Welcome to the study of authentic hadith selected by ULYAH. Let's look at some of the following sayings of the Prophet sallallaahu 'alaihi wa sallam, one by one, with an open heart to put them into practice. 1st Hadith. وَحَدَّثَنِي مَالِكٌ، عَنِ الْعَلاَءِ بْنِ عَبْدِ God willing God willing, God willing, God willing, God willing God willing may Allah bless him and give him peace and blessings مُسْلِمٍ بِيَمِينِهِ حَرَّمَ اللَّهُ عَلَيْهِ الْجَنَّةَ وَأَوْجَبَ لَهُ النَّارَ ‏"‏ ‏.‏ قَالُوا وَإِنْ كَانَ شَيْئًا يَسِيرًا يَا رَسُولَ اللَّهِ قَالَ ‏"‏ وَإِنْ كَانَ قَضِيبًا مِنْ أَرَاكٍ وَإِنْ كَانَ قَضِيبًا مِنْ أَرَاكٍ وَإِنْ كَانَ قَضِيبًا مِنْ أَرَاكٍ ‏"‏ ‏.‏ قَالَهَا ثَلاَثَ مَرَّاتٍ ‏.‏. It has been told to me Malik from [Al 'Ala` bin Abdurrahman] from [Ma'bad bin Ka'ab As Salami] from his brother [Abdullah bin Ka'ab bin Malik Al Ansari] from [Abu Umamah] that the Messenger of Allah sallallaahu 'alaihi wasallam said: "Whoever takes away the rights of a muslim with his oath, Allah has forbidden heaven for him and hell for him." They ask; "Even if it's a small matter, O Messenger of Allah?" He answered; "Even if it's only siwak from arak wood, even if it's only siwak from arak wood, even if it's only siwak from arak wood." he said it three times (Degree: authentic. Source: Muwatta Malik no. 1412.) 2nd hadith. قَالَ يَحْيَى قَالَ مَالِكٌ عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، God willing, God willing, God willing, God willing. يَقُولُ اخْتَصَمَ زَيْدُ بْنُ ثَابِتٍ الأَنْصَارِيُّ وَابْنُ مُطِيعٍ فِي دَارٍ كَانَتْ بَيْنَهُمَا إِلَى مَرْوَانَ بْنِ God willing God willing, God willing, God willing فَقَالَ زَيْدُ بْنُ ثَابِتٍ أَحْلِفُ لَهُ مَكَانِي ‏.‏ قَالَ فَقَالَ مَرْوَانُ لاَ وَاللَّهِ إِلاَّ عِنْدَ مَقَاطِعِ God bless you. God bless you God willing. God willing. God willing. God willing الْمِنْبَرِ - قَالَ - فَجَعَلَ مَرْوَانُ بْنُ الْحَكَمِ يَعْجَبُ God عَلَى الْمِنْبَرَ ثَلاَثَةُ دَرَاهِمَ ‏.‏. Yahya said; Malik said; from [Daud bin Al Husain] that he heard [Abu Ghatafan bin Thariq Al Muri] say; "Zaid bin Thabit Al Ansari and Ibnu Muthi' had a dispute about a house, then they complained about the matter to Marwan bin Hakam, who at that time served as governor of Medina. Then he gave the decision for Zaid bin Thabit to swear an oath on the pulpit, [Zaid bin Tsabit] said: "I will swear in my place." Marwan bin Al Hakam said: 'No! By Allah, except where the rights are terminated." Abu Ghathafan said, "Zaid bin Thabit also swore that his rights were true, and refused to swear on the pulpit." Zaid bin Thabit's attitude surprised Marwan bin Al Hakam." Malik said; "In our opinion, a person should not be asked to swear an oath on the pulpit for charges of less than a quarter of a dinar or three dirhams (Degree: authentic. Source: Muwatta Malik no. 1413.) 3rd Hadith. قَالَ يَحْيَى حَدَّثَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ God willing, God willing, God willing, God willing وسلم قَالَ ‏ "‏ لاَ يَغْلَقُ الرَّهْنُ ‏"‏ ‏.‏. Yahya said; has told me Malik from [Ibnu Shihab] from [Sa'id bin Musayyab] that the Messenger of Allah sallallaahu 'alaihi wasallam said: "Debt collateral should not be owned." Malik said; "The interpretation of his words - Wa allah 'alam - is that a man pawns his goods to another party, while the value of the pawned goods is greater than the amount of the debt. Then the person who pawned said to the party who received the pawn, "I will come to you with your rights until the specified time, but if not then the pawned goods become yours." Malik said; "This is not right and not halal, this kind of practice is prohibited. Namely, if the owner of the item exceeds the specified time, the item being pawned becomes the property of the pawnee. And I see that conditions like this are not valid (Degree: authentic. God willing God willing, God willing, God willing, God willing, God willing مُسْتَكْرَهَةً بِصَدَاقِهَا عَلَى مَنْ فَعَلَ ذَلِكَ بِهَا ‏.‏ قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ الأَمْرُ God willing كَانَتْ أَوْ ثَيِّبًا إِنَّهَا إِنْ كَانَتْ حُرَّةً فَعَلَيْهِ صَدَاقُ مِثْلِهَا وَإِنْ كَانَتْ أَمَةً فَعَلَيْهِ مَا نَقَصَ مِنْ ثَمَنِهَا وَالْعُقُوبَةُ فِي ذَلِكَ عَلَى الْمُغْتَصِبِ وَلاَ عُقُوبَةَ عَلَى الْمُغْتَصَبَةِ فِي ذَلِكَ كُلِّهِ وَإِنْ كَانَ الْمُغْتَصِبُ عَبْدًا فَذَلِكَ عَلَى سَيِّدِهِ إِلاَّ أَنْ يَشَاءَ أَنْ يُسَلِّمَهُ ‏.‏. It has been told to me Malik from [Ibn Shihab] that [Abdul Malik bin Marwan] decided that if a woman is raped by force, the man who does it must give her a dowry (Degree: authentic. Source: Muwatta Malik no. 1415.) 5th Hadith. God bless you God willing دِينَهُ فَاضْرِبُوا عُنُقَهُ ‏"‏ ‏.‏ وَمَعْنَى قَوْلِ God willing ‏"‏ مَنْ غَيَّرَ دِينَهُ فَاضْرِبُوا عُنُقَهُ ‏"‏ ‏.‏ أَنَّهُ God willing الزَّنَادِقَةِ وَأَشْبَاهِهِمْ فَإِنَِ عَلَيْهِما God willing God willing يُسْتَتَابَ هَؤُلاَءْ وَأَمَّا مَنْ خَرَجَ مِنَ الإِسْلاَمِ إِلَى غَيْرِهِ وَأَظْهَرَ ذَلِكَ فَإِنَّهُ يُسْتَتَابُ فَإِنْ تَابَ وَإِلاَّ قُتِلَ وَذَلِكَ لَوْ أَنَّ قَوْمًا كَانُوا عَلَى ذَلِكَ God willing فَإِنْ تَابُوا قُبِلَ ذَلِكَ مِنْهُمْ وَإِنْ لَمْ يَتُوبُوا قُتِلُوا وَلَمْ يُعْنَ بِذَلِكَ فِيمَا نُرَى وَاللَّهُ God willing, God willing, God willing, God willing God willing God bless you God willing God willing عُنِيَ بِهِ وَاللَّهُ أَعْلَمُ ‏.