Welcome to the study of authentic hadith selected by ULYAH. God bless you بْنُ حَرْبٍ عَنْ الْأَعْمَشْ وَعَلِيٍّ وَزَيْدٍ أَنَّهُمْ قَالُوا الْوَلَاءُ لِلْكُبْرِ. Has told us [Muhammad bin Isa] has told us [Abdus Salam bin Harb] from [Al A'masy] from [Ibrahim] from [Umar], [Ali] and [Zaid] that they said; Wala` for the older ones. (Degree: authentic. Source: Sunan Ad-Darimi.) 2nd hadith. God bless you God bless you مَوْلًى كَانَ أَعْتَقَهُ أَبُوهُمَا فَمَاتَ أَحَدُهُمَا وَتَرَكَ وَلَدًا قَالَ كَانَ عَلِيٌّ وَزَيْدٌ وَعَبْدُ اللَّهِ يَقُولُونَ الْوَلَاءُ لِلْكُبْرِ. Has told us [Muhammad bin Isa] has told us [Abu 'Awanah] from [Mughirah] from [Ibrahim] about two brothers who inherited former slaves that their father had freed. Then one of the two brothers died and left a son, he said; [Ali], [Zaid] and [Abdullah] said; Wala` for the older ones. (Degree: authentic. Source: Sunan Ad-Darimi.) 3rd Hadith. God willing, God willing, God willing, God willing زَيْدٍ قَالَ سَمِعْتُ مَطَرًا الْوَرَّاقَ يَقُولُ قَالَ عُمَرُ وَعَلِيٌّ الْوَلَاءُ لِلْكُبْرِ. Has told us [Muhammad bin Isa] has told us [Hammad bin Zaid] he said; I heard [Mathar Al Warraq] say; [Umar] and [Ali] said; Wala` for the older ones. (Degree: authentic. Source: Sunan Ad-Darimi.) 4th Hadith. God willing, God willing, God willing, God willing God willing أَبِيهِ قَالَ الْوَلَاءُ لِلْكُبْرِ. Has reported to us [Muhammad bin Isa] from [Rauh] from [Ibnu Juraij] from ['Atha`] and Ibn Juraij also from [Ibn Thawus] from [his father] he said; Wala` for the older ones. (Degree: authentic. Source: Sunan Ad-Darimi.) 5th Hadith. God willing عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ قَالَ الْوَلَاءُ لِلْكُبْرِ. Having reported to us [Ubaidullah bin Musa] from [Isra`il] from [Mansur] from [Ibrahim] he said; Wala` for the older ones. (Degree: authentic. Source: Sunan Ad-Darimi.) 6th Hadith. God bless you God bless you God willing الْمُسْلِمِينَ قَالَ سُفْيَانُ وَكَذَلِكَ نَقُولُ. Has told us [Abu Nu'aim] has told us [Sufyan] from [Mutharrif] from [Ash Sha'bi] and Sufyan from [Yunus] from [Al Hasan] about someone making a guardian for another person, both said; He is the same as other muslimin people. Sufyan said; We also think so. (Degree: authentic. Source: Sunan Ad-Darimi.) 7th Hadith. God willing God willing, God willing, God willing, God willing, God willing مَوْهَبٍ قَالَ سَمِعْتُ تَمِيمًا الدَّارِيَّ يَقُولُ سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا السُّنَّةُ فِي الرَِ God willing فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ هُوَ God willing. Has told us [Abu Nu'aim] has told us [Abdul Aziz bin Umar bin Abdul Aziz] from [Abdullah bin Mauhab] he said; I once heard [Tamim Ad Dari] say; I asked Rasulullah sallallaahu 'alaihi wasallam; O Messenger of Allah, what is the sunnah to do to an infidel who converts to Islam in the presence of a muslim? Rasulullah shallallahu 'alaihi wasallam answered: "That person (a non-believer who converts to Islam) has more rights over life and death." (Degree: authentic. Source: Sunan Ad-Darimi.) 