يستعرض الكتاب موضوع الجنايات في الفقه الإسلامي من منظور مقارن مع القوانين الوضعية، مسلطًا الضوء على تعريف الجريمة وأركانها وعقوبتها. ويتناول الفصل الأول جريمة القتل العمد وشبه العمد مستندًا إلى آراء الفقهاء ومقارنتهما بالأحكام القانونية. ومن خلال هذا الإطار يسعى المؤلف إلى إظهار كيفية تطبيق الشريعة في معالجة القضايا الجنائية وتقديم حلول مستندة إلى التراث الإسلامي.
Translation
The book reviews the subject of crimes in Islamic jurisprudence from a comparative perspective with positive laws, highlighting the definition of the crime, its elements, and its punishment. The first chapter deals with the crime of intentional and semi-intentional murder, based on the opinions of jurists and comparing them with legal provisions. Through this framework, the author seeks to show how to apply Sharia law in dealing with criminal cases and provide solutions based on Islamic heritage.
