numair] from [Ubaidullah bin Umar] from [Nafi'] from [Ibn Umar], he said; Rasulullah shallallahu 'alaihi wasallam said: "There is no right for a muslim who stays overnight for two nights and he has something bequeathed, unless his will is written beside him (Degree: authentic. Source: Sunan Ibnu Majah no. 2699.) 8th Hadith. حَدَّثَنَا نَصْرُ بْنُ عَم God willing, God willing, God willing, God willing. God willing, God willing, God willing, God willing, God willing. وسلم " الْمَحْرُومُ مَنْ حُرِمَ وَصِيَّتَهُ " .. Has told us [Nashr bin Ali Al Jahdhami], has told us [Durustu bin Ziyad], has told us [Yazid Ar Raqasyi] from [Anas Bin Malik], he said; Rasulullah shallallahu 'alaihi wasallam said: "The person who has bad luck is the person who is prevented from making a will (Degree: authentic. Source: Sunan Ibnu Majah no. 2700.) 9th Hadith. may Allah bless him and give him peace of mind God bless you God willing God willing مَنْ مَاتَ عَلَى وَصِيَّةٍ مَاتَ عَلَى سَبِيلٍ وَسُنَّةٍ "" .. Has told us [Muhammad bin Mushaffa Al Himshi], has told us [Baqiyyah bin Al Walid] from [Yazid bin 'Auf] from [Abu Zubair] from [Jabir bin Abdullah], he said; said the Messenger of Allah sallallaahu 'alaihi wasallam: "Whoever dies while having a will then he dies on the right path and sunnah, he dies on piety and shahada, and he dies in a state of forgiveness (Degree: authentic. Source: Sunan Ibnu Majah no. 2701.) 10th Hadith. God bless you God willing God willing لَيْلَتَيْنِ وَلَهُ شَىْءٌ يُوصِي بِهِ إِلاَّ وَوَصِيَّتُهُ مَكْتُوبَةٌ عِنْدَهُ " .. Has told us [Muhammad bin Ma'mar], has told us [Rauh bin 'Auf] from [Nafi'] from [Ibn Umar] from the Prophet sallallaahu 'alaihi wasallam, he said: "There is no right of a muslim who stays for two nights and he has something bequeathed, unless his will is written on his side (Degree: authentic. Source: Sunan Ibnu Majah no. 2702.) 11th Hadith. Allah's blessings God willing, God willing, God willing, God willing. God bless you " مَنْ فَرَّ مِنْ مِيرَاثِ وَارِثِهِ قَطَعَ اللَّهُ مِيرَاثَهُ مِنَ الْجَنَّةِ يَوْمَ الْقِيَامَةِ " .. Has told us [Suwaid bin Sa'id], has told us [Abdurrahim bin Zaid Al 'Ammi] from [his father] from [Anas bin Malik], he said; Rasulullah shallallahu 'alaihi wasallam said: "Whoever runs away with his heir's inheritance, Allah will cut off his inheritance from heaven on the Day of Resurrection (Degree: authentic. Source: Sunan Ibnu Majah no. 2703.) 12th Hadith. Allah's blessings God willing God willing, God willing, God willing, God willing God bless you وسلم " إِنَّ الرَّجُلَ لَيَعْمَلُ بِعَمَلِ أَهْلِ الْخَيْرِ God willing God bless you الرَّجُلَ لَيَعْمَلَ God bless you God bless you " وَاقْرَءُوا إِنْ شِئْتُمْ {تِلْكَ حُدُودُ اللَّهِ} إِلَى قَوْلِهِ {عَذَابٌ مُهِينٌ}. Has told us [Ahmad bin Azhar], has told us [Abdurrazak bin Hammam], has told us [Ma'mar] from [`Ash'ath bin Abdullah] from [Syahr bin Hausyab] from [Abu Hurairah], he said; Rasulullah shallallahu 'alaihi wasallam said: "Indeed, a man does good deeds with the deeds of ahlul khair (good) for seventy years, then if he makes a will and he acts unjustly in his will, then he ends with his bad deeds so he goes to hell. And verily, a man does good deeds with the deeds of bad deeds for seventy years then he acts justly in his will, then he ends with good deeds so he goes to heaven." Abu Hurairah Said; Read if you wish: "These are the provisions of Allah until His word is a despicable punishment." An Nisa: (Degree: authentic. Source: Sunan Ibnu Majah no. 2704.) 13th Hadith. God willing عُثْمَانَ بْنِ سَعِيدِ بْنِ كَثِيرِ God willing God willing God bless you God willing وَكَانَتْ وَصِيَّتُهُ عَلَى كِتَابِ اللَّهِ كَانَتْ كَفَّارَةً لِمَا تَرَكَ مِنْ زَكَاتِهِ فِي حَيَاتِهِ " .. Has told us [Yahya bin Uthman bin Sa'id bin Katsir bin Dinar Al Himshi], has told us [Baqiyyah] from [Abu Halbas] from [Khulaid bin Abu Khulaid] from [Mu'awiyah bin Qurrah], from [his father], he said; Rasulullah shallallahu 'alaihi wasallam said: "Whoever, when he is on the verge of death, makes a will with a will that is confirmed by the Book of Allah, then his will will become a disbursement for what he left behind from his zakat during his lifetime (Degree: authentic. Source: Sunan Ibnu Majah no. 2705.) 