هذا الكتاب يتناول النظام القضائي في الفقه الإسلامي، مبيناً أصوله وأهميته في تحقيق العدل بين الناس وحماية حقوقهم. يتناول المؤلف محمد رأفت عثمان تاريخ القضاء في العصور الإسلامية المبكرة، بدءاً من عهد النبي محمد صلى الله عليه وسلم ومروراً بالخلافة الراشدة، مستعرضاً أحكام الشريعة المتعلقة باختيار القضاة وشروطهم وصلاحياتهم. ويستعرض الكتاب أيضاً مفهوم التحكيم وأحكامه في النظام القضائي الإسلامي.
Translation
This book deals with the judicial system in Islamic jurisprudence, explaining its origins and importance in achieving justice among people and protecting their rights. The author, Muhammad Raafat Othman, deals with the history of the judiciary in the early Islamic eras, starting with the era of the Prophet Muhammad, may God bless him and grant him peace, and continuing through the Rightly Guided Caliphate, reviewing the provisions of Sharia law related to the selection of judges, their conditions, and their powers. The book also reviews the concept of arbitration and its rulings in the Islamic judicial system.