8th Hadith. God willing God bless you God willing وَيَرِثُهُ. Having told us [Ubaidullah] from [Isra`il] from [Mansur] from [Ibrahim] he said; He was once asked about a man from the experts of darkness who converted to Islam in front of someone? He answered; The man pays the person's diyat and he has the right to inherit it. (Degree: authentic. Source: Sunan Ad-Darimi.) 9th Hadith. God bless you مُغِيرَةَ عَنْ إِبْرَاهِيمَ قَالَ تَرِثُ الْمَرْأَةُ مِنْ دِيَةِ زَوْجِهَا فِي الْعَمْدِ وَالْخَطَإِ. Has told us [Sulaiman bin Harb] has told us [Syu'bah] from [Mughirah] from [Ibrahim] he said; The wife has the right to inherit her husband's diyat in cases of intentional or unintentional murder. (Degree: authentic. Source: Sunan Ad-Darimi.) 10th Hadith. God willing مُغِيرَةَ عَنْ إِبْرَاهِيمَ قَالَ الدِّيَةُ عَم اللَّهِ. Has told us [Abu An Nu'man] has told us [Abu 'Awanah] from [Mughirah] from [Ibrahim] he said; Diyat is distributed based on the distribution that has been determined by Allah. (Degree: authentic. Has told us [Muslim bin Ibrahim] has told us [Wuhaib] has told us [Ayyub] from [Abu Qilabah] he said; The method for distributing diyat is the same as for dividing inheritance. (Degree: authentic. God bless you God willing, God willing, God willing, God willing, God willing God willing, God willing, God willing, God willing الْإِخْوَةُ مِنْ الْأُمِّ مِنْ الدِّيَةِ. It has been told to us [Sulaiman bin Harb] has told us [Hammad bin Salamah] from [Humaid] and [Dawud bin Abu Hind] that [Umar bin Abdul Aziz] decreed that brothers from the same mother inherit the diyat. (Degree: authentic. Source: Sunan Ad-Darimi.) 13th Hadith. God willing God willing God willing, God willing, God willing, God willing وَفَرَائِضِهِ. Has told us [Abdullah bin Salih] has told me [Al Laits] has told me [Yunus] from [Ibn Shihab] he said; Diyat is an inheritance distributed among the heirs of the murdered victim in accordance with the Book of Allah and the distribution that He has determined. (Degree: authentic. Source: Sunan Ad-Darimi.) 14th Hadith. God bless you دِينَارٍ عَنْ بَعْضّ قَالَ لَقَدْ ظَلَمَ مَنْ لَمْ يُوَرِّثْ الْإِخْوَةَ مِنْ God willing. Has told us [Qabishah] has told us [Sufyan] from [Amr bin Dinar] from [some of Ibn Al Hanafiyyah's sons] from [Ali] he said; It is true that people who do not give inheritance rights from diyat assets to brothers and sisters of the same mother have indeed committed injustice. (Degree: authentic. Source: Sunan Ad-Darimi.) 15th Hadith. God willing خَالِدٍ أَخْبَرَنَا ابْنُ سَالِمٍ عَنْ الشَّعْبِيِّ عَنْ عُمَرَ وَعَلِيٍّ وَزَيْدٍ قَالُوا الدِّيَةُ تُورَثُ كَمَا يُورَثُ الْمَالُ خَطَؤُهُ وَعَمْدُهُ. Has told us [Abdullah bin Sa'id] has told us [Abu Khalid] has told us [Ibn Salim] from [Ash Sha'bi] from [Umar], [Ali] and [Zaid]. They said; Diyat can be inherited like property that can be inherited, whether diyat is an accidental or deliberate murder. (Degree: authentic. Source: Sunan Ad-Darimi.) 16th Hadith. God bless you may Allah bless him and give him peace God willing شَيْئًا قَالَ عَبْد اللَّهِ بَعَْ إِسْمَعِيلَ وَعَامِرٍ رَجُلًا. Has told us [Ja'far bin 'Aun] has told us [Isma'il] from [Amir] he said; [Ali] did not give any inheritance rights to his mother's brothers, husbands and wives from the diyat. Abdullah said; Some of them included someone (the narrator in the hadith sanad) between Isma'il and Amir. (Degree: authentic. Source: Sunan Ad-Darimi.) 