14th Hadith. God willing God willing God bless you God willing, God willing, God willing, God willing, God willing رَسُولَ اللَّهْ God bless you أُمُّكَ " ." . قَالَ ثُمَّ مَنْ قَالَ " ثُمَّ أُمُّكَ " . قَالَ ثُمَّ مَنْ قَالَ " ثُمَّ أَبُوكَ " . قَالَ نَبِّئْنِي يَا رَسُولَ اللَّهِ عَنْ مَالِي كَيْفَ أَتَصَدَّقُ فِيهِ قَالَ "" may Allah bless him and give him peace of mind God willing لِفُلاَنٍ وَمَالِي لِفُلاَنٍ وَهُوَ لَهُمْ وَإِنْ كَرِهْتَ " .. Has told us [Abu Bakr bin Abu Syaibah], has told us [Sharik] from [Umarah bin Qa'qa bin Shubrumah] from [Abu Zur'ah] from [Abu Hurairah], he said; "Someone came to the Prophet sallallaahu 'alaihi wasallam and said; 'O Messenger of Allah! Tell me, who is the person I have the most right to accompany?" He replied: "Okay, by Allah I will tell you, (she is) your mother. " The person said; "Then who?" He answered, "Your mother." The person said; "Then who?" He answered, "Your mother. " The person said again, "Then who?" Rasulullah shallallahu 'alaihi wasallam answered, "Then your father." The person said again, "O Messenger of Allah, tell me how I should give my wealth in charity." He said: "Okay, by Allah, I will tell you, you should give charity when you are healthy and stingy, hope for the good of the worldly life and fear poverty, and do not delay it until your breath reaches here, and you will say, "Indeed, my wealth is for so and so, my wealth is for so and so, even though it must be theirs even if you don't like it (Degree: authentic. Source: Sunan Ibnu Majah no. 2706.) 15th Hadith. God willing يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا حَرِيزُ بْنُ عُثْمَانَ، God willing God willing God bless you may Allah bless him and give him peace وَجَلَّ أَنَّى تُعْجِزُنِي ابْنَ آدَمَ وَقَدْ خَلَقْتُكَ مِنْ مِثْلِ هَذِهِ فَإِذَا بَلَغَتْ نَفْسُكَ هَذِهِ - وَأَشَارَ إِلَى حَلْقِهِ - قُلْتَ أَتَصَدَّقُ وَأَنَّى أَوَانُ الصَّدَقَةِ " .. It has told us [Abu Bakr bin Abu Syaibah], it has told us [Yazid bin Harun], it has told us [Hariz bin Uthman], it has told me [Abdurrahman bin Maisarah] from [Jubair bin Nufair] from [Busr bin Jahasy Al Qurasyi], he said; Rasulullah shallallahu 'alaihi wasallam spat in the palm of his hand then he straightened his index finger and said; "Allah subhanahu wata'ala said: 'How can you deceive me, O son of Adam! Even though I have created you from something like this. When your life has reached here - he gestured to his throat - you said; 'I will give charity! "Then is there still time to give charity? (Degree: authentic. Source: Sunan Ibnu Majah no. 2707.) 16th Hadith. God bless you God willing God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing, God willing حَتَّى أَشْفَيْتُ عَم may Allah bless him and give him peace and blessings مَالاً كَثِيرًا وَلَيْسَ يَرِثُنِي إِلاَّ ابْنَتِي أَفَأَتَصَدَّقُ بِثُلُثَىْ مَالِي قَالَ " لاَ " . قُلْتُ فَالشَّطْرُ قَالَ " لاَ " . قُلْتُ فَالثُّلُثُ قَالَ " الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ أَنْ تَتْرُكَ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَتْرُكَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ " .. It has been told to us [Hisyam bin Ammar] and [Husain bin Hasan Al Marwazi] and [Sahal], all of them said; has told us [Sufyan bin Uyainah] from [Az Zuhri] from [Amir bin Sa'd] from [his father], he said; "At the time of the conquest of the city of Makkah, I was suffering from illness, until I almost died, then Rasulullah shallallahu 'alaihi wasallam visited me. I said to him, O Rasulullah shallallahu 'alaihi wasallam! Indeed, I have a lot of wealth and no one will inherit me, except my daughter. Do I give charity with two-thirds of my wealth? Rasulullah answered: 'No.' I asked; "Half?" Rasulullah sallallaahu 'alaihi wasallam said: "No. " I asked again, "A third?" Rasulullah replied, "(Perhaps) a third, a third is a lot. You leaving your heirs rich is better than leaving them poor and begging from people (Degree: authentic. Source: Sunan Ibnu Majah no. 2708.) 