Welcome to the study of authentic hadith selected by ULYAH. Let's look at some of the following sayings of the Prophet sallallaahu 'alaihi wa sallam, one by one, with an open heart to put them into practice. 1st Hadith. حَدَّثَنَا أَبُو خَيْثَمَةَ مُصْعَبُ بْنُ سَعِيدٍ الْحَرَّانِيُّ حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ عَنْ الْأَشْعَثِ عَنْ الْحَسَنِ فِي رَجُلٍ هَلَكَ وَتَرَكَ ابْنَيْنِ وَتَرَكَ أَلْفَيْ دِرْهَمٍ فَاقْتَسَمَا الْأَلْفَيْ دِرْهَمٍ وَغَابَ أَحَدُ الِابْنَيْنِ فَجَاءَ رَجُلٌ فَاسْتَحَقَّ عَلَى الْمَيِّتِ أَلْفَ دِرْهَمٍ قَالَ يَأْخُذُ جَمِيعَ مَا فِي يَدِ هَذَا الشَّاهِدِ وَيُقَالُ لَهُ اتَّبِعْ أَخَاكَ الْغَائِبَ وَخُذْ نِصْفَ مَا فِي يَدِهِ. Has told us [Abu Khaitsamah Mush'ab bin Sa'id Al Harrani] has told us [Muhammad bin Abdullah] from [Al Asy'ats] from [Al Hasan] about someone who died and left two sons and assets worth two thousand dirhams. The two of them agreed to divide two thousand dirhams and one of them left. Then someone came and demanded a debt from the deceased worth a thousand dirhams. He said; He may take all that is in the hands of the boy who is in the place and said to him; Look for your brother who left and take half of what is in his hand. (Degree: authentic. Source: Sunan Ad-Darimi.) 2nd hadith. حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ عَنْ حَمَّادِ بْنِ سَلَمَةَ عَنْ زِيَادٍ الْأَعْلَمِ عَنْ الْحَسَنِ قَالَ إِذَا أَقَرَّ بَعْضُ الْوَرَثَةِ بِدَيْنٍ فَهُوَ عَلَيْهِ بِحِصَّتِهِ. Has told us [Sulaiman bin Harb] from [Hammad bin Salamah] from [Ziyad Al A'lam] from [Al Hasan] he said; If some of the heirs confirm that the deceased has a debt, then the heirs must pay it off. (Degree: authentic. Source: Sunan Ad-Darimi.) 3rd Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا ثَابِتُ بْنُ الْوَلِيدِ بْنِ جُمَيْعٍ قَالَ أَخْبَرَنِي أَبِي عَنْ الْقَاسِمِ بْنِ عَبْدِ الرَّحْمَنِ قَالَ كَانَ ابْنُ مَسْعُودٍ يُوَرِّثُ أَهْلَ الْمُرْتَدِّ إِذَا قُتِلَ. Has told us [Muhammad bin Isa] has told us [Thabit bin Al Walid bin Jumai'] he said; has informed us [my father] from [Al Qasim bin Abdur Rahman] he said; [Ibn Mas'ud] gave inheritance rights to the heirs of an apostate if he was killed. (Degree: authentic. Source: Sunan Ad-Darimi.) 4th Hadith. حَدَّثَنَا الْحَجَّاجُ بْنُ مِنْهَالٍ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ الْأَعْمَشِ عَنْ أَبِي عَمْرٍو الشَّيْبَانِيِّ أَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ جَعَلَ مِيرَاثَ الْمُرْتَدِّ لِوَرَثَتِهِ مِنْ الْمُسْلِمِينَ. It has been told to us [Al Hajjaj bin Minhal] has told us [Abu 'Awanah] from [Al A'masy] from [Abu Amr Asy Syaibani] that [Ali bin Abu Talib] made the inheritance of the apostates for his heirs from the muslimin people. (Degree: authentic. Source: Sunan Ad-Darimi.) 