17th Hadith. God willing, God willing, God willing, God willing سَلَمَةَ عَنْ زِيَادٍ الْأَعْلَمْ يُوَرَّثُ الْإِخْوَةُ مِنْ الْأُمِّ مِنْ الدِّيَةِ. Has told us [Sulaiman bin Harb] from [Hammad bin Salamah] from [Ziyad Al A'lam] from [Al Hasan] he said; One-mother's brothers cannot inherit property derived from diyat. (Degree: authentic. Source: Sunan Ad-Darimi.) 18th Hadith. God willing الزِّنَادْ God bless you مَوْتُهُمْ فِي هَدْمٍ أَوْ غَرَقٍ فَإِنَّهُمْ لَا يَتَوَارَثُونَ يَرِثُهُمْ الْأَحْيَاءُ. Has told us [Yahya bin Hassan] has told us [Ibn Abu Az Zinad] from [his father] from [Kharijah bin Zaid] from [Zaid bin Thabit] he said; Every person who has the right to inherit (from property) who dies due to being hit by rubble or drowning, they cannot inherit from each other. But living heirs can inherit them. (Degree: authentic. Source: Sunan Ad-Darimi.) 19th hadith. God willing God willing كُتُبِ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ فِي الْقَوْمَ God willing لَا يُوَرَّثُ الْأَمْوَاتُ بَعْضُهُمْ مِنْ بَعْضٍ وَيُوَرَّثُ God. Has told us [Yahya bin Hassan] has told us [Hammad bin Zaid] from [Yahya bin 'Atiq] he said; I once read part of a letter to [Umar bin Abdul Aziz] about several people who were crushed by the collapse of their houses, it is not known which of them died first. He answered; People who die cannot inherit from each other, but living heirs can inherit from people who have died. (Degree: authentic. Source: Sunan Ad-Darimi.) 20th hadith. حَدَّثَنَا نُعَيْم0 مُحَمَّدٍ حَدَّثَنَا جَعْفَرٌ عَنْ أَبِيهِ أَنَّ أُمَّ message love كُلُّ وَاحِدٍ مِنْهُمَا مِنْ صَاحِبِهِ وَأَنَّ أَهْلَ God willing يَتَوَارَثُوا. It has been told to us [Nu'aim bin Hammad] from [Abdul Aziz bin Muhammad] has told us [Ja'far] from [his father] that Umm Kulthum and her son, Zaid, both died on the same day. Then there were two people who shouted on the road meeting, but neither of them could inherit. People who died during the Harrah incident cannot inherit from each other and people who died during the Shiffin incident also cannot inherit from each other. (Degree: authentic. God willing, God willing, God willing, God willing لَيْلَى عَنْ الشَّعْبِيِّ أَنَّ بَيْتًا بِالشَّامِ وَقَعَ عَلَى قَوْمٍ فَوَرَّثَ عُمَرُ بَعْضَهُمْ مِنْ بَعْضٍ. It has been reported to us [Ja'far bin 'Aun] has informed us [Ibn Abu Laila] from [Ash Sya'bi] that in Syria a house collapsed and fell on its occupants. So [Umar] gave inheritance to some of them from others. (Degree: authentic. Source: Sunan Ad-Darimi.) 22nd Hadith. God bless you God willing, God willing, God willing, God willing God willing. Has told us [Abu Nu'aim] has told us [Sufyan] from [Huraisy] from [his father] from [Ali] that he gave inheritance rights to two male brothers who were killed in the Shiffin incident. Any one of them can inherit the other. (Degree: authentic. Source: Sunan Ad-Darimi.) 23rd Hadith. Allah's blessings God willing وَتَرَكَ عَمَّتَهُ وَخَالَتَهُ فَأَعْطَى عُمَرُ الْعَمَّةَ نَصِيبَ الْأَخِ وَأَعْطَى الْخَالَةَ نَصِيبَ الْأُخْتِ. [Yazid bin Harun] has informed us [Humaid] from [Bakr bin Abdullah Al Muzani] that a man died and left behind an aunt from his father's side and an aunt from his mother's side. So [Umar] gave his paternal aunt his share like a brother's share and his maternal aunt his share like a sister's share. (Degree: authentic. Source: Sunan Ad-Darimi.) 