17th Hadith. God bless you God willing, God willing, God willing, God willing قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِنَّ اللَّهَ تَصَدَّقَ عَلَيْكُمْ or أَمْوَالِكُمْ زِيَادَةً لَكُمْ فِي أَعْمَالِكُمْ " .. Has told us [Ali bin Muhammad], has told us [Waki'] from [Thalhah bin Amru] from ['Atha`] from [Abu Hurairah], he said; Rasulullah shallallahu 'alaihi wasallam said: "Indeed, Allah gave you charity when you died with a third of your wealth in addition to your deeds (Degree: authentic. Source: Sunan Ibnu Majah no. 2709.) 18th Hadith. God willing may Allah bless him and give him peace and blessings God bless you عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم "" Allah's blessings God willing God bless you بَعْدَ انْقِضَاءِ أَجَلِكَ " .. Has told us [Salih bin Muhammad bin Yahya bin Sa'id Al Qaththan]; has told us ['Ubaidullah bin Musa]; has reported to us [Mubarak bin Hassan] from [Nafi'] from [Ibn 'Umar] he said; Rasulullah shallallahu 'alaihi wasallam said: "O son of Adam, two things, one of which will not be yours, I have made part of your property for you when I took it in your anger so that I purify you and cleanse you and My servants pray to you after your death comes (Degree: authentic. Source: Sunan Ibnu Majah no. 2710.) 19th hadith. God bless you هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنِ ابْنِ عَبَّاسٍ، God bless you God willing الثُّلُثُ كَبِيرٌ - أَوْ كَثِيرٌ - " .. Has told us ['Ali bin Muhamad]; has told us [Waki'] from [Hisyam bin 'Urwah] from [His father] from [Ibn Abbas], he said; "I want people to reduce from a third to a quarter because Rasulullah shallallahu 'alaihi wasallam said: 'A third is a big -or a lot (Degree: authentic. Source: Sunan Ibnu Majah no. 2711.) 20th hadith. God willing يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا سَعِيدُ بْنُ أَبِي God willing God willing, God willing, God willing, God willing. God willing, God willing, God willing, God willing, God willing, God willing Allah's blessings وَإِنَّ لُغَامَهَا لَيَسِيلُ بَيْنَ كَتِفَىَّ قَالَ " إِنَّ اللَّهَ قَسَمَ لِكُلِِ فَلاَ يَجُوزُ لِوَارِثٍ وَصِيَّةٌ الْوَلَدُ لِلْفِرَاشِ God willing God willing love صَرْفٌ وَلاَ عَدْلٌ " ." " .. Has told us [Abu Bakr bin Abu Syaibah]; has told us [Yazid bin Harun]; has reported to us [Sa'id bin Abu 'Arubah] from [Qatadah] from [Syahr bin Hausyab] from [Abdurrahman bin Ghanam] from ['Amru bin Kharijah], indeed the Prophet sallallaahu 'alaihi wasallam was addressing the people, and he was in his vehicle. And at that time the vehicle (which was a camel) was chewing food, while saliva flowed down between my shoulders. Rasulullah sallallaahu 'alaihi wasallam said: "Indeed, Allah Subhanahu Wa Ta'ala has divided the inheritance in each part between the heirs. An heir may not receive the inheritance. Children are the right of the owner of the bed (husband), while for adulterers it is a stone's throw (stoning punishment), whoever attributes his offspring to someone else or a slave to someone other than his master, then the curse of Allah Subhanahu Wa Ta'ala, the angels and all humans, Allah Subhanahu Wa Ta'ala does not accept repentance and ransom." Or Rasulullah shallallahu 'alaihi wasallam said: 'Ransom or repentance (Degree: authentic. Source: Sunan Ibnu Majah no. 2712.) 21st Hadith. God willing God bless you الْخَوْلاَنِيُّ، سَمِعْتُ or يَقُولُ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ فِي God bless you God willing .. Has told us [Hisyam bin 'Ammar]; has told us [Isma'il bin 'Ayyasy]; has told us [Syurahbil bin Muslim Al Khaulani], I heard [Abu Umamah Al Bahili], he said; "I heard Rasulullah shallallahu 'alaihi wasallam say during the Hajj Wada sermon: 'Indeed, Allah Subhanahu Wa Ta'ala has given each person his or her rights, so there is no inheritance for heirs (Degree: authentic. Source: Sunan Ibnu Majah no. 2713.) 22nd Hadith. God bless you God willing God willing حَدَّثَهُ عَنْ أَنَسِ بْنِ مَالِكٍ، قَْتَ نَاقَةِ رَسُولِ اللَّهِ صلى الله عليه وسلم يَسِيلُ عَلَىَّ لُعَابُهَا فَسَمِعْتُهُ يَقُولُ " إِنَّ اللَّهَ قَدْ may Allah bless him and give him peace of mind " .. Has told us [Hisyam bin 'Ammar]; has told us [Muhammad bin Syu'aib bin Syabur]; has told us [Abdurrahman bin Yazid bin Jabir] from [Sa'id bin Abu Sa'id] that he told us from [Anas bin Malik], he said; "In fact, I was under the camel of Rasulullah shallallahu 'alaihi wasallam where its saliva flowed on me. I heard Rasulullah shallallahu 'alaihi wasallam say: 'Indeed Allah Subhanahu Wa Ta'ala has given each person his rights, remember there is no inheritance for heirs (Degree: authentic. Source: Sunan Ibnu Majah no. 2714.) 