5th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا الْحَجَّاجُ عَنْ الْحَكَمِ أَنَّ عَلِيًّا قَضَى فِي مِيرَاثِ الْمُرْتَدِّ لِأَهْلِهِ مِنْ الْمُسْلِمِينَ. It has been reported to us [Yazid bin Harun] has told us [Al Hajjaj] from [Al Hakam] that [Ali] decided the inheritance of the apostates for his family from the muslimin people. (Degree: authentic. Source: Sunan Ad-Darimi.) 6th Hadith. حَدَّثَنَا زَكَرِيَّا بْنُ عَدِيٍّ حَدَّثَنَا عُبَيْدُ اللَّهِ هُوَ ابْنُ عَمْرٍو عَنْ عَبْدِ الْكَرِيمِ عَنْ الْحَكَمِ قَالَ إِذَا قَتَلَ الرَّجُلُ أَخَاهُ عَمْدًا لَمْ يُوَرَّثْ مِنْ مِيرَاثِهِ وَلَا مِنْ دِيَتِهِ فَإِذَا قَتَلَهُ خَطَأً وُرِّثَ مِنْ مِيرَاثِهِ وَلَمْ يُوَرَّثْ مِنْ دِيَتِهِ قَالَ وَكَانَ عَطَاءٌ يَقُولُ ذَلِكَ. Has told us [Zakariya bin 'Adi] has told us [Ubaidullah] he is Ibn Amr, from [Abdul Karim] from [Al Hakam] he said; If a person kills his brother intentionally then he cannot inherit his inheritance nor his diyat. However, if he kills him accidentally then he can inherit his inheritance. But he cannot inherit his diyat. He said again; [Atha`] thinks like that. (Degree: authentic. Source: Sunan Ad-Darimi.) 7th Hadith. حَدَّثَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ سَعِيدٍ عَنْ قَتَادَةَ عَنْ خِلَاسٍ عَنْ عَلِيٍّ قَالَ رَمَى رَجُلٌ أُمَّهُ بِحَجَرٍ فَقَتَلَهَا فَطَلَبَ مِيرَاثَهُ مِنْ إِخْوَتِهِ فَقَالَ لَهُ إِخْوَتُهُ لَا مِيرَاثَ لَكَ فَارْتَفَعُوا إِلَى عَلِيٍّ فَجَعَلَ عَلَيْهِ الدِّيَةَ وَأَخْرَجَهُ مِنْ الْمِيرَاثِ. Has told us [Muhammad bin Uyainah] from [Ali bin Mushir] from [Sa'id] from [Qatadah] from [Khilas] from [Ali] he said; Someone threw a stone at his mother and killed her, then the person asked his brothers for an inheritance. His brothers also said to him; There is no inheritance for you. Then they complained about this matter to Ali, he decided that the person must pay diyat and be excluded from the inheritance. Source: Sunan Ad-Darimi.) 8th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا زُهَيْرٌ عَنْ الْحَسَنِ بْنِ الْحُرِّ عَنْ الْحَكَمِ أَنَّ الرَّجُلَ إِذَا قَتَلَ امْرَأَتَهُ خَطَأً أَنَّهُ يُمْنَعُ مِيرَاثَهُ مِنْ الْعَقْلِ وَغَيْرِهِ. It has been told to us [Abu Nu'aim] has told us [Zuhair] from [Al Hasan bin Al Hurr] from [Al Hakam] that if someone kills his wife accidentally then he cannot inherit either the diyat property or anything else. (Degree: authentic. Source: Sunan Ad-Darimi.) 9th Hadith. أَخْبَرَنَا أَبُو نُعَيْمٍ حَدَّثَنَا سُفْيَانُ عَنْ لَيْثٍ عَنْ مُجَاهِدٍ عَنْ ابْنِ عَبَّاسٍ قَالَ لَا يَرِثُ الْقَاتِلُ مِنْ الْمَقْتُولِ شَيْئًا. Has told us [Abu Nu'aim] has told us [Sufyan] from [Laits] from [Mujahid] from [Ibn Abbas] he said; The murderer cannot inherit any of the property of the murdered person. (Degree: authentic. Source: Sunan Ad-Darimi.) 