‏. Yahya has told us from Malik from [Zaid bin Aslam] that Rasulullah shallallahu 'alaihi wasallam said: "Whoever changes his religion (apostates), then cut his neck." Waallahu A'lam, according to what we know, the meaning of the words of the Prophet sallallaahu 'alaihi wasallam: "Whoever changes his religion, cut his neck" is a person who leaves the religion of Islam and joins another religion, such as zindiq and the like. If they show themselves, then they may be killed and there is no need to ask for repentance. Because their repentance is not acknowledged, and they may be able to hide their disbelief and reveal their Islam. So in our opinion, such people should not be given the opportunity to repent, and their words should not be accepted. As for a person who leaves Islam and converts to another religion and then shows it, then he should be asked to repent, if he does not repent then he will be killed. Then, if a people is in a situation like that, then in my opinion they are invited to convert to Islam, if they don't accept then they are fought. And the meaning of this hadith is not the conversion of a Jew to Christianity or a Christian to Judaism. Or, not from another religion to another religion. Except Islam, because the meaning of this hadith is a person who leaves Islam and enters another religion, then shows it." Waallahu A'lam (Degree: authentic. Source: Muwatta Malik no. 1416.) 6th Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ عَبْدِ الرَِ God willing, God willing, God willing, God willing, God willing God bless you قِبَلِ أَبِي مُوسَى الأَشْعَرِيِّ فَسَأَلَهُ عَنِ النَّاسِ، love مُغَرِّبَةِ خَبَرٍ فَقَالَ نَعَمْ رَجُلٌ كَفَرَ بَعْدَ God willing. God willing. God قَرَّبْنَاهُ فَضَرَبْنَا عُنُقَهُ ‏.‏ فَقَالَ عُمَرُ أَفَلاَ God bless you God willing أَمْرَ اللَّهْ أَحْضُرْ وَلَمْ آمُرْ وَلَمْ أَرْضَ إِذْ بَلَغَنِي ‏.‏. Has told me Malik from [Abdurrahman bin Muhammad bin Abdullah bin Abdulqari] from [his father] said; "A man from Abu Musa Al 'Asy'ari's side met [Umar bin Khattab], then Umar asked him about the human condition at that time, then he answered. After that Umar asked him; 'Is there any new news for you? ' The man answered, "Yes. a person who apostates after Islam." Umar asked again, "Then what did you do to him? ' The man answered, "We approached him, then we cut his neck." Umar said; "Didn't you first imprison him for three days, then give him rati every day, then ask him to repent until he truly repents, after that you leave his affairs to Allah?" Then Umar prayed, "O Allah, indeed I was not present at that time, I did not order and I was not willing when the news was conveyed to me (Degree: authentic. Source: Muwatta Malik no. 1417.) 7th Hadith. God bless you صَالِحٍ السَّمَّانِ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، God willing, God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing, God willing رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ نَعَمْ ‏"‏ ‏.‏. It has been told to me that Yahya from Malik from [Suhail bin Abu Salih As Saman] from [his father] from [Abu Hurairah] said, "Sa'd bin 'Ubadah asked the Messenger of Allah sallallaahu 'alaihi wasallam, "What do you think if I find a man with my wife, do I delay it until I bring four witnesses," then Rasulullah shallallahu 'alaihi wasallam answered; "Yes (Degree: authentic. Source: Muwatta Malik no. 1418.) 8th Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ God willing - love may Allah bless him and give him peace مُعَاوِيَةَ بْنِ أَبِي سُفْيَانَ الْقَضَاءُ فِيهِ فَكَتَبَ God willing, God willing, God willing, God willing, God willing God willing God willing, God willing, God willing, God willing, God willing, God willing. Allah's blessings ‏.” God willing. God willing. God God willing شُهَدَاءَ فَلْيُعْطَ بِرُمَّتِهِ ‏.‏. It has been told to me Malik from [Yahya bin Sa'id] from [Said bin Musayab] said, "A resident of Syria named Ibn Khaibari found a man with his wife, so he killed him or killed them both. So this made it difficult for Mu'awiyah bin Abu Sufyan to decide the case, he then wrote a letter to Abu Musa Al Asy'ari asking [Ali bin Abu Talib] about it. Then Abu Musa asked Ali bin Abu Talib about this, Ali then said to him; "This matter did not happen in my area, so I want you to provide me with the correct information." So Abu Musa Al Asy'ari then said; " Ali answered; "I, Abu Hasan! If he does not bring four witnesses then punish him (Degree: authentic. Source: Muwatta Malik no. 1419.) 9th Hadith. قَالَ يَحْيَى قَالَ مَالِكٌ عَنِ ابْنِ شِهَابٍ، عَنْ سُنَيْنٍ God willing prayer God willing, God willing, God willing, God willing, God willing, God willing God willing فَأَخَذْتُهَا ‏.‏ فَقَالَ لَهُ عَرِيفُهُ يَا أَمِيرَ God bless you. God bless you. God bless you God bless you ‏.‏. Yahya said Malik said; from [Ibnu Shihab] from [Sunain Abu Jamilah] a young man from Bani Sulaim, he found a child from adultery who was thrown away during the time of Umar bin Khattab. Sunain said; "I took him to Umar bin Khattab." Then [Umar] asked; "What caused you to take this child?" Sunain answered; "I found it abandoned so I picked it up." People who know the child say; "O Amirul Mukminin, he is a pious child." Umar said to him; "Is it true?" The person answered; "Yes." Umar bin Khattab then said; "Go! The child is free, you have custody of him, while we are the ones who will provide for him (Degree: authentic. Source: Muwatta Malik no. 1420.) 