✍️ Syaikh Ibnu Qasim Al-Ghazi — died 918H

The famous sharah of Al-Ghayah wat Taqrib by Shaykh Ibnu Qasim Al-Ghazi (d. 918 AH), explains the Syafi'i school of jurisprudence in a complete and orderly manner. Discusses all chapters of worship and muamalah: thaharah, prayer, zakat, fasting, hajj, buying and selling, inheritance, marriage, jinayah, and justice. Became the middle level of Islamic boarding school fiqh after Safinah and Sullam Taufiq.

Chapter 1: Marriage & Buyu'

النِّكَاحُ وَالْبُيُوعُ

Marriage Law & 5 Legal Conditions

حُكْمُ النِّكَاحِ وَشُرُوطُهُ

النِّكَاحُ مُسْتَحَبٌّ لِمَنِ اشْتَاقَ وَلَمْ يَخَفِ الْجَوْرَ، وَوَاجِبٌ لِمَنْ خَافَ الزِّنَا. وَيَصِحُّ بِخَمْسَةِ شُرُوطٍ: مَعْرِفَةُ الزَّوْجَيْنِ، رِضَاهُمَا، وَلِيٌّ، شَاهِدَانِ عَدْلَانِ، صِيغَةٌ.

Translation

Sunnah marriage is for those who desire and are not worried about wrongdoing. Mandatory for those who are worried about committing adultery. Valid with 5 conditions: (1) Know the identity of husband and wife, (2) Consent to both, (3) Guardian, (4) Two fair witnesses, (5) Shighat consent.

Commentary

A guardian is mandatory in the Shafi'i madhhab — a marriage without a guardian is invalid. Order of guardians: father > grandfather > brother > uncle > guardian judge. Shighat must use the word 'zawwajtu' or 'ankahtuka' from the guardian and 'qabiltu' from the groom.

Buying and Selling Pillars (3) & Conditions

أَرْكَانُ الْبَيْعِ

أَرْكَانُ الْبَيْعِ ثَلَاثَةٌ: عَاقِدٌ، مَعْقُودٌ عَلَيْهِ، صِيغَةٌ. وَيُشْتَرَطُ فِي الْمَعْقُودِ عَلَيْهِ: الطَّهَارَةُ، وَالنَّفْعُ، وَالْقُدْرَةُ عَلَى التَّسْلِيمِ، وَمِلْكُ الْبَائِعِ.

Translation

Pillars of buying and selling 3: (1) Aqid (seller-buyer), (2) Ma'qud 'alaih (goods), (3) Shighat. Item requirements: pure, useful, can be handed over, belongs to the seller.

Commentary

Items that cannot be sold: unclean (khamr, pork), cannot be handed over, nature unknown. Elements that prohibit buying and selling: riba (interest/additional), gharar (big uncertainty), and maysir (gambling).