24th Hadith. أَخْبَرَنَا أَحْمَدُ بْنُ عَبْدِ اللَّهّ God willing, God willing, God willing, God willing بِرَحِمٍ أُعْطِيَ بِرَحِمِهِ الَّتِي يُدْلِي بِهَا. Has told us [Ahmad bin Abdullah] has told us [Abu Shihab] from [Al A'masy] from [Ibrahim] he said; Whoever has a relationship with one womb, then he is given an inheritance because of the relationship of one womb which causes them to be connected. (Degree: authentic. Source: Sunan Ad-Darimi.) 25th Hadith. God bless you may Allah bless him and give him peace of mind. God willing قَالَ الْمَالُ لِابْنَةِ أَخِيهِ. Has told us [Ahmad bin Abdullah] has told us [Abu Shihab] he said; has told me [Abu Ishaq Asy Syaibani] from [Ash Sya'bi] about a man who left behind a paternal aunt and a brother's daughter, he said; Property is given to a brother's daughter. (Degree: authentic. Source: Sunan Ad-Darimi.) 26th Hadith. God bless you God willing may Allah bless him and give him peace and blessings وَارِثٌ. Has told us [Abu Nu'aim] has told us [Sharik] from [Laits] from [Muhammad bin Munkadir] from [Abu Hurairah] from the Prophet sallallaahu 'alaihi wasallam, He said: "The maternal uncle is the heir." (Degree: authentic. Source: Sunan Ad-Darimi.) 27th Hadith. Allah's blessings God willing, God willing, God willing, God willing, God willing يُوَرِّثَا خَالًا. It has been told to us [Abu Nu'aim] has told us [Hasan] from [Ubaidah] from [Ibrahim] that [Umar] and [Abdullah] were of the opinion that the maternal aunt could inherit. (Degree: authentic. Source: Sunan Ad-Darimi.) 28th Hadith. God bless you God willing قَالَ الْمَالُ لِابْنَةِ الْأَخِ حَدَّثَنَا أَبُو نُعَيْمٍ Allah's blessings إِبْرَاهِيمَ قَالَ لِلْعَمَّةِ. Having told us [Abu Nu'aim] had told us [Hasan] from [Sulaiman Abu Ishaq] from [Ash Sha'bi] about his maternal aunt and his brother's daughter, he said; Inheritance is given to a brother's daughter. Having told us [Abu Nu'aim] had told us [Hasan] from [Sulaiman] from [some of them] from [Ibrahim] he said; The property was given to his paternal aunt. (Degree: authentic. Source: Sunan Ad-Darimi.) 29th Hadith. God bless you God willing قَالَ أَعْطِي الْمَالَ لِابْنَةِ الْأَخِ. Having told us [Abu Nu'aim] had told us [Sufyan] from [Ash Syaibani] from [Ash Sya'bi] about the daughter of his brother and paternal aunt, he said; Property is given to a brother's daughter. (Degree: authentic. Source: Sunan Ad-Darimi.) 30th Hadith. God bless you قَالَ كَانَ مَسْرُوقٌ يُنَزِّلُ الْعَمَّةَ بِمَنْزِلَةِ God willing God willing. Has told us [Abu Nu'aim] has told us [Yunus] from [Amir] he said; [Masruq] places the paternal aunt in the same position as the father if the deceased does not have a father and the maternal aunt in the same position as the mother if the deceased does not have a mother. (Degree: authentic. Source: Sunan Ad-Darimi.) 