10th Hadith. قَالَ يَحْيَى عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ God bless you God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing, God willing. وَلِيدَةِ زَمْعَةَ مِنِّي فَاقْبِضْهُ إِلَيْكَ ‏.‏ قَالَتْ فَلَمَّا كَانَ عَامُ الْفَتْحِ أَخَذَهُ سَعْدٌ وَقَالَ ابْنُ God willing God willing, God willing, God willing, God willing, God willing, God willing. وُلِدَ عَلَى فِرَاشِهِ ‏.‏ فَتَسَاوَقَا إِلَى رَسُولِ اللَّهِ may Allah bless him and give him peace and blessings God willing زَمْعَةَ أَخِي وَابْنُ وَلِيدَةِ أَبِي وُلِهَ ‏"‏ يَا عَبْدُ بْنَ زَمْعَةَ ‏"‏ ‏.‏ ثُمَّ قَالَ رَسُولُ اللَّهِ may Allah bless him and give him peace and blessings الْحَجَرُ ‏"‏ ‏.‏ ثُمَّ قَالَ لِسَوْدَةَ بِنْتِ زَمْعَةَ ‏"‏ احْتَجِبِي مِنْهُ ‏"‏ ‏.‏ لِمَا رَأَى مِنْ شَبَهِهِ God willing لَقِيَ اللَّهَ عَزَّ وَجَلَّ ‏.‏. Yahya said; from Malik from [Ibn Shihab] from ['Urwah bin Az Zubair] from [Aisyah] the wife of the Prophet sallallaahu 'alaihi wasallam, he said; "Utbah bin Abu Waqqas promised his brother, Sa'd bin Abu Waqqash, "The child of the slave woman Zam'ah is my flesh and blood, so take care of him." Aisyah said; "When the city of Mecca was opened, Sa'd took the child and said; 'This is my brother's child, he has told me that I should take it." But then 'Abd bin Zam'ah said, "This is my brother, he is the child of my father's slave woman, who was born in his bed." Then both of them agreed to complain about this to Rasulullah shallallahu 'alaihi wasallam. Sa'd said; 'O Rasulullah, this is my brother's child, he has ordered me to take it." Abd bin Zam'ah said; "This is my brother, he is the child of my father's slave woman who was born on his mattress." Rasulullah sallallaahu 'alaihi wasallam then said: "O Abd bin Zam'ah, he is yours." He then said again: "The child is for the owner of the mattress, while for the adulterer the punishment is stoning." Waqqash. Aisyah said; "So he never saw it until he met Allah Azza Wa Jalla (Degree: authentic. Source: Muwatta Malik no. 1421.) 11th Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ God willing God willing God willing, God willing, God willing, God willing, God willing. God willing God bless you God willing God willing فَذَكَرَ ذَلِكَ لَهَ God bless you God willing هَلَكَ عَنْهَا زَوْجُهَا حِينَ حَمَلَتْ مِنْهُ فَأُهْرِيقَتْ may Allah bless him and give him peace of mind Allah's blessings الْمَاءُ تَحَرَّكَ الْوَلَدُ فِي بَطْنِهَا وَكَبِرَ ‏.‏ فَصَدَّقَهَا عُمَرُ بْنُ الْخَطَّابِ وَفَرَّقَ بَيْنا وَقَالَ عُمَرُ أَمَا إِنَّهُ لَمْ يَبْلُغْنِي عَنْكُمَا إِلاَّ خَيْرٌ وَأَلْحَقَ الْوَلَدَ بِالأَوَّلِ ‏.‏. It has been told to me Malik from [Yazid bin Abdullah bin Al Hadi] from [Muhammad bin Ibrahim bin Al Harits At Taimi] from [Sulaiman bin Yasar] from [Abdullah bin Abu Umayyah] said, "A woman was divorced by her husband, then she performed iddah for four months and ten days. After completion she married again, then she gave birth to a perfect son after four months and a half living at home (with her second husband). So her (second) husband When he met [Umar bin Khattab] he complained about this, then Umar called the women of the jahiliyah in the past and asked about this. One of them then said, "I will tell you about this woman. Her husband died while she was pregnant, and the child was developing in her stomach. When her second husband had sex with her, and his semen came into contact with the child, the child in her stomach moved and became big." Umar bin Khattab confirmed the woman and then separated the two of them. 'Umar said; "Nothing comes to me from the two of you except goodness." Then he assigned the child to the first husband (Degree: authentic. Source: Muwatta Malik no. 1422.) 12th Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ God willing God bless you God willing God willing God willing فَضَرَبَهُ عُمَرُ بْنُ الْخَطَّابِ بِالدِّرَّةِ ثُمَّ دَعَا God willing هَذَا - لأَحَدِ الرَّجُلَيْنِ - يَأْتِينِي ‏.‏ وَهِيَ فِي إِبِلٍ لأَهْلِهَا فَلاَ يُفَارِقُهَا حَتَّى يَظُنَّ وَتَظُنَّ God willing, God willing, God willing, God willing, God willing. - تَعْنِي الآخَرَ - فَلاَ أَدْرِي مِنْ أَيِّهِمَا هُوَ قَالَ فَكَبَّرَ الْقَائِفُ فَقَالَ عُمَرُ لِلْغُلاَمِ وَالِ أَيَّهُمَا شِئْتَ ‏.‏. It has been told to me Malik from [Yahya bin Sa'id] from [Sulaiman bin Yasar] that [Umar bin Khattab] includes the lineage of the children of Jahiliyah to anyone who professes Islam. Then two men came who claimed to be a woman's child, so Umar bin Khattab summoned a nasab expert to examine them both. The nasab expert said; "The two of them have become allies in the child's fate." Umar bin Khattab finally whipped them both with a bat, then called the woman and said, "Tell me about yourself!" The woman then said, "This child is the child of one of the people who had sex with me." When the woman was in the care of her family, the man never left her until he and the woman thought that the womb was still with him. Then the man left the woman, after which blood came out of the woman. then a second man came and sexually assaulted her. So I don't know which man this child came from." The hereditary expert gave takbir and Umar said to the child; "Go with the two of them, whatever you want (Degree: authentic. Source: Muwatta Malik no. 1423.) 