10th Hadith. حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ عَنْ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنْ قَتَادَةَ فِي رَجُلٍ قَذَفَ امْرَأَتَهُ وَجَاءَ بِشُهُودٍ فَرُجِمَتْ قَالَ يَرِثُهَا. Has told us [Sa'id bin Al Mughirah] from [Ibn Al Mubarak] from [Ma'mar] from [Qatadah] about a man who accused his wife and he brought several witnesses and then his wife was stoned, he said; Husbands can inherit from their wives. (Degree: authentic. Source: Sunan Ad-Darimi.) 11th Hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ حَمَّادٍ فِي رَجُلٍ جُلِدَ الْحَدَّ أَرَاهُ مَاتَ شَكَّ أَبُو النُّعْمَانِ قَالَ يَتَوَارَثَانِ. Has told us [Abu An Nu'man] has told us [Abu 'Awanah] from [Hammad] about a man who was sentenced to lashing, I think he died, Abu An Nu'man was doubtful, he said; They can inherit from each other. (Degree: authentic. Source: Sunan Ad-Darimi.) 12th Hadith. حَدَّثَنَا أَبُو النُّعْمَانِ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ مُحَمَّدِ بْنِ سَالِمٍ عَنْ عَامِرٍ عَنْ عَلِيٍّ قَالَ الْقَاتِلُ لَا يَرِثُ وَلَا يَحْجُبُ. Has told us [Abu An Nu'man] has told us [Abu 'Awanah] from [Muhammad bin Salim] from [Amir] from [Ali] he said; Murderers cannot inherit and cannot hinder the distribution of inheritance. (Degree: authentic. Source: Sunan Ad-Darimi.) 13th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ حَدَّثَنَا حَسَنٌ عَنْ لَيْثٍ عَنْ أَبِي عَمْرٍو الْعَبْدِيِّ عَنْ عَلِيٍّ قَالَ لَا يُوَرَّثُ الْقَاتِلُ. Has told us [Abu Nu'aim] has told us [Hasan] from [Laits] from [Abu Amr Al 'Abdi] from [Ali] he said; Murderers cannot inherit. (Degree: authentic. Source: Sunan Ad-Darimi.) 14th Hadith. حَدَّثَنَا زَكَرِيَّا بْنُ عَدِيٍّ حَدَّثَنَا أَبُو بَكْرٍ عَنْ مُطَرِّفٍ عَنْ الشَّعْبِيِّ قَالَ قَالَ عُمَرُ لَا يَرِثُ قَاتِلٌ خَطَأً وَلَا عَمْدًا. Has told us [Zakariya bin Adi] has told us [Abu Bakr] from [Mutharrif] from [Ash Sha'bi] he said; [Umar] said; The murderer has no right to inherit, whether the murder was committed accidentally or intentionally. (Degree: authentic. Source: Sunan Ad-Darimi.) 15th Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ عَنْ سُفْيَانَ عَنْ لَيْثٍ عَنْ طَاوُسٍ عَنْ ابْنِ عَبَّاسٍ قَالَ لَا يَرِثُ الْقَاتِلُ. Having reported to us [Muhammad bin Yusuf] from [Sufyan] from [Laits] from [Thawus] from [Ibn Abbas] he said; Murderers cannot inherit. (Degree: authentic. Source: Sunan Ad-Darimi.) 16th Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ عِيسَى حَدَّثَنَا عَبْدُ الْأَعْلَى عَنْ مَعْمَرٍ عَنْ الزُّهْرِيِّ قَالَ إِذَا اجْتَمَعَ نَسَبَانِ وُرِّثَ بِأَكْبَرِهِمَا يَعْنِي الْمَجُوسَ. Has told us [Muhammad bin Isa] has told us [Abdul A'la] from [Ma'mar] from [Az Zuhri] he said; If two lineages merge then the one who inherits is the older lineage, namely the Majusi. (Degree: authentic. Source: Sunan Ad-Darimi.) 