31st Hadith. God willing مُحَمَّدِ بْنِ حَبَّانَ نَسَبَهُ إِلَى جَدِّهِ عَنْ or وَاسِعِ بْنِ حَبَّانَ قَالَ تُوُفِّيَ ابْنُ الدَّحْدَاحَةِ وَكَانَ أَتِيًّا وَهُوَ الَّذِي لَا يُعْرَفُ لَهُ أَصْلٌ فَكَانَ فِي بَنِي الْعَجْلَانِ وَلَمْ يَتْرُكْ عَقِبًا فَقَالَ رَسُولُ اللَّهِ صَلَّّ بْنِ عَدِيٍّ هَلا نَعْرِفُهُ يَا رَسُولَ اللَّهِ فَدَعَا ابْنَ أُخْتِهِ فَأَعْطَاهُ مِيرَاثَهُ. Having told us [Ya'la] from [Muhammad bin Ishaq] from [Muhammad bin Habban] he attributed it to his grandfather from his uncle [Wasi' bin Habban] he said; Ibn Ad-Dahdahah died and he was an immigrant whose origins were unknown. He lived in Bani Al-'Ajlan and did not leave any children. So Rasulullah sallallaahu 'alaihi wasallam asked 'Ashim bin Adi; "Do you know that he is related to you?" He answered; We do not know, O Messenger of Allah. So he called his sister's son and to his sister's son he gave his inheritance. (Degree: authentic. Source: Sunan Ad-Darimi.) 32nd Hadith. God bless you God bless you God willing فَقَالَ كَانَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ يُنَزِّلُ God willing بِمَنْزِلَةِ أَخِيهَا. Has told us [Abu Nu'aim] has told us [Abu Hani`] he said; [Amir] was once asked about a woman or man who died and left behind a maternal aunt and a paternal aunt. There is no heir and no one in the same womb apart from the two of them. So he said; [Abdullah Mas'ud] placed maternal aunts in the position of mothers and paternal aunts in the position of brothers. God bless you God willing, God willing, God willing, God willing, God willing God willing God willing, God willing, God willing, God willing may Allah bless him and give him peace يَكُونَ مُفْلِسًا فَلَا يَجُوزُ إِقْرَارُهُ. Has told us [Ahmad bin Abdullah] has told us [Abu Shihab] from [Amr] from [Al Hasan] about a man who, when he died, admitted that he owed someone a thousand dirhams and another person gave evidence that he (the deceased) also owed him a thousand dirhams. While the deceased only left behind one thousand dirhams, he said; The property is divided into two, each person gets half, unless the deceased is a person who has no property then his confession is not justified. (Degree: authentic. Source: Sunan Ad-Darimi.) 34th Hadith. أَخْبَرَنَا أَبُم ذَكَرْتَ فِي الْأَخَوَيْنَ يَدْخُلُ عَلَيْهِ فِي نَصِيبِهِ قُلْتُ مَنْ ذَكَرَهُ قَالَ جَابِرٌ عَنْ عَامِرٍ عَنْ عَلِيٍّ. Having informed us [Abu Nu'aim] he said; I asked [Sharik]; What is the history you mentioned about two brothers, one of whom claimed to be a brother? He answered; The person who admits this is included in your section. I asked; Who narrated it? He answered; [Jabir] from [Amir] from [Ali]. (Degree: authentic. Source: Sunan Ad-Darimi.) 35th Hadith. God willing God willing God willing, God willing, God willing, God willing بِمَنْزِلَةِ عَبْدٍ يَكُونُ بَيْنَ الْإِخْوَةِ فَيَعْتِقَ أَحَدُهُمْ love يَقُولُونَ لَا يَدْخُلُ إِلَّا فِي نَصِيبِ الَّذِي اعْتَرَفَ بِهِ. Having told us [Abu Bakr bin Abu Syaibah] had told us [Abdurrahman bin Muhammad Al Muharibi] from [Al A'masy] from [Ibrahim] about brothers where some of them claimed to be brothers and some of them did not claim to be brothers, he said; The brother who did not claim to be a brother entered with them like a slave owned by several brothers, then one of them gave away his share. He said again; [Amir], [Hakam] and their companions said; He does not enter except among the brothers who claim to be his brothers. (Degree: authentic. Source: Sunan Ad-Darimi.) 