23rd Hadith. God bless you God bless you God willing, God willing, God willing, God willing, God willing Allah's blessings {مِنْ بَعْدِ وَصِيَّةٍ يُوصِي بِهَا أَوْ دَيْنٍ } وَإِنَّ God willing, God willing, God willing, God willing الْعَلاَّتِ .. Has told us ['Ali bin Muhammad]; has told us [Waki']; has told us [Sufyan] from [Ibn Ishaq] from [Al Harith] from ['Ali] said; "The Messenger of Allah sallallaahu 'alaihi wasallam has established the law to pay off debts before giving inheritance. You can read the verse of the Qur'an which reads: after fulfilling the will he made or (and) after paying the debts.' (An Nisaa: 11) And indeed it is siblings (from one father and one mother) who inherit, and not siblings from many mothers (Degree: authentic. Source: Sunan Ibnu Majah no. 2715.) 24th Hadith. God willing God willing, God willing, God willing, God willing, God willing, God willing. مَالاً وَلَمْ يُوصِ فَهَلْ يُكَفِّرُ عَنْهُ أَنْ تَصَدَّقْْ عَنْهُ قَالَ " نَعَمْ " .. Has told us [Abu Marwan Muhammad bin 'Utsman Al Utsmani]; has told us [Abdul Aziz bin Abu Hazim] from [Al A'la bin Abdurrahman] from [his father] from [Abu Hurairah], he said; "Indeed, a man asked Rasulullah shallallahu 'alaihi wasallam, he said; 'Indeed, my father has died and left a number of assets, while he did not make a will, can his assets become kifarat if I give them in charity? Rasulullah shallallahu 'alaihi wasallam answered: 'Yes (Degree: authentic. Source: Sunan Ibnu Majah no. 2716.) 25th Hadith. may Allah bless him and give him peace of mind God willing عَائِشَةَ، أَنَِ فَقَالَ إِنَّ أُمِّي افْتُلِتَتْ نَفْسُهَا وَم وَإِنِّي أَظُنُّهَا لَوْ تَكَلَّمَتْ لَتَصَدَّقَتْ فَلَهَا أَجْرٌ إِنْ تَصَدَّقْتُ عَنْهَا وَلِيَ أَجْرٌ فَقَالَ " نَعَمْ " .. Has told us [Ishaq bin Mansur]; has told us [Abu Usamah] from [Hisyam bin 'Urwah] from [his father] from ['Aisha], he said; "Indeed, a man came to the Prophet Muhammad sallallaahu 'alaihi wasallam, he said; 'Indeed, my mother died suddenly and she did not give a will. I predict that if she can speak, then she will definitely give alms, will my mother and I get a reward if I give away her wealth? ' Rasulullah sallallaahu 'alaihi wasallam answered: 'Yes (Degree: authentic. Source: Sunan Ibnu Majah no. 2717.) 26th Hadith. God willing God willing God bless you God willing, God willing, God willing, God willing, God willing, God willing, God willing. وَلَيْسَ لِي مَالٌ وَلِي يَتِيمٌ لَهُ مَالٌ قَالَ " كُلْ مِنْ "" . قَالَ وَأَحْسِبُهُ قَالَ " وَلاَ تَقِي مَالَكَ بِمَالِهِ " .. Has told us [Ahmad bin Al Azhar]; has told us [Rauh bin 'Ubadah]; has told us [Husain Al Mu'allim] from [Amru bin Syu'aib] from [his father] from [his grandfather], he said; "Someone came to the Prophet sallallaahu 'alaihi wasallam and said; 'I have nothing, I have no property, but I have an orphan and he has property.' Rasulullah shallallahu 'alaihi wasallam said: 'Eat from some of your orphans' wealth without overdoing it or controlling it.' 27th Hadith. may Allah bless him and give him peace of mind God willing God willing " يَا أَبَا هُرَيْرَةَ تَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا love شَىْءٍ يُنْتَزَعُ مِنْ أُمَّتِي " .. God bless you God willing, God willing, God willing, God willing مُحَمَّدِ بْنِ عَقِيلٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ جَاءَتِ امْرَأَةُ سَعْدِ بْنِ الرَّبِيعِ بِابْنَتَىْ may Allah bless him and give him peace and blessings رَسُولَ اللَّهْ أُحُدٍ وَإِنَّ عَمَّهُمَا أَخَذَ جَمِيعَ مَا تَرَكَ أَبُوهُمَا وَإِنَّ الْمَرْأَةَ لاَ تُنْكَحُ إِلاَّ عَلَى مَالِهَا . فَسَكَتَ رَسُولُ اللَّهِ صلى الله عليه وسلم حَتَّى أُنْزِلَتْ God willing, God willing, God willing, God willing, God willing. God willing سَعْدٍ ثُلُثَىْ مَالِهِ وَأَعْطِ امْرَأَتَهُ الثُّمُنَ وَخُذْ أَنْتَ مَا بَقِيَ " .. Has told us [Muhammad bin Abu Umar Al 'Adani]; has told us [Sufyan bin 'Uyainah] from [Abdullah bin Muhammad bin 'Aqil] from [Jabir bin Abdullah], he said; "The wife of Sa'd bin Rabi' came to the Prophet sallallaahu 