17th Hadith. حَدَّثَنَا حَجَّاجُ بْنُ مِنْهَالٍ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ عَنْ حَمَّادِ بْنِ أَبِي سُلَيْمَانَ قَالَ يَرِثُ مِنْ الْجَانِبِ الَّذِي يَصْلُحُ وَلَا يَرِثُ مِنْ الْجَانِبِ الَّذِي لَا يَصْلُحُ. Has told us [Hajjaj bin [Muhammad bin Al Minhal]] has told us [Hammad bin Salamah] from [Hammad bin Abu Sulaiman] he said; He inherits from the deserving party and does not inherit from the undeserving party. (Degree: authentic. Source: Sunan Ad-Darimi.) 18th Hadith. حَدَّثَنَا حَجَّاجٌ حَدَّثَنَا حَمَّادٌ عَنْ سُفْيَانَ الثَّوْرِيِّ عَنْ رَجُلٍ عَنْ الشَّعْبِيِّ أَنَّ عَلِيًّا وَابْنَ مَسْعُودٍ قَالَا فِي الْمَجُوسِ إِذَا أَسْلَمُوا يَرِثُونَ مِنْ الْقَرَابَتَيْنِ جَمِيعًا. Has told us [Hajjaj] has told us [Hammad] from [Sufyan Ats Tsauri] from [someone] from [Ash Sha'bi] that [Ali] and [Ibn Mas'ud] both said about the Magi converting to Islam; They have the right to inherit from all two relatives. (Degree: authentic. Source: Sunan Ad-Darimi.) 19th hadith. أَخْبَرَنَا يَحْيَى بْنُ حَسَّانَ حَدَّثَنَا ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي امْرَأَةِ الْأَسِيرِ أَنَّهَا تَرِثُهُ وَيَرِثُهَا. Has told us [Yahya bin Hassan] has told us [Ibn Abu Az Zinad] from [his father] from [Umar bin Abdul Aziz] about a woman who was taken prisoner; Indeed, she can inherit her husband and her husband can inherit her. (Degree: authentic. Source: Sunan Ad-Darimi.) 20th hadith. حَدَّثَنَا مُحَمَّدُ بْنُ الْفَضْلِ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ حَدَّثَنِي مَعْمَرٌ عَنْ إِسْحَقَ بْنِ رَاشِدٍ عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي الْأَسِيرِ يُوصِي قَالَ أَجِزْ لَهُ وَصِيَّتَهُ مَا دَامَ عَلَى دِينِهِ لَمْ يَتَغَيَّرْ عَنْ دِينِهِ. Has told us [Muhammad bin Al Fadlal] has told us [Abdullah bin Al Mubarak] has told me [Ma'mar] from [Ishaq bin Rasyid] from [Umar bin Abdul Aziz] about the captive who had a will, he said; I will allow his will as long as he still adheres to his religion and does not change his religion. (Degree: authentic. Source: Sunan Ad-Darimi.) 21st Hadith. أَخْبَرَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ دَاوُدَ عَنْ الشَّعْبِيِّ عَنْ شُرَيْحٍ قَالَ يُوَرَّثُ الْأَسِيرُ إِذَا كَانَ فِي أَيْدِي الْعَدُوِّ. Has told us [Muhammad bin Yusuf] has told us [Sufyan] from [Dawud] from [Ash Sya'bi] from [Syuraih] he said; A captive person has the right to inherit even if he is in the hands of the enemy. (Degree: authentic. Source: Sunan Ad-Darimi.) 22nd Hadith. حَدَّثَنَا مُحَمَّدٌ قَالَ حَدَّثَنَا سُفْيَانُ حَدَّثَنِي مَنْ سَمِعَ إِبْرَاهِيمَ يَقُولُ يُوَرَّثُ الْأَسِيرُ. Has told us [Muhammad] he said; Has told us [Sufyan] has told me [the person who heard] [Ibrahim] he said; Captive people have the right to inherit. (Degree: authentic. Source: Sunan Ad-Darimi.) 