36th Hadith. God willing أَخَوَيْنِ فَادَّعَي love لِلَّذِي لَمْ يَدَّعِ ثَلَاثَةٌ وَلِلْمُدَّعِي سَهْمَانِ وَلِلْمُدَّعَى سَهْمٌ. Having told us [Abu Bakr] from [Waki'] he said; If there are two brothers, then one of them claims to be a brother and the other does not claim to be a brother, [Ibn Abu Laila] said; The division of his inheritance from six. The person who does not confess gets three shares, the person who admits gets two shares and the person who admits gets one share. (Degree: authentic. Source: Sunan Ad-Darimi.) 37th Hadith. God bless you God willing God willing, God willing, God willing, God willing may Allah bless him and give him peace and blessings قَالَ هِيَ مِنْ تِسْعَةٍ يُخْرِجُ ثُلُثَهُ فَلَهُ سَهْمُهُ God bless you عَلَيْهِمْ جَمِيعًـ رَدَّ عَلَى نَفْسِهِ. Has told us [Yunus bin Muhammad] has told us [Abu 'Awanah] from [Mughirah] from [Hammad] about a man who had three sons. The man said; One third of my wealth for my youngest child. The second child said; I allowed it and the eldest son said; I don't allow it. He answered; The division of this inheritance is from nine. A third is given out, those who are not allowed get their share and one part for those who are allowed. Hammad said; Parts are returned to them. Meanwhile [Amir] said; The person who refuses, actually rejects himself. (Degree: authentic. Source: Sunan Ad-Darimi.) 38th Hadith. God willing ادَمَ عَنْ شَرِيكٍ عَنْ خَالِدٍ عَنْ ابْنِ God willing, God willing, God willing, God willing God willing. Has told us [Abu Bakr bin Abu Syaibah] has told us [Yahya bin Adam] from [Syarik] from [Khalid] from [Ibnu Sirin] from [Syuraih] about someone who claimed to be the deceased's brother, he said; He must show proof that he is his brother. (Degree: authentic. Source: Sunan Ad-Darimi.) 39th Hadith. Allah's blessings God willing, God willing, God willing, God willing عِنْدَ مَوْتِهِ بِأَلْفِ دِرْهَمٍ مُضَارَبَةً وَأَلْفٍ God willing God bless you الْمُضَارَبَةِ. Has told us [Abu An Nu'man] has told us [Abu 'Awanah] from [Mughirah] from [Al Harits Al 'Ukli] about a person who admitted when he was about to die that he had a loan of one thousand dirhams in mudlarabah and a debt of one thousand dirhams. But he did not confess except one thousand dirhams, he said; Debts are paid off first. If there is any remaining (from the assets), then it is given to the person who gave the loan in mudlarabah. God willing God bless you God willing God willing, God willing, God willing, God willing. يَدْخُلُ عَلَيْهِمْ بِالْحِصَّةِ ثُمَّ قَالَ الشَّعْبِيُّ مَا أُرَى أَنْ يَكُونَ مِيرَاثًا حَتَّى يُقْضَى الدَّيْنُ. Has told us [Abu Nu'aim] has told us [Hasan] from [Mutharrif] from [Ash Sya'bi] about someone who died and left assets worth three hundred dirhams and three sons. Then someone admitted that the deceased owed him a hundred dirhams. One of his children confirmed this confession. He said; The debt is included in their share of justification. Then Ash Sya'bi said; I don't think the deceased has an inheritance until the debt is paid off. (Degree: authentic. Source: Sunan Ad-Darimi.)