13th Hadith. قَالَ يَحْيَى قَالَ مَالِكٌ عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمِ God willing, God willing, God willing, God willing God bless you وَلاَئِدَهُمْ ثُمَّ يَعْزِلُوهُنَّ لاَ تَأْتِينِي وَلِيدَةٌ سَيِّدُهَا أَنْ قَدْ أَلَمَّ بِهَا إِلاَّ أَلْحَقْتُ بِهْ ‏.‏. Yahya said; Malik said; from [Ibn Shihab] from [Salim bin Abdullah bin 'Umar] from [his father] that [Umar bin Khattab] said; "Why do men sexually assault their female slaves and then commit 'azl, it is not a female slave whose master admits that he has sexually assaulted her except the child, I will give it to her master. So after this you can commit 'azl or not (Degree: authentic. Source: Muwatta Malik no. 1425.) 14th Hadith. love God willing God willing God bless you يَعْتَرِفُ سَيِّدُهَا أَنْ قَدْ أَلَمَّ بِهَا إِلاَّ قَدْ أَلْحَقْتُ بِهْ God bless you. God willing, God willing, God willing, God willing, God willing, God willing. God bless you God willing جِنَايَتِهَا أَكْثَرَ مِنْ قِيمَتِهَا ‏.‏. Has told me Malik from [Nafi'] from [Shafiyah bint Abu Ubaid] That he has informed him, that [Umar bin Khattab] said; "What about men who have relations with their female slaves and then let them go? A female slave does not come to me whose master admits to having had sexual relations with her, unless I determine the child's lineage to (his master), then release the female slaves or keep them (Degree: authentic. Source: Muwatta Malik no. 1426.) 15th Hadith. God bless you God willing, God willing, God willing, God willing "‏ مَنْ أَحْيَا أَرْضًا مَيِّتَةً فَهِيَ لَهُ وَلَيْسَ لِعِرْقٍ ظَالِمٍ حَقٌّ ‏"‏ ‏.‏. Yahya has told me from Malik from [Hisyam bin 'Urwah] from [his father] that the Messenger of Allah salla Allahu 'alaihi wa sallam said: "Whoever gives life to dead land then it belongs to him, and the sweat of the person who does injustice (seizes the land) does not get any rights." Malik said; "Unjust sweat is anything that is hollowed out or taken or planted without right (Degree: authentic. Source: Muwatta Malik no. 1427.) 16th Hadith. وَحَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمِ بْنِ God willing, God willing, God willing, God willing قَالَ مَنْ أَحْيَا أَرْضًا مَيِّتَةً فَهِيَ لَهُ ‏.‏ قَالَ مَالِكٌ وَعَلَى ذَلِكَ الأَمْرُ عِنْدَنَا ‏.‏. It has been told to me Malik from [Ibnu Shihab] from [Salim bin Abdullah] from [his father] that [Umar bin Khattab] said; "Whoever gives life to land that has died, then the land becomes his," Malik said; "This is our opinion (Degree: authentic. Source: Muwatta Malik no. 1428.) 17th Hadith. God willing God willing God willing, God willing, God willing, God willing, God willing, God willing. سَيْلِ مَهْزُورٍ وَمُذَيْنِبٍ ‏ "‏ يُمْسَكُ حَتَّى الْكَعْبَيْنْ ‏.‏. Yahya has told me from Malik from [Abdullah bin Abu Bakr bin Muhammad bin 'Amr bin Hazm] it has reached him, that the Messenger of Allah sallallaahu 'alaihi wasallam said about the flow of water being thrown away; "Let the water be held up to the ankles, then the upper one should let it flow to the lower one (Degree: authentic. Source: Muwatta Malik no. 1429.) 18th Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، God willing, God willing, God willing, God willing, God willing قَالَ ‏ "‏ لاَ يُمْنَعُ فَضْلُ الْمَاءِ لِيُمْنَعَ بِهِ الْكَلأُ ‏"‏ ‏.‏. It has been told to me Malik from [Abu Az Zinad] from [Al A'raj] from [Abu Hurairah] that the Messenger of Allah salla Allahu 'alaihi wa sallam said: "Excess water must not be retained, to prevent the growth of grass (Degree: authentic. Source: Muwatta Malik no. 1430.) 19th hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ أَبِي الرِّجَالِ، مُحَمَّدِ بْنِ God willing, God willing, God willing, God willing God willing الله عليه وسلم قَالَ ‏ "‏ لاَ يُمْنَعُ نَقْعُ بِئْرٍ ‏"‏ ‏.‏. It has been told to me Malik from [Abu Ar Rijal Muhammad bin Abdurrahman] from his mother [Amrah bint Abdurrahman] that she informed him, that the Messenger of Allah salla Allahu 'alaihi wa sallam said: "The overflow of well water must not be hindered (Degree: authentic. Source: Muwatta Malik no. 1431.) Hadits ke-20. حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ عَمْرِو بْنِ يَحْيَى الْمَازِنِيِّ، عَنْ أَبِيهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ ضَرَرَ وَلاَ ضِرَارَ ‏"‏ ‏.‏. Telah menceritakan kepadaku Yahya dari Malik dari ['Amru bin Yahya Al Muzani] dari [Bapaknya] bahwa Rasulullah Shalla Allahu 'alaihi wa sallam bersabda: "Tidak boleh membuat kemudharatan pada diri sendiri dan membuat kemudharatan pada orang lain (Derajat: shahih. Hadits ke-21. وَحَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يَمْنَعُ أَحَدُكُمْ جَارَهُ خَشَبَةً يَغْرِزُهَا فى جِدَارِهِ ‏"‏ ‏.‏ ثُمَّ يَقُولُ أَبُو هُرَيْرَةَ مَا لِي أَرَاكُمْ عَنْهَا مُعْرِضِينَ وَاللَّهِ لأَرْمِيَنَّ بِهَا بَيْنَ أَكْتَافِكُمْ ‏.