23rd Hadith. حَدَّثَنَا الْمُعَلَّى بْنُ أَسَدٍ حَدَّثَنَا وُهَيْبٌ عَنْ دَاوُدَ عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ أَنَّهُ كَانَ لَا يُوَرِّثُ الْأَسِيرَ. It has been told to us [Al Mu'alla bin Asad] has told us [Wuhaib] from [Dawud] from [Sa'id bin Al Musayyab] that he does not give inheritance rights to people who are captured. (Degree: authentic. Source: Sunan Ad-Darimi.) 24th Hadith. أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا الْأَشْعَثُ عَنْ الشَّعْبِيِّ قَالَ كَتَبَ عُمَرُ بْنُ الْخَطَّابِ إِلَى شُرَيْحٍ أَنْ لَا يُوَرِّثَ الْحَمِيلَ إِلَّا بِبَيِّنَةٍ وَإِنْ جَاءَتْ بِهِ فِي خِرَقِهَا. Has told us [Yazid bin Harun] has told us [Al Asy'ats] from [Ash Sya'bi] he said; [Umar bin Al Khaththab] wrote a letter to Syuraih, asking him not to give inheritance rights to someone who was brought to an Islamic land as a child unless there was proof, even if he came with the cloth he used when he was a child. (Degree: authentic. Source: Sunan Ad-Darimi.) 25th Hadith. أَخْبَرَنَا عُبَيْدُ اللَّهِ عَنْ إِسْرَائِيلَ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ قَالَ وَرِّثْ الْحَمِيلَ. Having reported to us [Ubaidullah] from [Isra`il] from [Mansur] from [Ibrahim] he said; Inherit the wealth of people who were brought to Islamic lands when they were children. (Degree: authentic. Source: Sunan Ad-Darimi.) 26th Hadith. حَدَّثَنَا أَبُو سَعِيدٍ مِنْ بَنِي أُمَيَّةَ عَنْ أَبِي بَكْرِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي مَرْيَمَ عَنْ ضَمْرَةَ وَالْفُضَيْلِ بْنِ فَضَالَةَ وَابْنِ أَبِي عَوْفٍ وَرَاشِدٍ وَعَطِيَّةَ قَالُوا لَا يُوَرَّثُ الْحُمَلَاءُ. It has been told to us [Abu Sa'id] from the Umayyads from [Abu Bakr bin Abdullah bin Abu Maryam] from [Dlamrah], [Al Fudlail bin Fadlalah], [Ibn Abu 'Auf], [Rashid] and ['Athiyah], they said; The inheritance of people who were brought to Islamic lands as children cannot be inherited. (Degree: authentic. Source: Sunan Ad-Darimi.) 27th Hadith. حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ قَالَ قَالَ ابْنُ الْمُبَارَكِ حَدَّثَنَا ابْنُ عَوْنٍ عَنْ مُحَمَّدٍ قَالَ ذُكِرَ عِنْدَهُ قَوْلُ مَنْ يَقُولُ فِي الْحَمِيلِ فَأَنْكَرَ ذَلِكَ وَقَالَ قَدْ تَوَارَثَ الْمُهَاجِرُونَ وَالْأَنْصَارُ بِنَسَبِهِمْ الَّذِي كَانَ فِي الْجَاهِلِيَّةِ. Has told us [Sa'id bin Al Mughirah] he said; [Ibn Al Mubarak] said; Has told us [Ibn 'Aun] from [Muhammad] he said; He mentioned the words of a person who said about a person who was taken to an Islamic land when he was still a child. So he denied it and said; The Muhajirin and Ansar people inherited each other because of the lineage of their descendants who were born during the period of ignorance. (Degree: authentic. Source: Sunan Ad-Darimi.) 