كتاب «اختلاف الأئمة العلماء» لابن هبيرة يُعد من أهم كتب الفقه المقارن التي لا يستغني عنها المسلم في الحاضر والمستقبل، ومن أبرز الكتب التي قدمت سردًا جديدًا وفريدًا من نوعه حيث سلط الضوء على الاختلاف بين الأئمة العلماء في أبواب الفقه، وبين لنا أن هذا الاختلاف رحمة، وناقش الاختلاف المقصود هنا والفرق بينه وبين الاختلافات الأخرى. ويشتمل الكتاب على الأحكام الشرعية المتعلقة بأمور العبادات والمعاملات وغيرها واختلاف آراء العلماء بالنسبة لهذه الأمور، وكان أول من دَوَّن الفقه: أبو حنيفة النعمان وبعده الإمام مالك ثم جاء الإمام الشافعي وبعده الإمام أحمد بن حنبل، فانحصرت مسائل أهل السنة والجماعة فيهم. …

Translation

The book “The Differences of Imams and Scholars” by Ibn Hubayra is considered one of the most important books of comparative jurisprudence that a Muslim cannot do without in the present and the future. It is one of the most prominent books that presented a new and unique narrative of its kind, as it shed light on the difference between imams and scholars in the chapters of jurisprudence, and showed us that this difference is a mercy, and discussed the intended difference here and the difference between it and other differences. The book includes legal rulings related to matters of worship, transactions, etc., and the differing opinions of scholars regarding these matters. The first to write down jurisprudence was: Abu Hanifa al-Numan, and after him Imam Malik. Then came Imam al-Shafi’i and after him Imam Ahmad ibn Hanbal, so the issues of the Sunnis and the community were confined to them. …