'alaihi wasallam with her two daughters, then said: 'O Rasulullah! These are the two daughters of Sa'd. She was killed during the battle of Uhud with you. In fact her uncle had taken all their father's inheritance. In fact, a married woman must have wealth. The Messenger of Allah was silent until the verse about inheritance was revealed. Then Rasulullah shallallahu 'alaihi wasallam called Sa'd bin's brother. Rabi', then said; 'Give two-thirds of Sa'd's wealth to his two daughters, one-eighth to his wife and the rest to you (Degree: authentic. Source: Sunan Ibnu Majah no. 2720.) Hadits ke-29. حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا سُفْيَانُ، عَنْ أَبِي قَيْسٍ الأَوْدِيِّ، عَنِ الْهُزَيْلِ بْنِ شُرَحْبِيلَ، قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى الأَشْعَرِيِّ وَسَلْمَانَ بْنِ رَبِيعَةَ الْبَاهِلِيِّ فَسَأَلَهُمَا عَنِ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ، لأَبٍ وَأُمٍّ فَقَالاَ لِلاِبْنَةِ النِّصْفُ وَمَا بَقِيَ فَلِلأُخْتِ وَائْتِ ابْنَ مَسْعُودٍ فَسَيُتَابِعُنَا . فَأَتَى الرَّجُلُ ابْنَ مَسْعُودٍ فَسَأَلَهُ وَأَخْبَرَهُ بِمَا قَالاَ فَقَالَ عَبْدُ اللَّهِ قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنِّي سَأَقْضِي بِمَا قَضَى بِهِ رَسُولُ اللَّهِ صلى الله عليه وسلم لِلاِبْنَةِ النِّصْفُ وَلاِبْنَةِ الاِبْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلأُخْتِ .. Telah menceritakan kepada kami ['Ali bin Muhammad]; telah menceritakan kepada kami [Waki']; telah menceritakan kepada kami [Sufyan] dari [Abu Qais Al Audi] dari [Al Huzail bin Syurahbil], ia berkata; "Seorang laki-laki datang menemui Abu Musa AI Asy'ari dan Salman bin Rabi'ah Al Bahili lalu ia bertanya pada keduanya mengenai harta warisan untuk seorang anak perempuan, cucu perempuan dan saudara perempuan sekandung?" Keduanya menjawab; 'Anak perempuan mendapat setengah dan sisanya untuk saudara perempuan si mayit. Temuilah Ibnu Mas'ud, maka ia pasti mengikuti fatwa kita.' Laki-laki tadi datang menemui [Ibnu Mas'ud] lalu bertanya dan memberitahukan apa yang dikatakan oleh kedua orang tersebut. Abdullah berkata; 'Aku telah sesat jika demikian, aku bukan termasuk orang-orang yang mendapat petunjuk, tetapi aku menetapkan hukum sesuai dengan yang ditetapkan oleh Rasulullah shallallahu 'alaihi wasallam yaitu: Anak perempuan mendapat setengah, cucu perempuan mendapat seperenam menyempurnakan pembagian dua pertiga dan sisanya untuk saudara perempuan si mayit (Derajat: shahih. Hadits ke-30. حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا شَبَابَةُ، حَدَّثَنَا يُونُسُ بْنُ أَبِي إِسْحَاقَ، عَنْ أَبِي إِسْحَاقَ، عَنْ عَمْرِو بْنِ مَيْمُونٍ، عَنْ مَعْقِلِ بْنِ يَسَارٍ الْمُزَنِيِّ، قَالَ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم أُتِيَ بِفَرِيضَةٍ فِيهَا جَدٌّ فَأَعْطَاهُ ثُلُثًا أَوْ سُدُسًا .. Telah menceritakan kepada kami [Abu Bakar bin Abu Syaibah]; telah menceritakan kepada kami [Syababah]; telah menceritakan kepada kami [Yunus bin Abu Ishaq] dari [Abu Ishaq] dari ['Amru bin Maimun] dari [Ma'qil bin Yasar Al Muzani], ia berkata; "Aku mendengar Rasulullah shallallahu 'alaihi wasallam didatangi oleh seseorang yang menanyakan pembagian harta warisan yang di dalamnya terdapat seorang kakek dimana ia memberi sepertiga atau seperenam." Telah menceritakan kepada kami [Abu Hatim]; telah menceritakan kepada kami [Ibnu Ath Thabba']; telah menceritakan kepada kami [Husyaim] dari [Yunus] dari [Al Hasan] dari [Ma'qil bin Yasar], ia berkata; 'Rasulullah shallallahu 'alaihi wasallam menetapkan hukum harta warisan bagi seorang kakek yang ada pada kita sebesar seperenam (Derajat: shahih. Hadits ke-31. حَدَّثَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ الْمِصْرِيُّ، أَنْبَأَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ، أَنْبَأَنَا يُونُسُ، عَنِ ابْنِ شِهَابٍ، حَدَّثَهُ عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ، ح وَحَدَّثَنَا سُوَيْدُ بْنُ سَعِيدٍ، حَدَّثَنَا مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُثْمَانَ بْنِ إِسْحَاقَ بْنِ خَرَشَةَ، عَنِ ابْنِ ذُؤَيْبٍ، قَالَ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ لَهَا أَبُو بَكْرٍ مَا لَكِ فِي كِتَابِ اللَّهِ شَىْءٌ وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ رَسُولِ اللَّهِ صلى الله عليه وسلم شَيْئًا فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ . فَسَأَلَ النَّاسَ فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ حَضَرْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم أَعْطَاهَا السُّدُسَ فَقَالَ أَبُو بَكْرٍ هَلْ مَعَكَ غَيْرُكَ فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ الأَنْصَارِيُّ فَقَالَ مِثْلَ مَا قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ . ثُمَّ جَاءَتِ الْجَدَّةُ الأُخْرَى مِنْ قِبَلِ الأَبِ إِلَى عُمَرَ تَسْأَلُهُ مِيرَاثَهَا فَقَالَ مَا لَكِ فِي كِتَابِ اللَّهِ شَىْءٌ وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلاَّ لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ شَيْئًا وَلَكِنْ هُوَ ذَاكِ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا .. Telah menceritakan kepada kami [Ahmad bin 'Amru bin As Sarh Al Mishri]; telah memberitakan kepada kami [Abdullah bin Wahab]; telah memberitakan kepada kami [Yunus] dari [Ibnu Syihab]; telah menceritakan kepadanya dari [Qabishah bin Dzu`aib]; Demikian juga telah diriwayatkan dari jalur yang lainnya, dan telah menceritakan kepada kami [Suwaid bin Sa'id]; telah menceritakan kepada kami [Malik bin Anas] dari [Ibnu Syihab] dari ['Utsman bin Ishaq bin Kharasy] dari [Qabishah bin Dzuaib] ia berkata; "Datang seorang nenek kepada Abu Bakar dan bertanya kepadanya tentang bagian warisannya, maka Abu Bakar berkata kepadanya; "Aku tidak mendapatkan sesuatupun untukmu di dalam Kitabullah dan aku tidak mengetahui sesuatupun bagimu di dalam Sunnah Rasulullah shallallahu 'alaihi wasallam, maka kembalilah sehingga aku bertanya kepada orang-orang. Maka bertanyalah ia kepada orang-orang, dan [Al Mughirah bin Syu'bah] berkata; 'Aku hadir dihadapan Rasulullah shallallahu 'alaihi wasallam, beliau memberinya seperenam.' Bertanyalah Abu Bakar; 'Apakah selainmu ada yang bersamamu? ' Maka bangunlah [Muhammad bin Maslamah Al Anshariy], dan dia berkata seperti yang dikatakan Al Mughirah bin Syu'bah, kemudian Abu Bakar memberikan seperenam kepadanya. Lalu datanglah nenek yang lain dari pihak ayah kepada 'Umar menanyakan bagian warisnya, maka dia menjawab; 'Aku tidak mendapatkan sesuatu bagimu di dalam kitabullah dan tidak ada ketetapan yang ditetapkan kecuali untuk selain dirimu, dan aku tidak menambah sesuatupun di dalam Faraidl, akan tetapi dia adalah seperenam, dan jika kalian berdua berkumpul di dalam warisan maka bagiannya diantara kalian berdua, siapa saja diantara kalian bersendirian dengannya, maka dia adalah miliknya (Derajat: shahih. Hadits ke-32. حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ عَبْدِ الْوَهَّابِ، حَدَّثَنَا سَلْمُ بْنُ قُتَيْبَةَ، عَنْ شَرِيكٍ، عَنْ لَيْثٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم وَرَّثَ جَدَّةً سُدُسًا .. Telah menceritakan kepada kami [Abdurrahman bin Abdul Wahhab]; telah menceritakan kepada kami [Salam bin Qutaibah] dari [Syarik] dari [Laits] dari [Thawus] dari [Ibnu 'Abbas]; "Sesungguhnya Rasulullah shallallahu 'alaihi wasallam memberi bagian warisan kepada nenek seperenam (Derajat: shahih. Hadits ke-33. حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ، عَنْ سَعِيدٍ، عَنْ قَتَادَةَ، عَنْ سَالِمِ بْنِ أَبِي الْجَعْدِ، عَنْ مَعْدَانَ بْنِ أَبِي طَلْحَةَ الْيَعْمُرِيِّ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، قَامَ خَطِيبًا يَوْمَ الْجُمُعَةِ أَوْ خَطَبَهُمْ يَوْمَ الْجُمُعَةِ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ وَقَالَ إِنِّي وَاللَّهِ مَا أَدَعُ بَعْدِي شَيْئًا هُوَ أَهَمُّ إِلَىَّ مِنْ أَمْرِ الْكَلاَلَةِ وَقَدْ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَمَا أَغْلَظَ لِي فِي شَىْءٍ مَا أَغْلَظَ لِي فِيهَا حَتَّى طَعَنَ بِإِصْبَعِهِ فِي جَنْبِي أَوْ فِي صَدْرِي ثُمَّ قَالَ " يَا عُمَرُ تَكْفِيكَ آيَةُ الصَّيْفِ الَّتِي نَزَلَتْ فِي آخِرِ سُورَةِ النِّسَاءِ " .. Telah menceritakan kepada kami [Abu Bakar bin Abu Syaibah]; telah menceritakan kepada kami [Isma'il bin Ulayyah] dari [Sa'id] dari [Qatadah] dari [Salim bin Abu Ja'ad] dari [Ma'dan bin Abu Thalhah Al Ya'muri]; "Sesungguhnya ['Umar bin Khaththab] berdiri sambil berpidato di hari jum'at atau ia menyampaikan khutbah kepada Masyarakat di hari jum'at. la memuji kepada Allah lalu berkata; 'Sesungguhnya aku Demi Allah! Tidak ada hal sama sekali yang aku tinggalkan yang sangat penting, yang aku perhatikan daripada masalah