28th Hadith. حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ عَنْ ابْنِ إِدْرِيسَ عَنْ هِشَامٍ عَنْ الْحَسَنِ وَابْنِ سِيرِينَ قَالَا لَا يُوَرَّثُ الْحَمِيلُ إِلَّا بِبَيِّنَةٍ. It has been told to us by [Abu Bakr bin Abu Syaibah] from [Ibn Idris] from [Hisyam] from [Al Hasan] and [Ibn Sirin] both said; The inheritance of a person brought to an Islamic land as a child cannot be inherited unless there is proof. (Degree: authentic. Source: Sunan Ad-Darimi.) 29th Hadith. حَدَّثَنَا أَبُو بَكْرٍ حَدَّثَنَا جَرِيرٌ عَنْ لَيْثٍ عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ قَالَ لَمْ يَكُنْ أَبُو بَكْرٍ وَعُمَرُ وَعُثْمَانُ يُوَرِّثُونَ الْحَمِيلَ. Having told us [Abu Bakr] had told us [Jarir] from [Laits] from [Hammad] from [Ibrahim] he said; Abu Bakr, Umar and Uthman did not give inheritance rights to people who were brought to Islamic lands as children. (Degree: authentic. Source: Sunan Ad-Darimi.) 30th Hadith. حَدَّثَنَا أَبُو بَكْرٍ حَدَّثَنَا عَبْدُ الرَّحِيمِ الْمُحَارِبِيُّ عَنْ زَائِدَةَ عَنْ أَشْعَثَ بْنِ أَبِي الشَّعْثَاءِ قَالَ أَقَرَّتْ امْرَأَةٌ مِنْ مُحَارِبٍ جَلِيبَةٌ بِنَسَبٍ لَهَا جَلِيبٍ فَوَرَّثَهُ عَبْدُ اللَّهِ بْنُ عُتْبَةَ مِنْ أُخْتِهِ. Has told us [Abu Bakr] has told us [Abdurrahim Al Muharibi] from [Za`idah] from [Ash'ats bin Abu Asy Sya'tsa`] he said; A woman from Muharib who was forcibly taken to a country admitted that she was in the same boat as someone who was also forcibly taken to that country. So [Abdullah bin Utbah] gave the man inheritance rights from his sister's inheritance. (Degree: authentic. Source: Sunan Ad-Darimi.) 31st Hadith. حَدَّثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ حَدَّثَنِي اللَّيْثُ حَدَّثَنِي يُونُسُ عَنْ ابْنِ شِهَابٍ عَنْ رَجُلٍ قَالَ عِنْدَ فِرَاقِ الدُّنْيَا أَنَا مَوْلَى فُلَانٍ قَالَ يَرِثُ مِيرَاثَهُ لِمَنْ سَمَّى أَنَّهُ مَوْلَاهُ عِنْدَ فِرَاقِ الدُّنْيَا إِلَّا أَنْ يَأْتُوا عَلَيْهِ بِبَيِّنَةٍ بِغَيْرِ ذَلِكَ يَرُدُّونَ بِهِ قَوْلَهُ فَيُرَدُّ مِيرَاثُهُ إِلَى مَا قَامَتْ بِهِ الْبَيِّنَةُ. Has told us [Abdullah bin Salih] has told me [Laits] has told me [Yunus] from [Ibn Shihab] about someone who said when he was about to die; I'm a former slave and so and so. He said; The inheritance is passed on to the person who is said to be the master when he dies unless they show evidence that refutes this. Then the inheritance is returned to those who are proven right. (Degree: authentic. Source: Sunan Ad-Darimi.) 32nd Hadith. أَخْبَرَنَا أَبُو نُعَيْمٍ حَدَّثَنَا شَرِيكٌ عَنْ مُحَمَّدِ بْنِ سَالِمٍ عَنْ الشَّعْبِيِّ عَنْ عَلِيٍّ وَعَبْدِ اللَّهِ قَالَا وَلَدُ الزِّنَا بِمَنْزِلَةِ ابْنِ الْمُلَاعَنَةِ. Has told us [Abu Nu'aim] has told us [Sharik] from [Muhammad bin Salim] from [Ash Sha'bi] from [Ali] and [Abdullah] both said; The inheritance of the child of adultery occupies the position of the child of the woman affected by li'an. It has been told to us [Abu Bakr bin Abu Syaibah] has told us [Rauh] from [Muhammad bin Abu Hafshah] from [Az Zuhri] from [Ali bin Husain] that he does not give inheritance rights to the child of adultery even if someone recognizes him as a child. Source: Sunan Ad-Darimi.) 