‏. Telah menceritakan kepadaku Malik dari [Ibnu Syihab] dari [Al A'raj] dari [Abu Hurairah] bahwa Rasulullah Shalla Allahu 'alaihi wa sallam bersabda: "Janganlah seorang di antara kalian melarang tetangganya menyandarkan kayu di temboknya." Kemudian Abu Hurairah berkata; "Demi Allah, tidaklah saya melihat kalian berpaling darinya, kecuali saya akan melemparkannya di antara pundak-pundak kalian (Derajat: shahih. Sumber: Muwatta Malik no. 1433.) 22nd Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ عَمْرِو بْنِ يَحْيَى God willing God willing يَمُرَّ بِهِ فِي أَرْضِ مُحَمَّدِ بْنِ مَسْلَمَةَ فَأَبَى مُحَمَّدٌ ‏.‏ فَقَالَ لَهُ الضَّحَّاكُ لِمَ تَمْنَعُنِي وَهُوَ لَكَ مَنْفَعَةٌ تَشْرَبُ بِهِ أَوَّلاً وَآخِرًا وَم يَضُرُّكَ ‏.‏ فَأَبَى مُحَمَّدٌ فَكَلَّمَ فِيهِ الضَّحَّاكُ God willing, God willing, God willing, God willing, God willing. مُحَمَّدَ بْنَ مَسْلَمَةَ فَأَمَرَهُ أَنْ يُخَلِّيَ سَبِيلَهُ فَقَالَ مُحَمَّدٌ لاَ ‏.‏ فَقَالَ عُمَرُ لِمَ تَمْنَعُ أَخَاكَ مَا يَنْفَعُهُ وَهُوَ لَكَ نَافِعٌ تَسْقِي بِهِ أَوَّلاً وَآخِرًا وَهُوَ لاَ يَضُرُّكَ ‏.‏ فَقَالَ مُحَمَّدٌ لاَ وَاللَّهِ ‏.‏ فَقَالَ عُمَرُ وَاللَّهِ لَيَمُرَّنَّ بِهِ God bless you فَفَعَلَ الضَّحَّاكُ ‏.‏. It has been told to me Malik from ['Amru bin Yahya Al Mazini] from [his father] that once Dlahak bin Khalifah once made a tributary flow, then he wanted to pass through Muhammad bin Maslamah's land, but Muhammad refused. Dlahak said; "Why did you forbid me even though it has benefits for you, you can always drink from it, and it won't harm you?" Muhammad still refused, then Dlahak complained about this to [Umar bin Khattab], Umar bin Khattab then called Muhammad bin Maslamah and told him to give him a way. Muhammad said; "No." Umar said; "Why do you deprive your brother of something that is beneficial to him and to you too, you can drink from him, and it does not harm you." Muhammad said; "No, by Allah." Umar said; "By Allah, he will miss it even on his stomach." Umar then ordered him to pass it, and Dlahak carried it out (Degree: authentic. Source: Muwatta Malik no. 1434.) 23rd Hadith. وَحَدَّثَنِي مَالِكٌ، عَنْ عَمْرِو بْنِ يَحْيَى God willing جَدِّهِ رَبِيعٌ لِعَبْدّ عَبْدُ الرَّحْمَنْ نَاحِيَةٍ مِنَ الْحَائِطِ هِيَ أَقْرَبُ إِلَى أَرْضِهِ God bless you God willing, God willing, God willing, God willing, God willing, God willing. لِعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ بِتَحْوِيلِهِ ‏.‏. Having told me Malik from ['Amru bin Yahya Al Muzani] from [his father] he said; "In his grandfather's garden there was a small river belonging to Abdurrahman bin 'auf, then Abdurrahman bin 'auf wanted to move the small river to a corner of the garden so that it was closer to his land. But the owner of the garden forbade him. Abdurrahman bin 'auf complained about this to [Umar bin Khattab], then Umar gave the decision that Abdurrahman bin 'auf could move it (Degree: authentic. Source: Muwatta Malik no. 1435.) 24th Hadith. God willing God willing, God willing, God willing, God willing may Allah bless him and give him peace and blessings God willing وَأَيُّمَا دَارٍ أَوْ أَرْضٍ أَدْرَكَهَا الإِسْلاَمُ وَلَمْ تُقْسَمْ فَهِيَ عَلَى قَسْمِ الإِسْلاَمِ ‏"‏ ‏.‏ قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ فِيمَنْ هَلَكَ وَتَرَكَ God willing, God willing, God willing, God willing يُقْسَمُ مَعَ النَّضْحِ إِلاَّ أَنْ يَرْضَى أَهْلُهُ بِذَلِكَ وَإِنَّ الْبَعْلَ يُقْسَمُ مَعَ الْعَيْنِ إِذَا كَانَ بِأَرْضٍ God bless you كُلُّ مَالٍ مِنْهَا ثُمَّ يُقْسَمُ بَيْنَهُمْ وَالْمَسَاكِنُ وَالدُّورُ بِهَذِهِ الْمَنْزِلَةِ ‏.‏. Yahya has told me from Malik from [Tsaur bin Zaid Ad Dili] That he said; "It has come to me that Rasulullah salla Allahu 'alaihi wa sallam said: "Any house or land that was divided during the jahiliyah period was on the basis of jahiliyah division, and any house or land after the arrival of Islam and has not been divided, then the division must be based on Islam (Degree: authentic. God bless you may Allah bless him and give him peace and blessings لِلْبَرَاءِ بْنِ عَازِبٍ دَخَلَتْ حَائِطَ رَجُلٍ فَأَفْسَدَتْ God willing may Allah bless him and give him peace of mind God willing, God willing, God willing, God willing, God willing ‏.‏. It has been told to me that Yahya from Malik from [Ibn Shihab] from [Haram bin Sa'd bin Muhaishah] said, "Bara bin 'Azib's camel entered someone's garden and damaged it, then the Messenger of Allah salla Allahu 'alaihi wa sallam decided that the owner of the fence should guard it during the day, while the damage done by the animal at night, the owner of the animal is responsible for it (Degree: authentic. Source: Muwatta Malik no. 1437.) Hadits ke-26. وَحَدَّثَنِي مَالِكٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ يَحْيَى بْنِ عَبْدِ الرَّحْمَنِ بْنِ حَاطِبٍ، أَنَّ رَقِيقًا، لِحَاطِبٍ سَرَقُوا نَاقَةً لِرَجُلٍ مِنْ مُزَيْنَةَ فَانْتَحَرُوهَا فَرُفِعَ ذَلِكَ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَأَمَرَ عُمَرُ كَثِيرَ بْنَ الصَّلْتِ أَنْ يَقْطَعَ أَيْدِيَهُمْ ثُمَّ قَالَ عُمَرُ أَرَاكَ تُجِيعُهُمْ ‏.‏ ثُمَّ قَالَ عُمَرُ وَاللَّهِ لأُغَرِّمَنَّكَ غُرْمًا يَشُقُّ عَلَيْكَ ثُمَّ قَالَ لِلْمُزَنِيِّ كَمْ ثَمَنُ نَاقَتِكَ فَقَالَ الْمُزَنِيُّ قَدْ كُنْتُ وَاللَّهِ أَمْنَعُهَا مِنْ أَرْبَعِمِائَةِ دِرْهَمٍ ‏.