kalalah, aku telah bertanya kepada Rasulullah shallallahu 'alaihi wasallam, seperti halnya dalam masalah ini, hingga Rasulullah shallallahu 'alaihi wasallam menusuk jarinya di pinggangku atau di dadaku, lalu bersabda: 'Wahai 'Umar! Cukup bagimu ayat shaif yang diturunkan di akhir surat An-Nisa (Derajat: shahih. Sumber: Sunan Ibnu Majah no. 2726.) Hadits ke-34. حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، وَأَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ قَالاَ حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا عَمْرُو بْنُ مُرَّةَ، عَنْ مُرَّةَ بْنِ شَرَاحِيلَ، قَالَ قَالَ عُمَرُ بْنُ الْخَطَّابِ ثَلاَثٌ لأَنْ يَكُونَ رَسُولُ اللَّهِ صلى الله عليه وسلم بَيَّنَهُنَّ أَحَبُّ إِلَىَّ مِنَ الدُّنْيَا وَمَا فِيهَا الْكَلاَلَةُ وَالرِّبَا وَالْخِلاَفَةُ .. Telah menceritakan kepada kami ['Ali bin Muhammad] dan [Abu Bakar bin Abu Syaibah], keduanya berkata; telah menceritakan kepada kami [Waki']; telah menceritakan kepada kami [Sufyan], telah menceritakan kepada kami [Amru bin Murrah] dari [Murrah bin Syarahil] berkata; ' [Umar bin Al Khatthab] berkata; "Tiga perkara, jika Rasulullah shallallahu 'alaihi wasallam menerangkannya lebih aku sukai ketimbang dunia dan seisinya; kalalah, riba dan khilafah (Derajat: shahih. Hadits ke-35. حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، حَدَّثَنَا سُفْيَانُ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ، يَقُولُ مَرِضْتُ فَأَتَانِي رَسُولُ اللَّهِ صلى الله عليه وسلم يَعُودُنِي هُوَ وَأَبُو بَكْرٍ مَعَهُ وَهُمَا مَاشِيَانِ وَقَدْ أُغْمِيَ عَلَىَّ فَتَوَضَّأَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَصَبَّ عَلَىَّ مِنْ وَضُوئِهِ فَقُلْتُ يَا رَسُولَ اللَّهِ كَيْفَ أَصْنَعُ كَيْفَ أَقْضِي فِي مَالِي حَتَّى نَزَلَتْ آيَةُ الْمِيرَاثِ فِي آخِرِ النِّسَاءِ {وَإِنْ كَانَ رَجُلٌ يُورَثُ كَلاَلَةً} الآيَةَ وَ {يَسْتَفْتُونَكَ قُلِ اللَّهُ يُفْتِيكُمْ فِي الْكَلاَلَةِ} الآيَةَ .. Telah menceritakan kepada kami [Hisyam bin Ammar]; telah menceritakan kepada kami [Sufyan] dari [Muhammad bin Al Munkadir], ia mendengar [Jabir bin 'Abdullah] berkata; "Aku sedang sakit lalu Rasulullah shallallahu 'alaihi wasallam bersama Abu bakar datang menjengukku, keduanya datang dengan berjalan kaki. Saat itu aku sedang dalam keadaan pingsan. Rasulullah shallallahu 'alaihi wasallam kemudian berwudlu lalu ia menyiramkan bekas air wudlunya kepadaku dan aku katakan; 'Wahai Rasulullah! Apa yang harus aku perbuat? Apa yang harus aku putuskan pada hartaku? Sampai turun ayat mengenai harta warisan di akhir surat An-Nisa yang berbunyi: 'Apabila seorang laki-laki mewariskan kalalah.' Dan ayat: 'Mereka meminta fatwa kepadamu (wahai Muhammad), katakanlah: 'Allah Subhanahu Wa Ta'ala memberi fatwa kepada kalian mengenai kalalah (Derajat: shahih. Sumber: Sunan Ibnu Majah no. 2728.) Hadits ke-36. حَدَّثَنَا هِشَامُ بْنُ عَمَّارٍ، وَمُحَمَّدُ بْنُ الصَّبَّاحِ، قَالاَ حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عَلِيِّ بْنِ الْحُسَيْنِ، عَنْ عَمْرِو بْنِ عُثْمَانَ، عَنْ أُسَامَةَ بْنِ زَيْدٍ، رَفَعَهُ إِلَى النَّبِيِّ صلى الله عليه وسلم قَالَ " لاَ يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلاَ الْكَافِرُ الْمُسْلِمَ " .. Telah menceritakan kepada kami [Hisyam bin 'Amar] dan [Muhammad bin Ash Shabah], keduanya berkata; telah menceritakan kepada kami [Sufyan bin Uyainah] dari [Az Zuhri] dari [Ali bin Al Husain] dari ['Amru bin 'Utsman] dari [Usamah bin Zaid], ia berkata; -secara marfu- Rasulullah shallallahu 'alaihi wasallam bersabda: "Seorang muslim tidak berhak memberikan harta warisannya kepada orang kafir, demikian pula seorang kafir tidak diperkenankan memberikan harta warisannya kepada seorang muslim (Derajat: shahih. Hadits ke-37. حَدَّثَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ وَهْبٍ، أَنْبَأَنَا يُونُسُ، عَنِ ابْنِ شِهَابٍ، عَنْ عَلِيِّ بْنِ الْحُسَيْنِ، أَنَّهُ حَدَّثَهُ أَنَّ عَمْرَو بْنَ عُثْمَانَ أَخْبَرَهُ عَنْ أُسَامَةَ بْنِ زَيْدٍ، أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ أَتَنْزِلُ فِي دَارِكَ بِمَكَّةَ قَالَ " وَهَلْ تَرَكَ لَنَا عَقِيلٌ مِنْ رِبَاعٍ أَوْ دُورٍ " . وَكَانَ عَقِيلٌ وَرِثَ أَبَا طَالِبٍ هُوَ وَطَالِبٌ وَلَمْ يَرِثْ جَعْفَرٌ وَلاَ عَلِيٌّ شَيْئًا لأَنَّهُمَا كَانَا مُسْلِمَيْنِ وَكَانَ عَقِيلٌ وَطَالِبٌ كَافِرَيْنِ . فَكَانَ عُمَرُ مِنْ أَجْلِ ذَلِكَ يَقُولُ لاَ يَرِثُ الْمُؤْمِنُ الْكَافِرَ . وَقَالَ أُسَامَةُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " لاَ يَرِثُ الْمُسْلِمُ الْكَافِرَ وَلاَ الْكَافِرُ الْمُسْلِمَ " .. Telah menceritakan kepada kami [Ahmad bin 'Amru bin As Sarh]; telah menceritakan kepada kami [Abdullah bin Wahab]; telah memberitakan kepada kami [Yunus] dari [Ibnu Syihab] dari [Ali bin Al Hushain] bahwa ia menceritakannya bahwa ['Amru bin 'Utsman] mengabarinya dari [Usamah bin Zaid], sesungguhnya ia berkata; "Wahai Rasulullah apakah engkau akan mampir di rumahmu di Makkah?" Ia berkata; 'Apakah Aqil meninggalkan bagian dari harta warisan untuk kami berupa rumah? ' Aqil adalah ahli waris dari Abu Thalib, yaitu ia dan Thalib. Sedangkan Ja'far dan Ali tidak mendapatkan harta warisan sama sekali karena keduanya orang Islam. Sementara Aqil dan Thalib adalah orang kafir. Hadits ke-39. حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا أَبُو أُسَامَةَ، حَدَّثَنَا حُسَيْنٌ الْمُعَلِّمُ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ تَزَوَّجَ رِئَابُ بْنُ حُذَيْفَةَ بْنِ سُعَيْدِ بْنِ سَهْمٍ أُمَّ وَائِلٍ بِنْتَ مَعْمَرٍ الْجُمَحِيَّةَ فَوَلَدَتْ لَهُ ثَلاَثَةً فَتُوُفِّيَتْ أُمُّهُمْ فَوَرِثَهَا بَنُوهَا رِبَاعًا وَوَلاَءَ مَوَالِيهَا فَخَرَجَ بِهِمْ عَمْرُو بْنُ الْعَاصِ مَعَهُ إِلَى الشَّامِ فَمَاتُوا فِي طَاعُونِ عَمْوَاسَ فَوَرِثَهُمْ عَمْرٌو وَكَانَ عَصَبَتَهُمْ فَلَمَّا رَجَعَ عَمْرُو بْنُ الْعَاصِ جَاءَ بَنُو مَعْمَرٍ يُخَاصِمُونَهُ فِي وَلاَءِ أُخْتِهِمْ إِلَى عُمَرَ فَقَالَ عُمَرُ أَقْضِي بَيْنَكُمْ بِمَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم سَمِعْتُهُ يَقُولُ " مَا أَحْرَزَ الْوَلَدُ أَوِ الْوَالِدُ فَهُوَ لِعَصَبَتِهِ مَنْ كَانَ " . قَالَ فَقَضَى لَنَا بِهِ وَكَتَبَ لَنَا بِهِ كِتَابًا فِيهِ شَهَادَةُ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ وَزَيْدِ بْنِ ثَابِتٍ وَآخَرَ حَتَّى إِذَا اسْتُخْلِفَ عَبْدُ الْمَلِكِ بْنُ مَرْوَانَ تُوُفِّيَ مَوْلًى لَهَا وَتَرَكَ أَلْفَىْ دِينَارٍ فَبَلَغَنِي أَنَّ ذَلِكَ الْقَضَاءَ قَدْ غُيِّرَ فَخَاصَمُوهُ إِلَى هِشَامِ بْنِ إِسْمَاعِيلَ فَرَفَعَنَا إِلَى عَبْدِ الْمَلِكِ فَأَتَيْنَاهُ بِكِتَابِ عُمَرَ فَقَالَ إِنْ كُنْتُ لأَرَى أَنَّ هَذَا مِنَ الْقَضَاءِ الَّذِي لاَ يُشَكُّ فِيهِ وَمَا كُنْتُ أَرَى أَنَّ أَمْرَ أَهْلِ الْمَدِينَةِ بَلَغَ هَذَا أَنْ يَشُكُّوا فِي هَذَا الْقَضَاءِ . فَقَضَى لَنَا بِهِ فَلَمْ نَزَلْ فِيهِ بَعْدُ .. Telah menceritakan kepada kami [Abu Bakar bin Abu Syaibah]; telah menceritakan kepada kami [Abu Usamah]; telah menceritakan kepada kami [Husain Al Mua'llim] dari [Amru bin Syu'aib] dari [Ayahnya] dari [Kakeknya] berkata; "Rabab bin Hudzaifah bin Sa'id bin Sahm, ibu dari Wail binti Ma'mar Al Jumahiyah menikah. Rubab melahirkan tiga orang anak, kemudian ibu mereka meninggal dunia. Anak-anaknya menjadi ahli waris dari ibunya, berupa rumah dan hamba sahaya. Amru bin Ash lalu keluar bersama mereka menuju Syam, tetapi mereka meninggal dunia terkena penyakit kusta di kawasan Amwas. Maka Amru menjadi ahli waris mereka karena Amru termasuk keluarga mereka, ketika Amru bin Ash kembali, Bani Ma'mar datang memprotes mengenai keberadaan hamba sahaya saudara perempuan mereka kepada Umar." [Umar] berkata; 'Aku menetapkan hukum dengan sesuatu yang aku dengar dari Rasulullah shallallahu 'alaihi wasallam, aku mendengar Rasulullah shallallahu 'alaihi wasallam bersabda: 'Harta yang diperoleh dari seorang anak dan seorang ayah, maka ia untuk keturunannya, siapa saja. (Umar) menetapkan hukum tersebut kepada kami. Umar juga menulis kepada kami suatu tulisan yang di dalamnya terdapat kesaksian Abdurrahman bin Auf dan Zaid bin Tsabit dan yang lainnya sehingga ketika Abdul Malik bin Marwan menjadi khalifah, seorang hamba sahaya meninggal dunia. Hamba sahaya tersebut meninggalkan dua ribu dinar. Lalu aku mendengar bahwa keputusan hukum tersebut telah diubah. Mereka lalu mengadu kepada Hisyam bin Ismail kemudian kami adukan kepada Abdul Malik, kami mendatanginya dengan membawa tulisan Umar. Abdul Malik berkata; 'Aku memandang bahwa ini adalah keputusan hukum yang tidak diragukan lagi, aku tidak melihat penduduk kota Madinah yang telah sampai kepada mereka hukum ini kemudian akan meragukannya, lalu ia menetapkan hukum ini kepada kami dan setelahnya terus seperti itu (Derajat: shahih.