34th Hadith. حَدَّثَنَا عَبْدُ اللَّهِ بْنُ صَالِحٍ حَدَّثَنِي بَكْرُ بْنُ مُضَرَ عَنْ عَمْرٍو يَعْنِي ابْنَ الْحَارِثِ عَنْ بُكَيْرٍ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ قَالَ أَيُّمَا رَجُلٍ أَتَى إِلَى غُلَامٍ يَزْعُمُ أَنَّهُ ابْنٌ لَهُ وَأَنَّهُ زَنَى بِأُمِّهِ وَلَمْ يَدَّعِ ذَلِكَ الْغُلَامَ أَحَدٌ فَهُوَ يَرِثُهُ قَالَ بُكَيْرٌ وَسَأَلْتُ عُرْوَةَ عَنْ ذَلِكَ فَقَالَ مِثْلَ قَوْلِ سُلَيْمَانَ بْنِ يَسَارٍ وَقَالَ عُرْوَةُ بَلَغَنَا أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ. Has told us [Abdullah bin Salih] has told me [Bakr bin Mudlar] from [Amru] namely Ibn Al Harith, from [Bukair] from [Sulaiman bin Yasar] he said; Whoever comes to a child and admits that he is his child and admits that he has committed adultery with his mother, while no one else claims that the child is his own, then the child can inherit it. Bukair said; I once asked [Urwah] about it. So he answered as Sulaiman bin Yasar said. Urwah also said; News has come to us that the Prophet sallallaahu 'alaihi wasallam said: "Children belong to the owner of the bed (wife) and (the retribution) for a man who commits adultery is a stone (stoning)." Has told us [Ibrahim bin Musa] from [Hafsh bin Ghiyats] from [Amr] from [Al Hasan] he said; The child of a woman affected by li'an is the same as the child of adultery. Source: Sunan Ad-Darimi.) 36th Hadith. حَدَّثَنَا سَعِيدُ بْنُ الْمُغِيرَةِ عَنْ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ أَوْ يُونُسَ عَنْ الزُّهْرِيِّ فِي أَوْلَادِ الزِّنَا قَالَ يَتَوَارَثُونَ مِنْ قِبَلِ الْأُمَّهَاتِ وَإِنْ وَلَدَتْ تَوْأَمًا فَمَاتَ وَرِثَ السُّدُسَ. Having told us [Sa'id bin Al Mughirah] from [Ibn Al Mubarak] from [Ma'mar] or [Yunus] from [Az Zuhri] about the children of adultery, he said; Heirs from the mother's lineage can inherit from each other, if an adulterous child has a child and then dies, the child gets one-sixth of the inheritance. Has told us [Abu Bakr bin Abu Syaibah] he said; Having told us [Husyaim] from [Mughirah] from [Syibak] from [Ibrahim] he said; The child of adultery cannot inherit, cannot inherit from a person whose father has not been convicted or has his mother by marriage or purchase. Source: Sunan Ad-Darimi.) 