هذه دراسات في التشريع الجنائي الإسلامي مقارنة بالقوانين الوضعية، تقوم على بحث المبادئ والنظريات العامة في الشريعة والقوانين، وبيان وجوه الخلاف والوفاق بينهما. يهدف المؤلف إلى إظهار محاسن الشريعة وتفوقها على القوانين الوضعية، وبيان المبادئ الإنسانية والنظريات العلمية والاجتماعية التي لم يعرفها العالم ولم يهتد إليها العلماء إلا أخيراً. يركز المؤلف على المقارنة الشاملة بين الشريعة والقوانين الوضعية، ويشمل الجزء الأول من الكتاب مباحث القسم الجنائي العام، في حين سيشمل الجزء الثاني مباحث القسم الجنائي الخاص.
Translation
These are studies in Islamic criminal legislation compared to positive laws, based on examining general principles and theories in Sharia and laws, and explaining the areas of disagreement and agreement between them. The author aims to show the virtues of Sharia law and its superiority over man-made laws, and to explain humanitarian principles and scientific and social theories that the world did not know and to which scholars only recently found their way. The author focuses on the comprehensive comparison between Sharia law and man-made laws. The first part of the book includes topics in the general criminal section, while the second part will include topics in the special criminal section.