‏ فَقَالَ عُمَرُ أَعْطِهِ ثَمَانَمِائَةِ دِرْهَمٍ ‏.‏ قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ وَلَيْسَ عَلَى هَذَا الْعَمَلُ عِنْدَنَا فِي تَضْعِيفِ الْقِيمَةِ وَلَكِنْ مَضَى أَمْرُ النَّاسِ عِنْدَنَا عَلَى أَنَّهُ إِنَّمَا يَغْرَمُ الرَّجُلُ قِيمَةَ الْبَعِيرِ أَوِ الدَّابَّةِ يَوْمَ يَأْخُذُهَا ‏.‏. Telah menceritakan kepadaku Malik dari [Hisyam bin 'Urwah] dari [Bapaknya] dari [Yahya bin Abdurrahman bin Hathib] bahwa budak milik Hatib mencuri seekor unta milik seorang dari Muzainah dan menyembelihnya. Hal itu diadukan kepada Umar bin Khattab, kemudian [Umar bin Khattab] menyuruh Katsir bin Shalt memotong tangan mereka. setelah itu Umar berkata; "Kulihat kamu sengaja membuat mereka lapar?" Demi Allah aku akan mendendamu dengan denda yang berat." Umar lalu berkata kepada orang yang untanya dicuri, "Berapa harga untamu?" dia menjawab; "Demi Allah, saat untaku ditawar empat ratus dirham aku tidak membolehkannya." Umar lalu berkata; "Bayarlah seharga delapan ratus dirham (Derajat: shahih. Sumber: Muwatta Malik no. 1438.) Hadits ke-27. حَدَّثَنَا يَحْيَى، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، وَعَنْ مُحَمَّدِ بْنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّهُمَا حَدَّثَاهُ عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، أَنَّهُ قَالَ إِنَّ أَبَاهُ بَشِيرًا أَتَى بِهِ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلاَمًا كَانَ لِي ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَكُلَّ وَلَدِكَ نَحَلْتَهُ مِثْلَ هَذَا ‏"‏ ‏.‏ فَقَالَ لاَ ‏.‏ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ فَارْتَجِعْهُ ‏"‏ ‏.‏. Telah menceritakan kepada kami Yahya dari Malik dari [Ibnu Syihab] dari [Humaid bin Abdurrahman bin Auf] dan dari [Muhammad bin Nu'man bin Basyir] bahwa keduanya menceritakan kepadanya, dari [Nu'man bin Basyir] ia mengatakan bahwa bapaknya, Basyir, membawa dirinya datang menemui Rasulullah shallallahu 'alaihi wasallam dan berkata, "Saya telah memberi anakku seorang pelayan." Rasulullah Shalla Allahu 'alaihi wa sallam lantas bertanya: "Apakah setiap anakmu telah kamu beri juga?" dia menjawab; "Tidak." Rasulullah Shalla Allahu 'alaihi wa sallam bersabda: "Kalau begitu, ambil kembali pemberian itu (Derajat: shahih. Sumber: Muwatta Malik no. 1439.) Hadits ke-28. وَحَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، عَنْ عَائِشَةَ، زَوْجِ النَّبِيِّ صلى الله عليه وسلم أَنَّهَا قَالَتْ إِنَّ أَبَا بَكْرٍ الصِّدِّيقَ كَانَ نَحَلَهَا جَادَّ عِشْرِينَ وَسْقًا مِنْ مَالِهِ بِالْغَابَةِ فَلَمَّا حَضَرَتْهُ الْوَفَاةُ قَالَ وَاللَّهِ يَا بُنَيَّةُ مَا مِنَ النَّاسِ أَحَدٌ أَحَبُّ إِلَىَّ غِنًى بَعْدِي مِنْكِ وَلاَ أَعَزُّ عَلَىَّ فَقْرًا بَعْدِي مِنْكِ وَإِنِّي كُنْتُ نَحَلْتُكِ جَادَّ عِشْرِينَ وَسْقًا فَلَوْ كُنْتِ جَدَدْتِيهِ وَاحْتَزْتِيهِ كَانَ لَكِ وَإِنَّمَا هُوَ الْيَوْمَ مَالُ وَارِثٍ وَإِنَّمَا هُمَا أَخَوَاكِ وَأُخْتَاكِ فَاقْتَسِمُوهُ عَلَى كِتَابِ اللَّهِ ‏.‏ قَالَتْ عَائِشَةُ فَقُلْتُ يَا أَبَتِ وَاللَّهِ لَوْ كَانَ كَذَا وَكَذَا لَتَرَكْتُهُ إِنَّمَا هِيَ أَسْمَاءُ فَمَنِ الأُخْرَى فَقَالَ أَبُو بَكْرٍ ذُو بَطْنِ بِنْتِ خَارِجَةَ ‏.‏ أُرَاهَا جَارِيَةً ‏.‏. Telah menceritakan kepadaku Malik dari [Ibnu Syihab] dari ['Urwah bin Az Zubair] dari [Aisyah] isteri Nabi Shalla Allahu 'alaihi wa sallam, ia mengatakan bahwa [Abu bakar Ash Shiddiq] telah memberinya dua puluh wasaq (enam puluh sha') dari dari harta miliknya di wilayah Ghabah. Ketika Abu Bakar mendekati ajalnya, dia berkata; "Wahai anakku! Demi Allah, tidak ada seorangpun yang saya senangi untuk menjadi kaya setelahku kecuali dirimu. Tidak ada orang yang susah kefakirannya setelahku dari kamu. Saya telah memberimu dua puluh wasaq (kurma) dari hartaku, sekiranya kamu telah memanen dan mengumpulkannya, maka itu menjadi milikmu. Namun hari ini, harta itu menjadi harta warisan. Berilah dua saudara laki-lakimu dan dua saudarimu, bagilah atas dasar Kitabullah." Aisyah berkata; "Wahai ayahku! Demi Allah, jika terjadi ini dan itu (kematianmu), sungguh aku akan meninggalkan kepemnilikanku itu. Saudaraku adalah Asma, lalu siapa lagi yang harus aku perhatikan?" Abu Bakar berkata; "Kandungan yang ada dalam perut binti Kharijah, saya lihat dia seorang budak wanita (tanggunganku) (Derajat: shahih. Sumber: Muwatta Malik no. 1440.) Hadits ke-29. وَحَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَبْدٍ الْقَارِيِّ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، قَالَ مَا بَالُ رِجَالٍ يَنْحَلُونَ أَبْنَاءَهُمْ نُحْلاً ثُمَّ يُمْسِكُونَهَا فَإِنْ مَاتَ ابْنُ أَحَدِهِمْ قَالَ مَالِي بِيَدِي لَمْ أُعْطِهِ أَحَدًا ‏.‏ وَإِنْ مَاتَ هُوَ قَالَ هُوَ لاِبْنِي قَدْ كُنْتُ أَعْطَيْتُهُ إِيَّاهُ ‏.‏ مَنْ نَحَلَ نِحْلَةً فَلَمْ يَحُزْهَا الَّذِي نُحِلَهَا - حَتَّى يَكُونَ إِنْ مَاتَ لِوَرَثَتِهِ - فَهِيَ بَاطِلٌ ‏.