38th Hadith. حَدَّثَنَا زَيْدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ رَاشِدٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى أَنَّ لِكُلِّ مُسْتَلْحَقٍ اسْتُلْحِقَ بَعْدَ أَبِيهِ الَّذِي ادَّعَاهُ وَرَثَتُهُ بَعْدَهُ فَقَضَى إِنْ كَانَ مِنْ أَمَةٍ يَمْلِكُهَا يَوْمَ يَطَؤُهَا فَقَدْ لَحِقَ بِمَنْ اسْتَلْحَقَهُ وَلَيْسَ لَهُ مِمَّا قُسِمَ قَبْلَهُ مِنْ الْمِيرَاثِ شَيْءٌ وَمَا أَدْرَكَ مِنْ مِيرَاثٍ لَمْ يُقْسَمْ فَلَهُ نَصِيبُهُ وَلَا يَلْحَقُ إِذَا كَانَ الَّذِي يُدْعَى لَهُ أَنْكَرَهُ وَإِنْ كَانَ مِنْ أَمَةٍ لَا يَمْلِكُهَا أَوْ حُرَّةٍ عَاهَرَهَا فَإِنَّهُ لَا يَلْحَقُ وَلَا يَرِثُ وَإِنْ كَانَ الَّذِي يُدْعَى لَهُ هُوَ ادَّعَاهُ وَهُوَ وَلَدُ زِنَا لِأَهْلِ أُمِّهِ مَنْ كَانُوا حُرَّةً أَوْ أَمَةً. It has been told to us by [Zaid bin Yahya] from [Muhammad bin Rasyid] from [Sulaiman bin Musa] from [Amr bin Syu'aib] from [his father] from [his grandfather] that the Messenger of Allah (peace and blessings of Allaah be upon him) once decided: "That every person who places a trust in himself, he will be attributed to his father whom he acknowledges and his heir will be after him." Then he decided: "If he comes from a female slave who was owned on the day he had sexual relations with her, then he follows the line of the person who is recognized as his father and he does not get the slightest part of the inheritance that has been previously distributed. As for the inheritance that has not been divided, then he gets a share of it. However, if the person who is recognized as his father denies it, then he has no right to follow the line of inheritance to him. And if he comes from a slave who is not his own or a free woman who is in adultery, then he does not follow the line and gets an inheritance. Even if the person who is recognized as the father admit it. She still has the status of an adulterous child who follows her mother's family, both free women and slaves." (Degree: authentic. Source: Sunan Ad-Darimi.) 39th Hadith. حَدَّثَنَا أَبُو نُعَيْمٍ عَنْ الْحَسَنِ عَنْ عُمَيْرِ بْنِ يَزِيدَ قَالَ سَأَلْتُ الشَّعْبِيَّ عَنْ مَمْلُوكٍ لِي وَلَدُ زِنًا قَالَ لَا تَبِعْهُ وَلَا تَأْكُلْ ثَمَنَهُ وَاسْتَخْدِمْهُ. Has told us [Abu Nu'aim] from [Al Hasan] from [Umair bin Yazid] he said; I once asked [Ash Sya'bi] about my slave who was born as a result of adultery. He answered; Don't sell him and eat the money from the sale, but help him. (Degree: authentic. Source: Sunan Ad-Darimi.) 40th Hadith. حَدَّثَنَا مَرْوَانُ بْنُ مُحَمَّدٍ عَنْ سَعِيدٍ عَنْ الزُّهْرِيِّ سُئِلَ عَنْ وَلَدِ زِنَا يَمُوتُ قَالَ إِنْ كَانَ ابْنَ عَرَبِيَّةٍ وَرِثَتْ أُمُّهُ الثُّلُثَ وَجُعِلَ بَقِيَّةُ مَالِهِ فِي بَيْتِ الْمَالِ وَإِنْ كَانَ ابْنَ مَوْلَاةٍ وَرِثَتْ أُمُّهُ الثُّلُثَ وَوَرِثَ مَوَالِيهَا الَّذِينَ أَعْتَقُوهَا مَا بَقِيَ قَالَ مَرْوَانُ سَمِعْتُ مَالِكًا يَقُولُ ذَلِكَ. Has told us [Marwan bin Muhammad] from [Sa'id] from [Az Zuhri] he was asked about the child of adultery who died, he answered; If he is an Arab child, his mother gets a third of the inheritance, while the rest is handed over to Baitul Mal. If he was the child of a slave, his mother received a third of the inheritance, while the rest of the property was given to his master who had freed his mother.
