It has been told to me from Malik from [Yahya bin Sa'id] that Marwan bin Al Hakam wrote a letter to [Mu'awiyah bin Abu Sufyan], that he was once confronted by a madman who had killed someone. So Mu'awiyah answered; "Tie him up and do not respond to him according to his actions, because a madman cannot be qishas (Degree: authentic. Source: Muwatta Malik no. 1555.) 2nd hadith. It has been told to me by Yahya from Malik from [Ibn Shihab] from ['Iraq bin Malik] and [Sulaiman bin Yasar] that someone from Bani Said bin Laith rode a horse and stepped on someone from Juhainah's toes until they broke off and died. Then [Umar bin Khattab] said to the defendants; 'Are you willing to swear in the name of Allah fifty times, that he will not die because of it? ' they refused and felt heavy." Then Umar asked the others; 'Will you swear? ' they were reluctant. Then Umar bin Khattab decided to pay half a diyat to the people of Bani Said. It has been told to me Malik from [Ibnu Shihab] that it has come to him from ['Urwah bin Az Zubair] that both of them are of the same opinion as Sa'id bin Musayyab's opinion about women paying a third of a diyat over men, if it reaches a third of a man's diyat then it increases to half. Malik said; "The interpretation of this is that the woman pays diyat for wounds that show the bones, or for wounds that cause the bones to break, or wounds that do not penetrate the bones of the head or stomach, or the like, then it is still a third of a diyat more, if it exceeds this then she pays half of the diyat of a man (Degree: authentic.