‏. Telah menceritakan kepadaku Malik dari [Ibnu Syihab] dari ['Urwah bin Az Zubair] dari [Abdurrahman bin Abdulqari] bahwa [Umar bin Khattab] berkata; "Kenapa kaum lelaki memberi sesuatu kepada anak-anaknya kemudian memintanya kembali, jika kemudian salah seorang dari mereka meninggal?" Ia mengatakan, 'Harta yang ada di tanganku ini belum pernah aku berikan kepada seorang pun'. Tetapi ketika anak tersebut telah meninggal ia berkata, 'Harta itu milik anakku, aku telah memberikan kepadanya'. Berhati-hatilah (yang melakukan hal ini), barangsiapa memberi sesuatu pemberian, lalu pemberian itu belum diterima oleh si penerima sehingga ia meninggal, maka tidak sah jika harta itu menjadi warisan (Derajat: shahih. Sumber: Muwatta Malik no. 1441.) Hadits ke-30. حَدَّثَنِي مَالِكٌ، عَنْ دَاوُدَ بْنِ الْحُصَيْنِ، عَنْ أَبِي غَطَفَانَ بْنِ طَرِيفٍ الْمُرِّيِّ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، قَالَ مَنْ وَهَبَ هِبَةً لِصِلَةِ رَحِمٍ أَوْ عَلَى وَجْهِ صَدَقَةٍ فَإِنَّهُ لاَ يَرْجِعُ فِيهَا وَمَنْ وَهَبَ هِبَةً يَرَى أَنَّهُ إِنَّمَا أَرَادَ بِهَا الثَّوَابَ فَهُوَ عَلَى هِبَتِهِ يَرْجِعُ فِيهَا إِذَا لَمْ يُرْضَ مِنْهَا ‏.‏ قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ الْهِبَةَ إِذَا تَغَيَّرَتْ عِنْدَ الْمَوْهُوبِ لَهُ لِلثَّوَابِ بِزِيَادَةٍ أَوْ نُقْصَانٍ فَإِنَّ عَلَى الْمَوْهُوبِ لَهُ أَنْ يُعْطِيَ صَاحِبَهَا قِيمَتَهَا يَوْمَ قَبَضَهَا ‏.‏. Telah menceritakan kepadaku Malik dari [Daud bin Al Hushain] dari [Abu Ghatafan bin Tharif Al Mari] bahwa [Umar bin Khattab] berkata; "Barangsiapa memberi sebuah pemberian untuk menyambung silaturahim, atau untuk tujuan sedekah, maka dia tidak boleh menariknya kembali. Barangsiapa memberi suatu pemberian, dengannya dia mengharap pahala, maka dia boleh menariknya kembali jika dia tidak ridla dengan hibah tersebut (Derajat: shahih. Sumber: Muwatta Malik no. 1442.) Hadits ke-31. حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ الأَنْصَارِيِّ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي يُعْطَاهَا لاَ تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا أَبَدًا ‏"‏ ‏.‏ لأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ ‏.‏. Telah menceritakan kepadaku Malik dari [Ibnu Syihab] dari [Abu Salamah bin Abdurrahman bin Auf] dari [Jabir bin Abdullah Al Anshari] bahwa Rasulullah Shalla Allahu 'alaihi wa sallam bersabda: "Siapa saja yang diberi tempat tinggal untuk dirinya maupun keturunannya, maka hal itu menjadi milik si penerima, dan selamanya tidak bisa kembali kepada si pemberi. Karena dia telah memberi pemberian yang ada hak pewarisan di dalamnya (Derajat: shahih. Sumber: Muwatta Malik no. 1443.) Hadits ke-32. وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، أَنَّهُ سَمِعَ مَكْحُولاً الدِّمَشْقِيَّ، يَسْأَلُ الْقَاسِمَ بْنَ مُحَمَّدٍ عَنِ الْعُمْرَى، وَمَا يَقُولُ النَّاسُ فِيهَا فَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ مَا أَدْرَكْتُ النَّاسَ إِلاَّ وَهُمْ عَلَى شُرُوطِهِمْ فِي أَمْوَالِهِمْ وَفِيمَا أُعْطُوا ‏.‏ قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ وَعَلَى ذَلِكَ الأَمْرُ عِنْدَنَا أَنَّ الْعُمْرَى تَرْجِعُ إِلَى الَّذِي أَعْمَرَهَا إِذَا لَمْ يَقُلْ هِيَ لَكَ وَلِعَقِبِكَ ‏.‏. Telah menceritakan kepadaku Malik dari [Yahya bin Sa'id] dari [Abdurrahman bin Al Qasim] bahwa dia mendengar Makhul Ad Dimasyqi bertanya kepada [Al Qasim bin Muhammad] tentang 'umra dan pendapat orang-orang tentangnya, maka Al Qasim bin Muhammad berkata; "Tidak ada yang saya temui kecuali meraka dalam kesepakatannya dalam (perkara) harta dan apa yang telah mereka berikan (Derajat: shahih. Hadits ke-33. وَحَدَّثَنِي مَالِكٌ، عَنْ نَافِعٍ، ‏.‏ أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ، وَرِثَ مِنْ حَفْصَةَ بِنْتِ عُمَرَ دَارَهَا قَالَ وَكَانَتْ حَفْصَةُ قَدْ أَسْكَنَتْ بِنْتَ زَيْدِ بْنِ الْخَطَّابِ مَا عَاشَتْ فَلَمَّا تُوُفِّيَتْ بِنْتُ زَيْدٍ قَبَضَ عَبْدُ اللَّهِ بْنُ عُمَرَ الْمَسْكَنَ وَرَأَى أَنَّهُ لَهُ ‏.‏. Telah menceritakan kepadaku Malik dari [Nafi'] bahwa [Abdullah bin Umar] mewarisi rumah Hafshah binti Umar. Nafi' berkata; "Hafshah telah memberikan hak penempatan kepada anak perempuan Zaid bin Khattab selama dia masih hidup. Tatkala anak perempuan Zaid wafat, Abdullah bin Umar menahan rumah itu dan dia berpendapat bahwa rumah tersebut adalah miliknya (Derajat: shahih. Sumber: Muwatta Malik no. 1445.) Hadits ke-34. حَدَّثَنِي مَالِكٌ، عَنْ رَبِيعَةَ بْنِ أَبِي عَبْدِ الرَّحْمَنِ، عَنْ يَزِيدَ، مَوْلَى الْمُنْبَعِثِ عَنْ زَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّهُ قَالَ جَاءَ رَجُلٌ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَهُ عَنِ اللُّقَطَةِ ‏.‏ فَقَالَ ‏"‏ اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلاَّ فَشَأْنَكَ بِهَا ‏"‏ ‏.‏ قَالَ فَضَالَّةُ الْغَنَمِ يَا رَسُولَ اللَّهِ قَالَ ‏"‏ هِيَ لَكَ أَوْ لأَخِيكَ أَوْ لِلذِّئْبِ ‏"‏ ‏.‏ قَالَ فَضَالَّةُ الإِبِلِ قَالَ ‏"‏ مَا لَكَ وَلَهَا مَعَهَا سِقَاؤُهَا وَحِذَاؤُهَا تَرِدُ الْمَاءَ وَتَأْكُلُ الشَّجَرَ حَتَّى يَلْقَاهَا رَبُّهَا ‏"‏ ‏.‏. Telah menceritakan kepadaku Malik dari [Rabi'ah bin Abu Abdurrahman] dari [Yazid] budak Al Munba'its, dari [Zaid bin Khalid AL Juhani] ia berkata; "Seorang laki-laki menemui Rasulullah shallallahu 'alaihi wasallam bertanya tentang Luqathah (barang temuan), beliau lalu bersabda: 'Kenalilah tutup dan talinya, lalu umumkan selama satu tahun. Jika pemiliknya datang maka berikanlah, dan jika tidak maka itu menjadi milikmu." laki-laki itu bertanya lagi, "Wahai Rasulullah, bagaimana dengan kambing yang tersesat?" Beliau menjawab: "Kambing itu untukmu, atau untuk saudaramu, atau untuk serigala." Laki-laki itu bertanya lagi; "Bagaimana dengan unta yang tersesat? ' beliau menjawab: "Apa urusanmu dengan unta, ia bisa minum dan punya kaki! Ia akan mencari minum dan makannya sendiri hingga bertemu dengan pemiliknya (Derajat: shahih. Hadits ke-35. وَحَدَّثَنِي مَالِكٌ، عَنْ أَيُّوبَ بْنِ مُوسَى، عَنْ مُعَاوِيَةَ بْنِ عَبْدِ اللَّهِ بْنِ بَدْرٍ الْجُهَنِيِّ، أَنَّ أَبَاهُ، أَخْبَرَهُ أَنَّهُ، نَزَلَ مَنْزِلَ قَوْمٍ بِطَرِيقِ الشَّامِ فَوَجَدَ صُرَّةً فِيهَا ثَمَانُونَ دِينَارًا فَذَكَرَهَا لِعُمَرَ بْنِ الْخَطَّابِ فَقَالَ لَهُ عُمَرُ عَرِّفْهَا عَلَى أَبْوَابِ الْمَسَاجِدِ وَاذْكُرْهَا لِكُلِّ مَنْ يَأْتِي مِنَ الشَّأْمِ سَنَةً فَإِذَا مَضَتِ السَّنَةُ فَشَأْنَكَ بِهَا ‏.‏. Telah menceritakan kepadaku Malik dari [Ayyub bin Musa] dari [Mu'awiyah bin Abdullah bin Badr Al Juhani] bahwa [Bapaknya] mengabarkan kepadanya, bahwa ia pernah mampir di suatu kaum dalam perjalanan ke Syam. Lalu dia mendapatkan sebuah kantong berisi delapan puluh dinar, ia pun memberitahukan hal itu kepada Umar bin Khattab. [Umar] lalu berkata, "Umumkan di pintu-pintu masjid dan beritahukan kepada siapa saja yang datang dari Syam selama setahun. Jika telah lewat satu tahun terserah kamu (Derajat: shahih. Hadits ke-36. وَحَدَّثَنِي مَالِكٌ، عَنْ نَافِعٍ، أَنَّ رَجُلاً، وَجَدَ لُقَطَةً فَجَاءَ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ فَقَالَ لَهُ إِنِّي وَجَدْتُ لُقَطَةً فَمَاذَا تَرَى فِيهَا فَقَالَ لَهُ عَبْدُ اللَّهِ بْنُ عُمَرَ عَرِّفْهَا ‏.‏ قَالَ قَدْ فَعَلْتُ ‏.‏ قَالَ زِدْ ‏.‏ قَالَ قَدْ فَعَلْتُ ‏.‏ فَقَالَ عَبْدُ اللَّهِ لاَ آمُرُكَ أَنْ تَأْكُلَهَا وَلَوْ شِئْتَ لَمْ تَأْخُذْهَا ‏.‏. Telah menceritakan kepadaku Malik dari [Nafi'] berkata, "Seorang laki-laki menemukan sebuah barang, lalu dia menemui Abdullah bin Umar seraya berkata; "Saya menemukan sebuah barang, bagaimana pendapatmu?" [Abdullah bin Umar] menjawab; "Umumkan! " Laki-laki itu berkata; "Sudah saya lakukan." Abdullah berkata, "Lakukan lagi." Laki-laki itu berkata, "Sudah saya lakukan." Abdullah berkata; "Saya tidak menyuruhmu untuk memakannya, jika mau maka janganlah kamu ambil (Derajat: shahih. Sumber: Muwatta Malik no. 1448.) Hadits ke-37. وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ ثَابِتَ بْنَ الضَّحَّاكِ الأَنْصَارِيَّ، أَخْبَرَهُ ‏.‏ أَنَّهُ، وَجَدَ بَعِيرًا بِالْحَرَّةِ فَعَقَلَهُ ثُمَّ ذَكَرَهُ لِعُمَرَ بْنِ الْخَطَّابِ فَأَمَرَهُ عُمَرُ أَنْ يُعَرِّفَهُ ثَلاَثَ مَرَّاتٍ فَقَالَ لَهُ ثَابِتٌ إِنَّهُ قَدْ شَغَلَنِي عَنْ ضَيْعَتِي ‏.‏ فَقَالَ لَهُ عُمَرُ أَرْسِلْهُ حَيْثُ وَجَدْتَهُ ‏.‏. Telah menceritakan kepadaku Malik dari [Yahya bin Sa'id] dari [Sulaiman bin Yasar] bahwa [Tsabit bin Dlahak Al Anshari] mengabarkan kepadanya, bahwa ia pernah mendapat seekor unta yang terlepas di suatu tempat, lalu dia mengikatnya dan melaporkannya kepada [Umar bin Khattab] . Umar lalu menyuruhnya untuk mengumumkannya tiga kali. Tsabit berkata; "Hal itu telah menyibukkanku hingga aku tidak bisa mengurus ladangku." Umar pun berkata, "Lepaskanlah unta itu ke tempat di mana kamu mendapatkannya (Derajat: shahih. Sumber: Muwatta Malik no. 1449.) Hadits ke-38. وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، قَالَ وَهُوَ مُسْنِدٌ ظَهْرَهُ إِلَى الْكَعْبَةِ مَنْ أَخَذَ ضَالَّةً فَهُوَ ضَالٌّ ‏.‏. Telah menceritakan kepadaku Malik dari [Yahya bin Sa'id] dari [Sa'id bin Musayyab] bahwa [Umar bin Khattab] berkata dengan menyandarkan pungungnya ke Ka'bah, "Barangsiapa mengambil hewan yang tersesat maka dia telah sesat (Derajat: shahih. Hadits ke-39. وَحَدَّثَنِي مَالِكٌ، أَنَّهُ سَمِعَ ابْنَ شِهَابٍ، يَقُولُ كَانَتْ ضَوَالُّ الإِبِلِ فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ إِبِلاً مُؤَبَّلَةً تَنَاتَجُ لاَ يَمَسُّهَا أَحَدٌ حَتَّى إِذَا كَانَ زَمَانُ عُثْمَانَ بْنِ عَفَّانَ أَمَرَ بِتَعْرِيفِهَا ثُمَّ تُبَاعُ فَإِذَا جَاءَ صَاحِبُهَا أُعْطِيَ ثَمَنَهَا ‏.‏. Telah menceritakan kepadaku Malik bahwa dia mendengar [Ibnu Syihab] berkata; "Unta yang tersesat pada masa Umar bin Khattab amat banyak, bahkan sampai berkembang biak dan tidak ada seorang pun mengambilnya. Sementara masa [Utsman bin Affan], setelah dikenali ciri-cirinya dia memerintahkan untuk menjualnya, jika pemiliknya datang maka uang penjualan tersebut diberikan kepadanya (Derajat: shahih. Hadits ke-40. حَدَّثَنِي مَالِكٌ، عَنْ سَعِيدِ بْنِ عَمْرِو بْنِ شُرَحْبِيلَ بْنِ سَعِيدِ بْنِ سَعْدِ بْنِ عُبَادَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّهُ قَالَ خَرَجَ سَعْدُ بْنُ عُبَادَةَ مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم فِي بَعْضِ مَغَازِيهِ فَحَضَرَتْ أُمَّهُ الْوَفَاةُ بِالْمَدِينَةِ فَقِيلَ لَهَا أَوْصِي ‏.‏ فَقَالَتْ فِيمَ أُوصِي إِنَّمَا الْمَالُ مَالُ سَعْدٍ ‏.‏ فَتُوُفِّيَتْ قَبْلَ أَنْ يَقْدَمَ سَعْدٌ فَلَمَّا قَدِمَ سَعْدُ بْنُ عُبَادَةَ ذُكِرَ ذَلِكَ لَهُ فَقَالَ سَعْدٌ. Telah menceritakan kepadaku Malik dari [Sa'id bin 'Amru bin Syurahbil bin Sa'id bin Sa'ad bin 'Ubadah] dari [Bapaknya] dari [kakeknya] berkata; "Saad bin 'Ubadah keluar bersama Rasulullah Shalla Allahu 'alaihi wa sallam pada beberapa peperangan. Sementara Ibunya yang berada di Madinah mendekati ajalnya, lalu dikatakanlah kepada ibu tersebut, "Berwasiatlah." Ibunya lalu berkata; 'Sesungguhnya harta itu adalah milik Sa'd." kemudian dia meninggal sebelum Sa'd sampai di Madinah. Ketika Sa'd bin Ubadah tiba, maka hal itu diberitahukan kepadanya. Sa'd pun berkata, "Wahai Rasulullah, apakah jika saya sedekahkan harta itu akan memberi manfaat pada ibuku?" Rasulullah Shalla Allahu 'alaihi wa sallam menjawab: "Ya."
